Mountain lions.

Proposition 117, an initiative measure approved by the electors at the June 5, 1990, direct primary election, enacted the California Wildlife Protection Act of 1990. The act establishes that the mountain lion is a specially protected mammal under the laws of this state, and makes it unlawful to take, injure, possess, transport, import, or sell any mountain lion or any part or product thereof. The act establishes certain exemptions from that prohibition. The act prohibits the Legislature from changing the act, with specified exceptions, except by a 45 vote of the membership of both houses of the Legislature and then only if consistent with, and in furtherance of, the purposes of the act. This bill would authorize the Department of Fish and Game to authorize qualified individuals, educational institutions, governmental agencies, or nongovernmental organizations to conduct scientific research involving mountain lions that meets specified requirements, pursuant to a Scientific Collecting Permit, as defined. The bill would find and declare that the amendments made by the bill are consistent with, and further the purposes of, the act. This bill would declare that it is to take effect immediately as an urgency statute.

County recorder: recordation of documents.

Existing law requires the county recorder, upon payment of proper fees and taxes, to record any document that is authorized or required by statute or court order to be recorded, provided that the document meets certain standards. This bill would additionally require the county recorder to record any document that is authorized or required by local ordinance adopted within that county to be recorded. Existing law sets forth the required form that a notice of intent to preserve an interest in real property must take. This bill would revise that form.

Arbitration: legal representation.

Existing law, until January 1, 2013, permits persons admitted to the bar of any other state to represent a party in an arbitration proceeding in this state, or to render legal services in this state in connection with an arbitration proceeding in another state. Existing law requires those out-of-state attorneys to serve upon the arbitrator, the parties, the State Bar of California, and counsel, a certificate containing specified information within a reasonable period of time after the attorney expresses his or her intent to appear in an arbitration. This bill would delete the repeal date of January 1, 2013, thereby making these provisions operative indefinitely. This bill would make conforming changes to an existing provision of law.

Harbor Maintenance Tax: Harbor Maintenance Trust Fund surplus.

This measure would urge the President and the Congress of the United States to significantly increase federal funding from the Harbor Maintenance Trust Fund surplus for navigational improvements and continued operational and maintenance dredging in those federal channels that serve California's ports such that these expenditures equal the amounts contributed by California, to halt adding to the surplus in the Harbor Maintenance Trust Fund, and to recognize the role of California's ports in contributing the greatest share of the Harbor Maintenance Tax revenues. This measure would also memorialize the Legislature's support of efforts by California's congressional delegation to obtain an equitable share of all federal port and goods movement infrastructure funding and would encourage those representatives to support measures that will fund the security and facilitation of commercial activity at California's ports.

Health care facilities: financing.

The California Health Facilities Financing Authority Act authorizes the California Health Facilities Financing Authority to make loans from the continuously appropriated California Health Facilities Financing Authority Fund to participating health institutions for financing or refinancing the acquisition, construction, or remodeling of health facilities. The act defines a health facility to include various specified facilities and facilities operated in conjunction with these facilities. It also defines a participating health institution to mean specified entities authorized by state law to provide or operate a health facility and undertake the financing or refinancing of the construction or acquisition of a project or of working capital, as defined. Existing law authorizes the authority to award grants to any eligible health facility, as defined, for purposes of financing defined projects. This bill would authorize the authority to award one or more grants that, in the aggregate, do not exceed $1,500,000 to one or more projects designed to demonstrate new or enhanced cost-effective methods of delivering health care services, as specified. This bill would create the California Health Access Model Program Account in the California Health Facilities Financing Authority Fund, and would transfer up to $1,500,000 from the fund to the account for the purposes of the bill. The bill would require that any moneys remaining in the account as of January 1, 2015, revert to the fund. This bill would require the authority to report to the Governor and the Legislature on the outcomes of the demonstration grant program, as specified. By expanding the purposes for which a continuously appropriated fund may be used, this bill would make an appropriation. This bill would declare that it is to take effect immediately as an urgency statute.

Medi-Cal: managed care: exemption from plan enrollment.

Existing law provides for the Medi-Cal program, which is administered by the State Department of Health Care Services, under which qualified low-income individuals receive health care services. The Medi-Cal program is, in part, governed and funded by federal Medicaid Program provisions. One of the methods by which these services are provided is pursuant to contracts with various types of managed care plans. This bill would establish a process that would permit an eligible Medi-Cal beneficiary to receive fee-for-service Medi-Cal, if available, as an alternative to plan enrollment for a prescribed period of time if the beneficiary meets specified criteria. This bill would provide that these provisions shall not apply to a beneficiary who is enrolled in a county organized health system. This bill would require the department to develop a process to track a beneficiary who has been denied a request for exemption from plan enrollment and to notify the plan, if applicable, of the denial, including information identifying the provider.

Relative to Sikh American Awareness and Appreciation Month.

This measure would designate November 2012 as California Sikh American Awareness and Appreciation Month. It would recognize and acknowledge the significant contributions made by Californians of Sikh heritage to the state and afford all Californians the opportunity to understand, recognize, and appreciate the rich history and shared principles of Sikh Americans.
