Relative to the Eagle Staff.

This measure would recognize the history and significance of the Eagle Staff to Native American tribes. The measure would express the Legislature's commitment to inclusiveness for all Native Americans and respect for the traditions and symbolism of the Eagle Staff and would urge state government departments to incorporate these principles into their policies and practices.

Public works: prevailing wages.

Existing law defines "public works," for the purposes of regulating public works contracts, as, among other things, construction, alteration, demolition, installation, or repair work done under contract and paid for, in whole or in part, out of public funds. Existing law further requires that, except as specified, not less than the general prevailing rate of per diem wages be paid to workers employed on public works and imposes misdemeanor penalties for a willful violation of this requirement. This bill would expand the definition of "public works," for the purposes of provisions relating to the prevailing rate of per diem wages, to also include any construction, alteration, demolition, installation, or repair work done under private contract on a project for a charter school, as defined, when the project is paid for, in whole or in part, with the proceeds of conduit revenue bonds, as defined, that were issued on or after January 1, 2019. Because the willful violation of prevailing wage requirements when engaged in these public works projects would result in the imposition of misdemeanor penalties, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Public health: retail sale of dogs, cats, and rabbits.

Existing law requires a pet store operator, as defined, to comply with laws governing, among other things, the care and sale of, animals in a pet store. Existing law prohibits, commencing January 1, 2019, a pet store operator from selling a live dog, cat, or rabbit in a pet store unless the animal was obtained from a public animal control agency or shelter, society for the prevention of cruelty to animals shelter, humane society shelter, or rescue group, as specified. Existing law imposes, effective January 1, 2019, a civil penalty on a pet store operator who violates these prohibitions. This bill would additionally require a pet store operator to maintain records documenting the health, status, and disposition of each animal for at least 2 years after the animal is sold, and make these records available to specified individuals. This bill would require a pet store operator to provide to the prospective purchaser the pet return policy of the store. The bill would require the organization providing the animal to the pet store, upon request of the pet store operator, to provide the terms of the transfer and information about the animal, as specified. The bill would require a per store to provide any veterinary records of the animal to a prospective purchaser or purchaser.

Teacher credentialing: out-of-state prepared teachers: clear credential.

Existing law requires the Commission on Teacher Credentialing to, among other duties, establish standards for the issuance and renewal of credentials, certificates, and permits. Existing law requires the commission to issue a clear multiple subject, single subject, or education specialist teaching credential to an out-of-state applicant who satisfies specified requirements, including documenting, in a manner prescribed by the commission, that he or she has completed 150 clock hours of activities that contribute to his or her competence, performance, and effectiveness in the education profession, or that he or she has earned a master's degree or higher in a field related to the credential, or the equivalent semester units, from a regionally accredited institution of higher education. This bill would eliminate that requirement as a condition for an out-of-state applicant to be issued a clear multiple subject, single subject, or education specialist teaching credential.

School facilities: task order procurement contracting: Los Angeles Unified School District.

Existing law requires the governing board of any school district to let contracts for the purchase of equipment, materials, or supplies to be furnished, leased, or sold to the district, services other than construction services, and certain repairs, involving an expenditure of more than $50,000, and to let contracts for public projects, as defined, involving an expenditure of $15,000 or more, to the lowest responsible bidder who gives security as the governing board requires. Existing law authorizes personal services contracting by school districts when specified conditions are met. This bill, until January 1, 2024, would establish a pilot project in which the governing board of the Los Angeles Unified School District would be authorized to award multiple annual task order procurement contracts, not exceeding $3,000,000 each, for purposes that include, but are not limited to, services, repairs including maintenance, and construction, as described above, that are paid for with moneys from the school district's general fund. The bill would require the contracts to be awarded to the lowest responsible bidder and to be based primarily on plans and specifications for typical work. The bill would require the school district, before entering into a contract under these provisions, to ensure that it is in compliance with the above-described provisions authorizing personal services contracting by school districts when specified conditions are met. The bill would authorize task order procurement contracts to only be awarded to supplement existing personnel and would prohibit task order procurement contracts from being used to supplant existing personnel. The bill would authorize task order contracting pursuant to these provisions only if the school district has entered into a project labor agreement or agreements, as specified. The bill would require the school district, by January 15, 2023, to submit to committees of the Legislature a specified report on the use of the task order procurement method and to pay for the report. By requiring this report, this bill would impose a state-mandated local program. This bill would make legislative findings and declarations as to the necessity of a special statute for the Los Angeles Unified School District. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

Relative to World Oceans Day.

This measure would recognize June 8 as World Oceans Day, and would declare that the Legislature intends to act decisively in 2018 in regard to passing legislation aimed at reducing plastic pollution in California rivers, beaches, and ocean, and would further declare that the State of California is determined to seek additional ways to curb plastic pollution on those waterways and beaches, and in other natural spaces and communities.

Relative to Philippine Independence Day.

This measure would recognize June 12, 2018, as the 120th Anniversary of Philippine Independence and would call upon the people of the state to observe the month of June with appropriate ceremonies, programs, and activities.
