The Brady-Jared Teen Driver Safety Act of 1997 allows for the issuance of a driver's license to an applicant who is at least 16 years of age but under 18 years of age pursuant to the provisional licensing program. A person licensed under this program is prohibited during the first 12 months after issuance of a license from driving during the hours of 11 p.m. and 5 a.m. or from transporting passengers who are under 20 years of age, unless he or she is accompanied by a licensed driver who is his or her parent or guardian, at least 25 years of age, or a certified driving instructor. The act provides that this licensee may drive between the hours of 11 p.m. and 5 a.m. or transport an immediate family member without being accompanied as prescribed under certain circumstances, including the necessity of the licensee or the licensee's immediate family member when reasonable transportation facilities are inadequate and operation of a vehicle by a minor is necessary to transport the licensee or the licensee's immediate family member, as specified. This bill would revise this exception, to allow a person with a provisional driver's license to drive at any hour to transport an immediate family member without being accompanied due to the necessity of the licensee or the licensee's immediate family member when reasonable transportation facilities are inadequate and operation of a vehicle by a minor is necessary to transport the licensee or the licensee's immediate family member, and to also transport others who may rely on the licensee for essential education-related transportation, including, but not limited to, school carpools.

Existing law provides that the Department of Transportation shall have full possession and control of the state highway system. Existing law, when the Legislature, by concurrent resolution, has designated names for certain districts and state highway bridges and requested the placement of name plaques, authorizes the department to expend reasonable sums on those plaques. This bill would transfer the authority for naming highways, bridges, pathways, and other transportation infrastructure from the Legislature to the California Transportation Commission.

Existing law dissolved redevelopment agencies and community development agencies, as of February 1, 2012, and provides for the designation of successor agencies, as defined. Existing law imposes various requirements on successor agencies and subjects successor agency actions to the review of oversight boards. Existing law requires each oversight board to direct the successor agency to, among other things, cease performance in connection with and terminate all existing agreements that do not qualify as enforceable obligations, as defined. This bill would, in directing the successor agency to take a specified action, prohibit the oversight board from requiring the successor agency to take any action that results in the forgiveness, wholly or partially, of a loan, advance, or indebtedness that is owed by a private entity to the dissolved redevelopment agency. The bill would authorize the oversight board, consistent with a specified provision of law, to set aside any agreements relating to the forgiveness of indebtedness, loans, or advances owed by a private entity to the dissolved redevelopment agency dating back to January 1, 2011.
Existing law makes it unlawful for a person to advertise, solicit, or contract to manufacture, repair, or renovate upholstered furniture, as specified, without obtaining a custom upholsterer's license from the Bureau of Electronic and Appliance Repair, Home Furnishings, and Thermal Insulation within the Department of Consumer Affairs. This bill would eliminate those provisions. The bill would make conforming changes. Existing law requires a person who advertises, solicits, or contracts to repair or renovate upholstered furniture and who does not do the work himself or herself or have it done by employees to obtain a license as a retail furniture dealer. This bill would eliminate that requirement.
This measure would designate April 18, 2012, as DMV/Donate Life California Day in the State of California, and April 2012 as DMV/Donate Life California Month in the State of California, and would encourage all Californians to be organ, tissue, and blood donors.
Existing law authorizes the governing board of any school district to permit a person, except a person required to register as a sex offender, as specified, to volunteer to supervise pupils during the school lunch period or any breakfast period or nutrition period, or to serve as a nonteaching volunteer aide under the immediate supervision and direction of the certificated personnel of the district, as specified. Existing law prohibits a school district from abolishing any of its classified positions and utilizing those volunteers for those services in place of classified employees laid off as a result of the abolition of a position. This bill would authorize the governing board of a school district to permit a person, except a person required to register as a sex offender, as specified, to serve as an unpaid volunteer for a capital maintenance project in the school district. The bill would provide that, to the extent these provisions conflict with any provision of a collective bargaining agreement entered into before January 1, 2013, by a public school employer and an exclusive bargaining representative, the provisions shall not apply to the school district until the expiration of that collective bargaining agreement.
This measure would recognize April 23, 2012, to April 30, 2012, inclusive, as Black April Memorial Week, and April 2012 as Vietnamese American month.
Existing law establishes a workers' compensation system to compensate an employee for an injury sustained in the course of his or her employment. Existing law requires that these provisions be liberally construed by the courts with the purpose of extending the benefits of these provisions for the protection of persons injured in the course of their employment. This bill would, require that these provisions be strictly construed by the courts with respect to what constitutes an independent contractor, as defined for purposes of limiting the inappropriate extension of these benefits to persons not intended to receive them.
Existing law provides that any elected public officer who takes public office, or is reelected to public office, on or after January 1, 2006, who is convicted of any specified felony arising directly out of his or her official duties, forfeits all rights and benefits under, and membership in, any public retirement system in which he or she is a member, effective on the date of final conviction, as specified. This bill would require that an employee of a school district, county office of education, or charter school, who is convicted of any state or federal felony for conduct arising out of, or in the performance of, his or her official duties in pursuit of the office or appointment, or in connection with obtaining salary, disability retirement, or service retirement, or other benefits, forfeit retirement benefits earned or accrued from the earliest date of the commission of the felony to the forfeiture date, as specified. The bill would also require any contributions to the public retirement system made by the employee on or after the earliest date of commission of the felony to be returned, without interest, to the employee upon the occurrence of a distribution event, as defined, unless otherwise ordered by a court or determined by the pension administrator.
