Relative to New United Motor Manufacturing, Inc.

This measure would make various statements regarding the importance of New United Motor Manufacturing, Inc. (NUMMI) to the California economy and would declare the necessity for the Legislature to utilize its vested powers to keep NUMMI in California.

Relative to pancreatic cancer.

California YouthBuild Program: funding and designation.

Existing law establishes the California YouthBuild Program and authorizes the director of the Employment Development Department to make grants to eligible applicants, as provided, for specified purposes. Existing law also authorizes the director to contract with qualified nonprofit organizations to provide technical assistance to YouthBuild programs. Existing law also authorizes the director to contract with qualified nonprofit organizations to provide technical assistance to YouthBuild programs. Existing law allows the department to accept proposals for funding from applicants who establish their eligibility, as provided, by submitting proof that they have been funded or designated as a federal YouthBuild program by the Department of Housing and Urban Development, and restricts the use of the term "YouthBuild" to programs funded pursuant to the California YouthBuild Program. This bill, in conformity with the federal YouthBuild Transition Act of 2005 that transferred the administration of the YouthBuild program from the Department of Housing and Urban Development to the Department of Labor, would revise those provisions that make reference to the Department of Housing and Urban Development to refer instead to the Department of Labor.

Criminal history information: law enforcement employees.

Existing law requires the Department of Justice to maintain various data and information pertaining to criminal history information and to disclose that information under specified circumstances to various specified recipients. This bill would require the department to disseminate the date and agency name associated with all retained peace officer or nonsworn law enforcement agency employee preemployment criminal offender record information search requests, as specified. The bill would also require the department to retain an individual's fingerprint images and related information submitted as part of a peace officer or nonsworn law enforcement agency employee preemployment criminal offender record information search request, as specified.

Relative to the economy.

This measure would urge the Congress of the United States and the federal administration to work with the Governor and the Legislature of the State of California to, among other things, provide federal loan guarantees, flexibility with respect to certain programs, and certain funding levels for vital programs, as specified.

Relative to Chinese Americans in California.

This measure would acknowledge the history of the Chinese in California, recognize the contributions made to the State of California by Chinese Americans and Chinese immigrants, and express regret for past discriminatory laws and constitutional provisions which resulted in the persecution of Chinese living in California.

Sales and use taxes: exemption: automobile manufacturing equipment.

The Sales and Use Tax Law imposes a tax on retailers measured by the gross receipts from the sale of tangible personal property sold at retail in this state, or on the storage, use, or other consumption in this state of tangible personal property purchased from a retailer for storage, use, or other consumption in this state. This bill would, on and after January 1, 2010, exempt from those taxes the gross receipts from the sale of, and the storage, use, or other consumption in this state of tangible personal property, as specified purchased for use by an automobile manufacturer. The Bradley-Burns Uniform Local Sales and Use Tax Law authorizes counties and cities to impose local sales and use taxes in conformity with the Sales and Use Tax Law, and the Transactions and Use Tax Law authorizes districts, as specified, to impose transactions and use taxes in conformity with the Sales and Use Tax Law. Exemptions from state sales and use taxes are incorporated in these laws. Section 2230 of the Revenue and Taxation Code provides that the state will reimburse counties and cities for revenue losses caused by the enactment of sales and use tax exemptions. This bill would provide that, notwithstanding Section 2230 of the Revenue and Taxation Code, no appropriation is made and the state shall not reimburse local agencies for sales and use tax revenues lost by them pursuant to this bill. The California Constitution authorizes the Governor to declare a fiscal emergency and to call the Legislature into special session for that purpose. The Governor issued a proclamation declaring a fiscal emergency, and calling a special session for this purpose, on July 1, 2009. This bill would state that it addresses the fiscal emergency declared by the Governor by proclamation issued on July 1, 2009, pursuant to the California Constitution. This bill would take effect immediately as a tax levy.

Relative to Dr. Martin Luther King, Jr. Day.

This measure would designate that January 19, 2009, be observed as the official memorial of the late Rev. Dr. Martin Luther King, Jr.'s birth, and commemorate Dr. Martin Luther King, Jr. Day, the work of Dr. Martin Luther King, Jr., and the Civil Rights Movement in changing public policy in California and in the United States of America.
