Sales and use taxes: exemptions: trucks for use in interstate or out-of-state commerce.

Existing state sales and use tax laws impose a tax on retailers measured by the gross receipts from the sale of tangible personal property sold at retail in this state or on the storage, use, or other consumption in this state of tangible personal property purchased from a retailer for storage, use, or other consumption in this state. The Sales and Use Tax Law provides various exemptions from those taxes, including an exemption for the sale of, or the storage, use, or other consumption of, a new or remanufactured trailer or semitrailer with an unladen weight of 6,000 pounds or more that is purchased for use without this state and is delivered to the purchaser within this state, and the purchaser drives or moves the vehicle to any point outside this state within 30 or 75 days, as applicable, from and after the date of delivery, if the purchaser furnishes certain documents to the manufacturer or remanufacturer. Those documents include the purchaser's affidavit as to the exclusive use of the vehicle in interstate or foreign commerce, and the vehicle having been taken out of the state within the applicable time period. This bill, until January 1, 2024, would additionally include within this exemption the sale of, or the storage, use, or consumption of, a new, used, or remanufactured truck with an unladen weight of 6,000 pounds or more that is purchased for use without this state. By requiring additional purchaser affidavits, this bill would expand the crime of perjury and impose a state-mandated local program. The Bradley-Burns Uniform Local Sales and Use Tax Law authorizes counties and cities to impose local sales and use taxes in conformity with the Sales and Use Tax Law, and existing laws authorize districts, as specified, to impose transactions and use taxes in accordance with the Transactions and Use Tax Law, which generally conforms to the Sales and Use Tax Law. Amendments to the Sales and Use Tax Law are automatically incorporated into the local tax laws. Existing law requires the state to reimburse counties and cities for revenue losses caused by the enactment of sales and use tax exemptions. This bill would provide that, notwithstanding Section 2230 of the Revenue and Taxation Code, no appropriation is made and the state shall not reimburse any local agencies for sales and use tax revenues lost by them pursuant to this bill. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. This bill would take effect immediately as a tax levy, but its operative date would depend on its effective date.

Relative to domestic terrorism.

This measure would call for groups and organizations across the United States who act under the banner of Antifa to be designated as domestic terrorist organizations, would unequivocally condemn the violent actions of Antifa groups as unacceptable acts for anyone in the United States, would express the need for peaceful communication of varied ideas, and would urge any group or organization in the United States to voice its opinions without using violence or threatening the health, safety, or well-being of other persons, groups, or law enforcement officers in the United States. The measure would further call upon the President of the United States, the United States Congress, and the Governor to redouble efforts, using all available and appropriate tools, to combat the spread of all forms of domestic terrorism, including White supremacist terrorism.

Upholding democracy through civic education in public schools.

This measure would endorse activities in public schools that instruct pupils in upholding and sustaining American democracy, encourage, in the strongest terms, California schools to pursue certain recognized designations that reflect specified ethos and values, and encourage publicly elected officials to conduct themselves in ways that strengthen civic engagement and participation in civil society.

Adoption.

Existing law establishes procedures for stepparent adoptions involving a spouse or partner who gave birth to the child during the marriage or domestic partnership. Among other things, existing law exempts those adoptions from the requirements of a home investigation and a hearing, as well as specified costs, unless the court orders otherwise. This bill would allow a stepparent adoption in which the child was born during the marriage or domestic partnership through a gestational surrogacy process brought about by one or both spouses or partners to use the same procedure as a stepparent adoption in which one of the spouses or partners gave birth to the child during the marriage or domestic partnership. Under existing law, the existing parents of an adopted child are, from the time of the adoption, relieved of all parental duties toward, and have no right over, the adopted child, unless the existing parent or parents and the prospective adoptive parent or parents sign a waiver before the finalization of the adoption. This bill would provide that the waiver provision described above applies to all adoptions except intercountry adoptions, as specified. Existing law also terminates the parental rights and responsibilities of the birth parent or parents of an adult who is adopted, except that when an adult is adopted by a stepparent, the legal relationship between the adult and the birth parent who is the spouse of the stepparent is not terminated. This bill would allow an adult who is being adopted to waive the termination of the legal relationship between the adult and an existing parent or parents by signing a waiver before the finalization of the adoption.

Veterans: education.

Existing law establishes the Department of Veterans Affairs within state government and sets forth its powers and duties, including, but not limited to, the administration of various programs providing benefits to veterans. This bill would require the department to establish an education assistance program to provide housing and tuition assistance to disabled veterans attending graduate school in the State of California if their eligibility for federal education assistance has expired. The bill would, upon appropriation by the Legislature, require the department to provide tuition assistance and a housing allowance to disabled veterans while they attend specified graduate schools in the State of California, as specified. The bill would additionally require the department, upon appropriation by the Legislature, to provide a housing allowance to a disabled veteran in a graduate internship or fellowship program that earns credits toward a graduate degree.

Open meetings.

The Bagley-Keene Open Meeting Act requires that all meetings of a state body, as defined, be open and public and that all persons be permitted to attend and participate in a meeting of a state body, subject to certain conditions and exceptions. This bill would specify that the definition of "state body" includes an advisory board, advisory commission, advisory committee, advisory subcommittee, or similar multimember advisory body of a state body that consists of 3 or more individuals, as prescribed, except a board, commission, committee, or similar multimember body on which a member of a body serves in their official capacity as a representative of that state body and that is supported, in whole or in part, by funds provided by the state body, whether the multimember body is organized and operated by the state body or by a private corporation. This bill would declare that it is to take effect immediately as an urgency statute.

Education finance: Higher Education Facilities Bond Act of 2020.

(1) Under the Higher Education Facilities Bond Act of 1986, the Higher Education Facilities Bond Act of 1988, and the Higher Education Facilities Bond Act of June 1992, the issuance, pursuant to the State General Obligation Bond Law, of bonds in an amount not to exceed $400,000,000, $600,000,000, and $900,000,000, respectively, and the expenditure of the revenues therefrom, were authorized for the purpose of aid to the University of California and the California State University for, among other things, the construction and equipping of educational facilities, as specified. Existing law establishes the Higher Education Facilities Finance Committee to administer those acts, and to authorize the issuance and sale of bonds to the extent necessary to fund the education facilities construction apportionments expressly authorized by the Legislature in the annual Budget Act. More recently, the Class Size Reduction Kindergarten-University Public Education Facilities Bond Act of 1998, the Kindergarten-University Public Education Facilities Bond Act of 2002, the Kindergarten-University Public Education Facilities Bond Act of 2004, and the Kindergarten-University Public Education Facilities Bond Act of 2006 authorized the issuance of bonds and the expenditure of revenues therefrom for the University of California and the California State University, as well as for the California Community Colleges and public elementary and secondary schools. This bill would enact the Higher Education Facilities Bond Act of 2020, which, upon approval by the state electorate, would authorize the issuance of state general obligation bonds in an amount not to exceed $8,000,000,000, with one-half of the amount designated for the University of California and the Hastings College of the Law and the other half designated for the California State University, for purposes similar to those specified in the Higher Education Facilities Bond Act of 1986, the Higher Education Facilities Bond Act of 1988, and the Higher Education Facilities Bond Act of June 1992, to be issued and sold in a manner similar to that provided under those acts. The bill would require that any request for funds from the bonds issued pursuant to the bond act enacted by this bill be accompanied by the 5-year capital outlay plan of the particular university or college and include a schedule that prioritizes the seismic retrofitting needed to significantly reduce seismic hazards in buildings identified as high priority by the university or college, as specified. (2) This bill would provide for the submission of the Higher Education Facilities Bond Act of 2020 to the voters at the March 3, 2020, statewide primary election, as specified.
