Vehicular air pollution: heavy-duty trucks.

Existing law imposes various limitations on emissions of air contaminants for the control of air pollution from vehicular sources. Existing law generally designates the State Air Resources Board as the state agency with the primary responsibility for the control of vehicular air pollution. Existing law requires the state board to adopt and implement emission standards for new motor vehicles for the control of emissions from new motor vehicles that the state board finds to be necessary and technologically feasible, as provided. Existing state regulations establish exhaust emissions standards and test procedures for 1985 and subsequent model heavy-duty engines and vehicles, as provided. Existing law defines "heavy-duty" for purposes of laws governing air resources. This bill would exempt, notwithstanding any other law, a 2024 and subsequent model heavy-duty truck that meets federal exhaust emission standards from the state regulations described above governing exhaust emissions standards and test procedures for 1985 and subsequent model heavy-duty engines and vehicles.

Relative to Data Privacy Week.

This measure would designate, in perpetuity, the 4th week of January as Data Privacy Week and the last Sunday of January as Data Privacy Day.

Lifetime hunting and sport fishing licenses: Gold Star Family members.

Existing law requires the Department of Fish and Wildlife to issue lifetime hunting licenses and lifetime sport fishing licenses, and grants certain lifetime privileges to holders of those licenses, upon the one-time payment of specified fees. This bill would require, upon application to the department, lifetime hunting licenses and lifetime sport fishing licenses to be issued at no cost to Gold Star Family members who meet certain eligibility requirements.

Transportation network companies: participating drivers: proof of insurance.

The Passenger Charter-party Carriers' Act provides for the regulation of charter-party carriers of passengers by the Public Utilities Commission and includes specific requirements for liability insurance coverage, background checks, and other regulatory matters applicable to transportation network companies, as defined, and their participating drivers, as defined. The act also requires a participating driver to carry proof of transportation network company insurance coverage with them at all times during their use of a vehicle in connection with a transportation network company's online-enabled application or platform. This bill would authorize a participating driver to carry the proof of insurance on a mobile electronic device, as provided.

Workforce training: CaliforniaVolunteers: youth job corps.

Under existing law, by executive order, CaliforniaVolunteers is established in the Office of the Governor and is charged with overseeing programs and initiatives for service and volunteerism. Existing law authorizes CaliforniaVolunteers to form a nonprofit public benefit corporation or other entity exempt from income taxation, as provided, to raise revenues and receive grants or other financial support from private or public sources, for purposes of undertaking or funding any lawful activity authorized to be undertaken by CaliforniaVolunteers. Existing federal law, the National and Community Service Trust Act of 1993, also requires the state to create a commission to carry out specified duties relating to national service programs to be eligible for grants or allotments under certain programs, or to receive distributions of approved national service positions. Existing state law continues into existence the Board of Commissioners under CaliforniaVolunteers for purposes of meeting the requirements of the federal act and the act's implementing rules and regulations. #CaliforniansForAll Youth Jobs Corps is a program of the CaliforniaVolunteers. This bill would establish in statute the #CaliforniansForAll Youth Job Corps Program. The bill would require the CaliforniaVolunteers to expand the program, upon appropriation by the Legislature, which would fund supportive services, as specified, that are necessary for homeless youth and current or former foster youth to enable their participation in the workforce development program, as defined. Under the bill, grants would be awarded on a competitive basis. The bill would require the CaliforniaVolunteers to conduct outreach activities and to provide technical assistance to eligible applicants to ensure that grants are awarded to qualified applicants providing a broad spectrum of supportive services. The bill would prescribe definitions, duties for the CaliforniaVolunteers, and requirements for applications and applicants, including the requirement that applicants agree to provide the office any information that the office deems necessary to meet reporting requirements and other grant requirements. The bill would require the CaliforniaVolunteers to evaluate how grants awarded under the program address the needs of eligible targeted populations and, beginning one year after the initial award of grant funds, to post an annual report on its internet website regarding the progress and success of the program.

Taxation: renter's credit.

The Personal Income Tax Law authorizes various credits against the taxes imposed by that law, including a credit for qualified renters in the amount of $120 for spouses filing joint returns, heads of household, and surviving spouses if adjusted gross income is $50,000, as adjusted, or less, and in the amount of $60 for other individuals if adjusted gross income is $25,000, as adjusted, or less. Existing law requires the Franchise Tax Board to annually adjust for inflation these adjusted gross income amounts. For 2021, the adjusted gross income limit is $87,066 and $43,533, respectively. Existing law establishes the continuously appropriated Tax Relief and Refund Account in the General Fund and provides that payments required to be made to taxpayers or other persons from the Personal Income Tax Fund are to be paid from that account. This bill, for taxable years beginning on or after January 1 of the taxable year that includes the date on which funding is first authorized for purposes of this bill and for the succeeding 4 taxable years, and only when specified in a bill relating to the Budget Act, would increase the credit amount to $2,000 for spouses filing joint returns, heads of households, and surviving spouses and $1,000 for other individuals. In the event the increased credit amount is not specified in a bill relating to the Budget Act, the existing credit amounts, as described above, would be the credit amounts for that taxable year. The bill would require the Franchise Tax Board to annually recompute the credit amounts for inflation for taxable years following the first year in which the increased credit is operative, except as provided. The bill, for credits allowable for taxable years in which the above-described increased credit is operative, would provide that the credit amount in excess of the qualified renter's liability would be refundable and paid from the Tax Relief and Refund Account to the qualified renter upon appropriation by the Legislature. Existing law requires any bill authorizing a new tax credit to contain, among other things, specific goals, purposes, and objectives that the tax credit will achieve, detailed performance indicators, and data collection requirements. The bill would provide findings and declarations relating to the goals, purposes, and objectives of this credit. This bill would take effect immediately as a tax levy.

Telecommunications: privacy protections: 988 calls.

Under existing law, the Public Utilities Commission has regulatory authority over public utilities, including telephone corporations. Existing law prohibits a telephone corporation, when selling or licensing lists of residential subscribers, from including the telephone number of any subscriber assigned an unpublished or unlisted access number without the subscriber's written waiver of this protection. Existing law prohibits a provider of mobile telephony services, as defined, or any affiliate or agent of the provider, when providing the name and dialing number of a subscriber for inclusion in a directory or directory database, from including the dialing number of any subscriber without first obtaining the express consent of that subscriber. However, existing law authorizes providing those telephone numbers without regard to consent to a law enforcement agency, fire protection agency, public health agency, public environmental health agency, city or county emergency services planning agency, or private for-profit agency operating under contract with, and at the direction of, one or more of these agencies, for the sole purpose of responding to a 911 call, communicating an imminent threat to life or property, or testing the systems that respond to 911 calls or communicate threats to life or property. This bill would additionally authorize providing those telephone numbers to those parties without consent for the purpose of responding to a 988 call or testing the systems that respond to 988 calls.
