The Control, Regulate and Tax Adult Use of Marijuana Act (AUMA) , an initiative measure, authorizes a person who obtains a state license under AUMA to engage in commercial adult-use cannabis activity pursuant to that license and applicable local ordinances. The Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA) , among other things, consolidates the licensure and regulation of commercial medicinal and adult-use cannabis activities, and requires the Department of Cannabis Control to administer its provisions. The California Environmental Quality Act (CEQA) requires a lead agency, as defined, to prepare, or cause to be prepared, and certify the completion of, an environmental impact report on a project that it proposes to carry out or approve that may have a significant effect on the environment or to adopt a negative declaration if it finds that the project will not have that effect. This bill would provide that the Department of Cannabis Control is not required to serve as a responsible agency under CEQA if the local jurisdiction acting as lead agency under CEQA has filed a notice of determination for the commercial cannabis activity, or a notice of exemption for a retail commercial cannabis project, with the Office of Planning and Research following the adoption of a mitigated negative declaration or certification of an environmental impact report by the local jurisdiction, as specified, and the commercial cannabis activity for which the applicant is seeking a license from the department is the same project as the commercial cannabis activity analyzed by the local jurisdiction under CEQA.

(1) Existing law authorizes the State Water Resources Control Board to investigate all streams, stream systems, lakes, or other bodies of water, take testimony relating to the rights to water or the use of water, and ascertain whether water filed upon or attempted to be appropriated is appropriated under the laws of the state. Existing law requires the board to take all appropriate proceedings or actions to prevent waste, unreasonable use, unreasonable method of use, or unreasonable method of diversion of water in this state. This bill would authorize the board, in conducting an investigation or proceeding for these purposes, to inspect the property or facilities of any person or entity to ascertain certain purposes are being met or compliance with specified requirements. The bill would authorize the board, if consent is denied for an inspection, to obtain an inspection warrant, as specified, or in the event of an emergency affecting public health and safety pertaining to the particular site under which the inspection is being sought, to conduct an inspection without consent or a warrant. The bill would authorize the board to participate in an inspection of an unlicensed cannabis cultivation site, as specified. Because the willful refusal of an inspection lawfully authorized by an inspection warrant is a misdemeanor, this bill would impose a state-mandated local program by expanding the application of a crime. (2) Existing law authorizes the executive director of the board to issue a complaint to any person or entity on which administrative civil liability may be imposed pursuant to specified law, and requires the complaint to be served by personal notice or certified mail. Existing law requires the board to serve a copy of a decision or order on the parties by personal delivery or registered mail. This bill would expand methods of notice for those purposes to include notice in accordance with the manner of service of a summons under specified provisions of the Code of Civil Procedure or by any method of physical delivery that provides a receipt. (3) Existing law authorizes the board to issue a cease and desist order when it determines a specified violation is made. Existing law requires, in the event the violation is occurring or threatening to occur, the board to give notice by personal notice or certified mail, pursuant to which the party shall be informed that they may request a hearing not later than 20 days from the date on which the notice is received, to the person allegedly engaged in the violation. This bill would expand methods of notice for those purposes to include notice in accordance with the manner of service of a summons under specified provisions of the Code of Civil Procedure, or by any method of physical delivery that provides a receipt. (4) Existing law, the Porter-Cologne Water Quality Control Act, requires a person who discharges waste into the waters of the state in violation of waste discharge requirements or other order or prohibition issued by a California regional water quality control board or the State Water Resources Control Board to clean up the waste or to abate the effects of the waste. Existing law authorizes the regional board to expend available moneys to perform any cleanup, abatement, or remedial work required under those circumstances. Existing law authorizes a regional board, in establishing or reviewing any water quality control plan or waste discharge requirements, or in connection with any action relating to any plan or requirement authorized by the act, to investigate the quality of any waters of the state within its region. This bill would authorize a regional board to participate in an inspection of an unlicensed cannabis cultivation site, as specified. (5) Existing law requires cease and desist orders issued by the board pursuant to the act to be served by personal service or by registered mail upon the person being charged with the violation of the requirements and upon other affected persons who appeared at the hearing and requested a copy. This bill would instead require the cease and desist orders to be served by personal service, certified mail, or by any method of physical delivery that provides a receipt, upon the person being charged with the violation of the requirements, and by first class or electronic mail upon other affected persons who appeared at the hearing and requested a copy. (6) The act authorizes a regional board to administratively impose civil liability in connection with violations of certain water quality provisions. Existing law authorizes any executive officer of a regional board to issue a complaint to any person on whom administrative civil liability may be imposed, as specified. This bill would additionally authorize service of a complaint or order by any method of physical delivery that provides a receipt. (7) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.
Existing law establishes within state government the Office of Planning and Research as the comprehensive state planning agency for long-range planning and research. Existing law, until January 1, 2026, establishes within state government a Governor's Military Council that serves under the direction of the Military Department to advise the Governor on efforts to retain military installations and operations within this state that are necessary for the defense of the nation and to coordinate and focus those efforts. This bill, upon appropriation by the Legislature, would establish the California Defense Community Infrastructure Program, which would require the Office of Planning and Research to grant funds and provide technical assistance to local agencies to assist with matching fund requirements in applications for funds from the federal Defense Community Infrastructure Program. The bill would require the office, in consultation with the Governor's Military Council, to develop guidelines for the program that, where possible, align with the guidelines of the federal program. This bill would require the office to use specified project criteria, define an eligible project, as specified, rank eligible projects, as specified, and award grants based on the available funds. The bill would require the office to give priority to projects located in, or that would provide services to people who live in, a disadvantaged community, as defined.
Existing law establishes the Ocean Protection Council in state government to, among other things, establish policies to coordinate the collection, evaluation, and sharing of scientific data related to coastal and ocean resources among agencies. This bill would require the council, upon an appropriation by the Legislature, to oversee the establishment of, in coordination with other unspecified state and federal agencies, a nonprofit West Coast Offshore Wind Science Entity for the purpose of directing comprehensive baseline and ongoing monitoring of the California current ocean ecosystem as well as targeted research, and oversee that the research is available and used to inform state and federal decisions, as provided. The bill would require the entity to perform specified functions, including reviewing and incorporating existing research, monitoring, data standardization methods, and data portals. The bill would require, by no later than July 1, 2024, the council to form a steering committee to provide governance and oversight on the processes and procedures of the entity, as specified.
This measure would designate the portion of U.S. Route 101 in the County of San Luis Obispo, from postmile 13.173 to postmile 17.767, as the Katcho Achadjian Memorial Highway. The measure would request the Department of Transportation to determine the cost of appropriate signs showing this special designation and, upon receiving donations from nonstate sources covering that cost, to erect those signs.
Existing law creates the Monterey-Salinas Transit District to include all of the County of Monterey, with specified powers and duties related to public transit service. Existing law requires the district to award contracts for the purchase of supplies, equipment, and materials in excess of $100,000 to the lowest responsible bidder, or to the responsible bidder that provides the best value, as provided. Existing law requires the district to obtain a minimum of 3 quotations, as provided, that permit prices and terms to be compared, whenever the expected expenditure required for the purchase of supplies, equipment, or materials exceeds $2,500 but does not exceed $100,000. This bill would increase to $150,000 the monetary threshold for contracts above which the district is required to award contracts to the lowest responsible bidder, or to the responsible bidder that provides the best value, as provided. The bill would also require the district to obtain a minimum of 3 quotations, as provided, that permit prices and terms to be compared whenever the expected expenditure required for the purchase instead exceeds $5,000 but does not exceed $150,000. The bill would also, until January 1, 2030, apply those rules concerning monetary thresholds for contracts to contracts for the purchase of services, excluding services related to certain public construction projects and architectural, landscape architectural, engineering, environmental, land surveying, or construction project management services. To the extent these provisions impose new duties on the district, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.
The California Constitution provides that only a marriage between a man and a woman is valid or recognized in California, and federal law permanently enjoins the state from enforcing this constitutional provision. This measure would repeal this unenforceable constitutional provision and would instead provide that the right to marry is a fundamental right, as specified.
Existing law establishes the Sierra Nevada Conservancy in the Natural Resources Agency and prescribes the functions and duties of the conservancy with regard to the preservation of specified lands in the Sierra Nevada Region, as defined, and the 6 subregions, as defined, in which the Sierra Nevada Region is located. This bill would revise and recast the definition of "subregion." The bill would require the conservancy to support efforts that advance climate resilience and equity. The bill would also revise certain legislative findings related to the conservancy and make nonsubstantive and conforming changes.
The California Constitution establishes the state civil service for state employees, with specified exceptions. Existing law requires the State Personnel Board to establish a probationary period for each class of employee in state service, which is generally required to be 6 months, unless the board establishes a longer period not to exceed one year, and requires that the period be served, upon appointment. This bill would recast these provisions to specify that the probationary period commences on the first day that the employee reports to work or begins performing the job duties. The bill would make other conforming and nonsubstantive changes to those provisions.
Existing law, the Pajaro Valley Water Management Agency Act, specifies qualifications for the 7-member board of directors that governs the agency, 4 of whom are elected and 3 of whom are appointed. Existing law requires that the 3 appointed members reside within the jurisdiction of the appointing power, derive at least 51% of their net income from the production of agricultural products, as certified by affidavit, and be appointed by the Board of Supervisors of Monterey County, the Board of Supervisors of Santa Cruz County, and the City of Watsonville, respectively. This bill would require the appointee of the City of Watsonville to instead have a primary income that involves or, if the appointee is retired, did involve, a close and continuing relationship with the Pajaro Valley agricultural industry.
