Residential care facilities for the elderly: liability insurance.

Existing law provides for the licensure and regulation of residential care facilities for the elderly by the State Department of Social Services, including requiring, as a condition of licensure, bonds issued by a surety company for a licensee that handles the moneys of a person in the facility. Violation of these provisions is a misdemeanor. This bill, on and after July 1, 2015, would require all residential care facilities for the elderly to maintain liability insurance in an amount of at least $1,000,000 per occurrence and $3,000,000 in the annual aggregate to cover injury to residents or guests caused by the negligent acts or omissions to act of, or neglect by, the licensee or its employees. By creating a new crime, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Railroad safety: transportation of crude oil.

This measure would urge the United States Department of Transportation and other relevant federal entities to (1) safeguard communities and environmentally sensitive areas from rail accidents involving transportation of crude oil by expediting rail safety reforms, (2) prioritize safety considerations over cost-effectiveness in deliberations about improving the transport of crude oil by rail, (3) mandate, at a minimum, the best practices explained in a 2014 safety initiative, as specified and (4) partner with the Canadian Transportation Agency to improve safety of the North American railroad tank car fleet by swiftly adopting a stricter design standard, and by retrofitting or phasing out tank cars that do not meet that standard.

Journeyman Linemen Recognition Day.

This measure would designate July 10, 2014, as Journeyman Linemen Recognition Day to honor and recognize the contribution of the countless journeyman linemen who often place themselves in harm's way to serve their communities.

Relative to Diffuse Intrinsic Pontine Glioma (DIPG) Awareness Week.

This measure would declare the week of May 25, 2014, to May 31, 2014, inclusive, as Diffuse Intrinsic Pontine Glioma (DIPG) Awareness Week to honor those who work to make research and resources a reality for children suffering from DIPG and their families.

State construction projects: insurance.

Existing law generally prohibits property belonging to the state from being insured against risk of damage or destruction by fire, with specified exceptions. Existing law, notwithstanding this general prohibition, authorizes the Director of General Services to establish a master builders' risk insurance program for all state construction projects during construction. Existing law requires a deductible from a contractor of at least $25,000 for a master policy issued under the master builders' risk insurance program. This bill would instead require the contractor's deductible under a master policy to be outlined in the request for bids or proposals.

State Board of Equalization: administration: managed audit program.

The Sales and Use Tax Law provides for a managed audit program, in which, if the State Board of Equalization determines a taxpayer's account is eligible for the program by meeting specified criteria and the taxpayer agrees to participate, the taxpayer examines its books, records, and equipment to determine if it has any unreported tax liability for the audit period, in compliance with the managed audit instructions provided by the board. Under that law, upon completion of the managed audit and verification by the board, interest on any unpaid liability is computed at 12 the rate that would otherwise be imposed for liabilities covered by the audit period. This bill would authorize a managed audit program for the Motor Vehicle Fuel Tax Law, Use Fuel Tax Law, Cigarette and Tobacco Products Tax Law, Alcoholic Beverage Tax Law, Energy Resources Surcharge Law, Emergency Telephone Users Surcharge Act, Hazardous Substances Tax Law, Integrated Waste Management Fee Law, Oil Spill Response, Prevention, and Administration Fees Law, Underground Storage Tank Maintenance Fee Law, fees collected pursuant to the Fee Collection Procedures Law, and Diesel Fuel Tax Law.
