Relative to the 76th anniversary of the repeal of the Chinese Exclusion Act.

This measure would mark December 17, 2019, as the 76th anniversary of the repeal of the Chinese Exclusion Act to honor the contributions of all immigrants and refugees in our communities. The measure would also declare the opposition of the Legislature to executive orders and a presidential proclamation signed by President Trump relating to immigration, call upon the President to revoke those orders and that proclamation, condemn the expansion of deportations being undertaken under the current presidential administration, stand in firm opposition to the President's proposal for construction of a wall along the southern border with Mexico, and reaffirm that the state is open and welcoming to immigrants and refugees who are integral to life in our state.

Natural disasters: insurance and related alternative risk transfer products: Special Fund for Economic Uncertainties.

Existing law, the California Emergency Services Act, among other things, vests the Governor with various powers and duties related to that act, including coordinating the State Emergency Plan and those programs necessary for the mitigation of the effects of an emergency in this state. Existing law authorizes the Governor to expend any appropriation for support of the California Emergency Services Act to carry out its provisions. Existing law creates the Department of Insurance, headed by the Insurance Commissioner, and prescribes the commissioner's powers and duties, including a duty to convene a working group to identify, assess, and recommend risk transfer market mechanisms that promote investment in natural infrastructure to reduce the risks of climate change related to catastrophic events, create incentives for investment in natural infrastructure to reduce risks to communities, and provide mitigation incentives for private investment in natural lands to lessen exposure and reduce climate risks to public safety, property, utilities, and infrastructure. Existing law establishes the Special Fund for Economic Uncertainties, a continuously appropriated fund, and requires the Controller to transfer as necessary from that fund to the unappropriated balance of the General Fund an amount necessary to eliminate any General Fund deficit as of the end of each fiscal year. Existing law also continuously appropriates moneys in the Special Fund for Economic Uncertainties to the Director of Finance for the purpose of allocating funds for disaster relief, as specified. This bill would authorize the Governor to purchase insurance, reinsurance, insurance linked securities, or other related alternative risk transfer products for the State of California to help mitigate against costs incurred by the state in response to a mudslide, wildfire, or flood. The bill would require the Office of Emergency Services, or another agency designated by the Governor, to work with the Treasurer and the Insurance Commissioner to determine the appropriate product to be purchased by the state pursuant to these provisions. The bill would authorize the Office of Emergency Services, or the Governor's designee, the Treasurer, and the Insurance Commissioner to consult with the working group described above when implementing these provisions. The bill would continuously appropriate moneys in the Special Fund for Economic Uncertainties to the Director of Finance, and would authorize the Director of Finance to allocate funds from the Special Fund for Economic Uncertainties to the Governor, for these purposes, thereby making an appropriation.

Taxation: renters' credit.

The Personal Income Tax Law authorizes various credits against the taxes imposed by that law, including a credit for qualified renters in the amount of $120 for spouses filing joint returns, heads of household, and surviving spouses if adjusted gross income is $50,000, as adjusted, or less, and in the amount of $60 for other individuals if adjusted gross income is $25,000, as adjusted, or less. Existing law requires the Franchise Tax Board to annually adjust for inflation these adjusted gross income amounts. For 2018, the adjusted gross income limit is $83,282 and $41,641, respectively. Existing law requires any bill authorizing a new tax credit to contain, among other things, specific goals, purposes, and objectives that the tax credit will achieve, detailed performance indicators, and data collection requirements. Existing law establishes the continuously appropriated Tax Relief and Refund Account in the General Fund and provides that payments required to be made to taxpayers or other persons from the Personal Income Tax Fund are to be paid from that account, including any amount allowable as an earned income tax credit in excess of any tax liabilities. This bill, for taxable years beginning on or after January 1, 2020, and before January 1, 2025, and only when specified in a bill relating to the Budget Act, would increase the credit amount for a qualified renter to $220 and $434, as provided. In the event the increased credit amount is not specified in a bill relating to the Budget Act, the existing credit amounts of $120 and $60, as described above, respectively, would be the credit amounts for that taxable year. The bill would require the Franchise Tax Board to annually recompute for inflation the credit amount for taxable years on or after January 1, 2021, and before January 1, 2025, unless otherwise provided. The bill would provide findings and declarations relating to the goals, purposes, and objectives of this credit. The bill, for credits allowable for taxable years beginning on or after January 1, 2020, and before January 1, 2025, would provide that the credit amount in excess of the qualified renter's liability would be refundable and paid from the Tax Relief and Refund Account to the qualified renter upon appropriation by the Legislature. This bill would take effect immediately as a tax levy.

Disaster relief: Camp Fire.

The California Disaster Assistance Act provides that the state share for disaster project allocations to local agencies is no more than 75% of total state eligible costs, except for specified events for which the state share is up to 100% of state eligible costs. This bill would provide that the state share is up to 100% of total state eligible costs connected with the Camp Fire that started on November 8, 2018, in the County of Butte. This bill would make legislative findings and declarations as to the necessity of a special statute for the County of Butte. This bill would declare that it is to take effect immediately as an urgency statute.

Relative to Philippine Independence Day.

This measure would recognize June 12, 2019, as the 121st Anniversary of Philippine Independence and would call upon the people of the state to observe the month of June with appropriate ceremonies, programs, and activities.

Immigration: Development, Relief, and Education for Alien Minors Act: Deferred Action for Childhood Arrivals: Deferred Enforced Departure: Temporary Protected Status.

This measure would urge the President and the Congress of the United States to enact legislation to provide permanent legal status and a path to citizenship for immigrant youths and individuals with Deferred Enforced Departure and Temporary Protected Status.
