This measure would proclaim the week of September 5, 2021, through September 11, 2021, as Suicide Prevention Week in California.

The military: sexual harassment.

Existing law makes a member of the active militia who, when subject to the Uniform Code of Military Justice, commits a sexual assault crime, as defined, subject to prosecution by the office of the district attorney or other equivalent civilian prosecutorial authority with appropriate jurisdiction, and authorizes the Military Department or California National Guard to claim jurisdiction only if the district attorney, or other equivalent civilian prosecutorial authority, refuses to pursue a criminal prosecution of that member. Existing law requires a member of the active militia recommended for court-martial, as specified, for a sexual assault offense to be tried by general court-martial. The bill would additionally make a member of the active militia who has been lawfully ordered to any type of state duty and who commits sexual harassment punishable by specified military proceedings or by a court-martial. The bill would also state that these provisions do not preclude any other military or civilian authority from exercising its jurisdiction over any act or omission that violates any local, state, or federal law. Existing law requires the Military Department, on or before July 1 of each year, to report specified information to the Governor, the Legislature, the Senate Committee on Veterans Affairs, the Assembly Committee on Veterans Affairs, the Attorney General, and the United States Attorney for each district in California, including, among other things, statistical data relating to incidents of sexual assault against service members and plans for the prevention of, and response to, sexual assault involving service members. This bill would require that information to also include statistical data relating to incidents of sexual harassment against service members and plans for the prevention of, and response to, sexual harassment involving service members. The bill would also require the department to make that information available on the department's internet website in the form of aggregated statistical data, as specified. Existing law states that members of the militia in active service shall not be liable civilly or criminally for any act done by them in the performance of their duty. This bill would clarify that this exemption does not apply to any act or acts by members of the militia in the active service of the state done by them outside the performance of their military duty, including, but not limited to, sexual assault or sexual harassment.

Equestrian safety.

Existing law generally establishes rules of the road for the operation of vehicles on state highways and roads, and authorizes the Department of Transportation and local governments to consider equestrian safety and designate equestrian crossings on highways, as specified. Existing law requires a person under 18 years of age to wear a properly fitted and fastened bicycle helmet, as specified, while operating, or riding as a passenger upon, a bicycle, a nonmotorized scooter, or a skateboard, or while wearing in-line or roller skates, upon a street, bikeway, or any other public bicycle path or trail. A violation of the Vehicle Code is punishable as an infraction. This bill would require a person under 18 years of age to wear a properly fitted and fastened helmet meeting specified requirements when that person is riding an equestrian animal on a paved highway. The bill would require a person, regardless of age, riding an equestrian animal upon a paved highway during hours of darkness to use reflective gear or a lamp emitting a white light on their person or on the equestrian animal, as specified. The bill would make a violation of these provisions an infraction punishable by a fine of not more than $25, except as provided. By creating a new crime, the bill would impose a state-mandated local program. The bill would make the parent or legal guardian having control or custody of an unemancipated minor whose conduct violates this section jointly and severally liable with the minor for the amount of the fine. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Relative to Public Power Week.

This measure would designate the first full week of October of each year as "Public Power Week" in the State of California in honor of public power utilities and their customer-owners, policymakers, and employees who work together to provide the best possible energy service for the benefit of their communities.

Sacramento Municipal Utility District: zero-carbon emissions goal.

This measure would recognize the Sacramento Municipal Utility District (SMUD) for setting the most ambitious carbon reduction goal of any large utility in the country and applaud SMUD's commitment to finding innovative ways to reach its zero-carbon emissions goal without impacting reliability or rates. The measure would recognize that SMUD's zero-carbon emissions goal puts the Sacramento region on the map as an example to follow and as a region where innovative, climate-friendly businesses want to be, the achieving the zero-carbon emissions goal that brings benefits not only globally, but also locally, the reduced emissions improve our local air quality and overall health and create jobs, and that SMUD is helping create a cleaner, more prosperous, and healthier region for all.
