Relative to Elder and Dependent Adult Abuse Awareness Month.

This measure would proclaim and acknowledge the month of June 2023 as Elder and Dependent Adult Abuse Awareness Month in California and would reiterate the importance of annually recognizing Elder and Dependent Adult Abuse Awareness Month in the state.

Adoption facilitators.

Existing law generally sets forth the procedures and requirements for an adoption and authorizes an adoption facilitator to provide specific adoption services, including advertising for the purpose of soliciting parties to an adoption or locating children for an adoption or acting as an intermediary between the parties to an adoption, and charging a fee or other valuable consideration for services rendered. This bill would repeal the provisions relating to adoption facilitators and would expressly prohibit a person or organization from engaging in specified activities relating to adoption, unless the person or organization is either licensed as an adoption agency by the State Department of Social Services or an attorney licensed to practice law in California. The bill would make various conforming changes.

California Environmental Quality Act: groundwater recharge projects: Judicial Council rules of court.

The California Environmental Quality Act (CEQA) requires, among other things, a lead agency, as defined, to prepare, or cause to be prepared, and certify the completion of an environmental impact report on a project that it proposes to carry out or approve that may have a significant effect on the environment or to adopt a negative declaration if it finds that the project will not have that effect. CEQA establishes a procedure by which a person may seek judicial review of the decision of the lead agency made pursuant to CEQA. Existing law, the Sustainable Groundwater Management Act, requires all groundwater basins designated as high- or medium-priority basins by the Department of Water Resources to be managed under a groundwater sustainability plan or coordinated groundwater sustainability plan, except as specified. This bill would require the Judicial Council to adopt a rule of court to establish procedures requiring actions or proceedings brought to attack, review, set aside, void, or annul the certification of an environmental impact report, or the granting of any project approvals, for groundwater recharge projects, as described, except as provided, that implement a groundwater sustainability plan or an interim groundwater sustainability plan, as described, that would require the actions or proceedings, including any appeals, to be resolved within 270 days of the filing of the certified record of proceedings with the court. The bill would also include a related statement of legislative intent.

Teacher credentialing: Interstate Teacher Mobility Compact.

Existing law requires the Commission on Teacher Credentialing to, among other duties, establish standards for the issuance and renewal of credentials, certificates, and permits. Under existing law, California is a party to The Interstate Agreement on Qualification of Educational Personnel, a compact designed to support the movement of teachers and other professional educational personnel among the states party to it, and to authorize specific interstate educational personnel contracts to achieve that end. This bill would ratify the Interstate Teacher Mobility Compact, the purpose of which is to facilitate the mobility of teachers across the member states, with the goal of supporting teachers through a new pathway to licensure. The compact would, among other things, require member states, in their sole discretion, to make certain determinations about teacher licensure for teachers from other member states, as provided, and create and establish a joint public agency known as the Interstate Teacher Mobility Compact Commission. This compact would only become effective if the compact statute is enacted into law in ten member states, as provided.

Child Abuse Central Index.

Existing law designates certain individuals, such as teachers, peace officers, physicians, and clergy members, among others, as mandated reporters and requires them to report suspected child abuse or neglect to specified agencies whenever the mandated reporter, in their professional capacity or within the scope of their employment, knows of, or observes, a child whom the mandated reporter knows or reasonably suspects has been the victim of child abuse or neglect. Existing law requires specified local agencies to forward those reports to the Department of Justice in writing of all cases the agencies investigate of known or suspected child abuse or severe neglect that are determined to be substantiated. Existing law requires the Department of Justice to be a repository of reports of suspected child abuse and severe neglect and to maintain those reports in the Child Abuse Central Index (CACI) . Existing law prohibits a police or sheriff's department from forwarding to the Department of Justice a report of a case the police or sheriff's department investigates of known or suspected child abuse or neglect. This bill would authorize a police or sheriff's department to which a report of suspected child abuse or severe neglect is made on or after January 1, 2024, to forward to the Department of Justice a report in writing of its investigation of known or suspected child abuse or severe neglect that is determined to be substantiated. The bill would require a police or sheriff's department that forwards a report to comply with the same requirements placed on other reporting agencies and would require the police or sheriff's department to adopt procedures to notify persons reported to the CACI. The bill would require the Department of Justice to create a grievance procedure for reports to the CACI submitted by police or sheriff's departments, and would prescribe minimum requirements for the notification and grievance procedures, including specifying timelines and rules governing the grievance hearing. The bill would also make conforming changes.

Middle Class Scholarship Program: community colleges: current and former foster youth.

Existing law establishes the Middle Class Scholarship Program (MCSP) under the administration of the Student Aid Commission. Existing law makes an undergraduate student eligible for a scholarship award under the MCSP if the student is enrolled at the University of California or the California State University, or enrolled in upper division coursework in a community college baccalaureate program, and meets certain eligibility requirements. This bill would extend awards under the MCSP to community college students who are current or former foster youth pursuing transfer to a 4-year postsecondary educational institution, an associate degree, an associate degree for transfer, or a community college career technical education certificate and meet other MCSP requirements, as provided. The bill would require the commission to summarize the provisions of the MCSP that apply to these current or former foster youth and title those provisions as "The Fostering Futures Program" on a page on its internet website.
