Relative to Juneteenth.

This measure would recognize June 19, 2023, as Juneteenth and would urge the people of California to join in celebrating Juneteenth as a day to honor and reflect on the significant role that African Americans have played in the history of the United States and how they have enriched society through their steadfast commitment to promoting unity and equality.

Relative to Portuguese Heritage Month.

This measure would declare the month of June 2023 to be Portuguese Heritage Month and would recognize June 10 as the Day of Portugal and May 29 as the Day of the Azores.

A resolution to propose to the people of the State of California an amendment to the Constitution of the State, by adding Section 33 to Article I thereof, relating to controlled substances.

Existing law makes it a crime to possess for sale or purchase for purpose of sale, transport, import, sell, furnish, administer, give away, manufacture, compound, convert, produce, derive, process, or prepare various controlled substances, including, among others, fentanyl, peyote, and various other opiates and narcotics. This measure would require a criminal court to advise a person who is convicted of, or who pleads guilty or no contest to, the above-described crimes, as specified, of the danger of selling or administering illicit drugs and counterfeit pills and that, if a person dies as a result of that action, the defendant can be charged with homicide. The measure would require the court to read the advisory statement in a case in which the defendant exchanged a controlled substance containing fentanyl or its analogs for anything else of value, as specified. The measure would require the advisory statement to be included in a plea form, if used, and specified on the record. The measure would require that the fact the advisory was given be recorded in the abstract of conviction and would prohibit the advisement from being used as evidence in the prosecution of a minor in juvenile court.

School district board vacancies: internet website notifications.

If a vacancy on a school district governing board occurs, or if a resignation of a person on the school district governing board is filed with the county superintendent of schools containing a deferred effective date, existing law requires the school district governing board to, within 60 days of the vacancy or the deferred resignation filing, either order an election or make a provisional appointment of a person to fill the vacancy. Existing law requires, within 10 days of making a provisional appointment, the school district governing board to post a notice of the actual vacancy or the deferred resignation filing, the provisional appointment, and other specified statements in 3 public places in the school district, and, if a newspaper of general circulation is published in the school district, in that newspaper, as specified. This bill would require a school district governing board to also post the notice on the school district's internet website and would make nonsubstantive changes to the notice requirements described above. By imposing new duties on school districts, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.
