Existing law requires the superintendent of each school district to assign employees employed in positions requiring certification qualifications to positions in which they are to serve, subject to the approval of the governing board of the school district. Existing law provides that the power of the superintendent of a school district to assign includes the power to transfer a teacher from one school to another school, as prescribed, when the superintendent concludes the transfer is in the best interest of the school district. This bill would instead provide that the power of the superintendent of a school district to assign includes the power to transfer a teacher when the superintendent concludes the transfer is in the best interest of the pupils. The bill would declare that it is the intent of the Legislature that if the amendments to this provision conflict with a collective bargaining agreement entered into between a public employer and an exclusive bargaining representative, the amendments shall not apply to the public employers or public employees subject to that agreement. Under existing law, when school employees are terminated pursuant to a reduction in workforce, a school district is generally required to terminate the employees in order of seniority. Existing law further provides those employees with a preferred right to reappointment and an opportunity for substitute service in order of seniority. Existing law authorizes a school district to deviate from the order of seniority for those purposes for specified reasons, including to maintain or achieve compliance with constitutional requirements related to equal protection of the laws. This bill would authorize a school district to deviate from the general requirement that terminations and reappointments occur in order of seniority in order to maintain or achieve compliance with constitutional requirements related to equal protection of the law as it applies to pupils. The bill would also make nonsubstantive changes.
Existing law generally ensures the right of a woman to choose or obtain an abortion, but provides that the performance of an abortion is unauthorized under certain circumstances, including when the abortion is performed on a viable fetus and continuation of the pregnancy posed no risk to the life or health of the pregnant woman, as specified. This bill would enact the Prenatal Nondiscrimination Act. The bill would prohibit a person from intentionally performing or attempting to perform an abortion with knowledge that the pregnant woman is seeking the abortion because of the gender of the unborn child. The bill would provide for injunctive relief, civil damages, and civil fines for a violation of this provision. The bill would also prohibit the public disclosure of the woman's identity, unless she consents to that disclosure.
Existing law requires the Secretary of Veterans Affairs to establish a California Mexican American Veterans' Memorial Beautification Committee for the purpose of beautification and enhancement of a specified existing memorial on state grounds. Under existing law funds for the beautification and enhancement of the memorial are required to be provided through private contributions and through existing funds collected under the auspices of the former California Mexican American Veterans' Memorial Beautification Commission. Under existing law these funds are required to be deposited in the California Mexican American Veterans' Memorial Beautification and Enhancement Account, a continuously appropriated account within the General Fund. Existing law requires any funds remaining in the account as of July 1, 2014, to revert to the General Fund. This bill would extend the date for the reversion of funds in this account until July 1, 2016. By extending the operation of a continuously appropriated account, this bill would make an appropriation. This bill would declare that it is to take effect immediately as an urgency statute.
This measure, in celebration of National Strawberry Month, would recognize the contributions of California strawberry farmers and the California Strawberry Commission in supporting a quintessential California crop that sustains families, communities, the environment, the California economy, and the opportunity for immigrants to pursue the American Dream.
