Under existing law, any person who has an interest in a matter in litigation, or in the success of either of the parties, or an interest against both, may intervene in the action or proceeding. Existing law provides that a third person may become a party to an action or proceeding between other persons, either by joining the plaintiff in claiming what is sought by the complaint, uniting with the defendant in resisting the claims of the plaintiff, or demanding anything adversely to both the plaintiff and the defendant, by filing a complaint setting forth the grounds upon which the intervention rests, as specified. This bill would require that a person seeking to intervene in an action or proceeding, deemed the intervenor, petition the court for leave to intervene by noticed motion or ex parte application setting forth the grounds upon which the intervention rests, and would require the intervenor to include a copy of the proposed complaint in intervention or answer in intervention with the petition. The bill would also require the intervenor to serve the order, or notice of the court's decision or order, granting leave to intervene and the pleadings in intervention on all other parties in the action or proceeding, as specified. The bill would also recast some provisions of existing law and make conforming changes to other provisions of law.

Existing law, the Uniform Supervision of Trustees and Fundraisers for Charitable Purposes Act, requires a commercial fundraiser for charitable purposes and a fundraising counsel for charitable purposes to register with and to file specified items with the Attorney General's Registry of Charitable Trusts and provides that the register, copies of instruments, and the reports filed with the Attorney General are subject to public inspection, as specified. Existing law requires the Attorney General to withhold any instrument so filed whose content is not exclusively for charitable purposes from public inspection, as specified. This bill would additionally include any instrument filed with the Attorney General for these purposes among those documents to be open to public inspection. The bill would, however, require the Attorney General to withhold from public inspection any report filed with any governmental entity, as specified, that is required by law to be kept confidential, specified portions of documents that do not relate to charitable purposes or charitable assets and that are not otherwise records, public and donor information that is exempt from public inspection under a certain federal law, except as specified. Existing constitutional provisions require that a statute that limits the right of access to the meetings of public bodies or the writings of public officials and agencies be adopted with findings demonstrating the interest protected by the limitation and the need for protecting that interest. This bill would make legislative findings to that effect.

Existing law imposes an excise tax on motor vehicle fuel (gasoline) . Existing law, as a result of the elimination of the sales tax on gasoline effective July 1, 2010, provides for a commensurate increase in the excise tax on gasoline. These taxes are deposited to the Motor Vehicle Fuel Account in the Transportation Tax Fund. Existing law requires certain moneys attributable to taxes imposed upon distribution of gasoline related to specified off-highway motor vehicles and off-highway vehicle activities to be transferred monthly from the Motor Vehicle Fuel Account to the Off-Highway Vehicle Trust Fund. Existing law, however, transfers, with respect to the increase in gasoline excise taxes as a result of the elimination of the sales tax on gasoline, to the General Fund the revenues attributable to off-highway vehicles that would otherwise be deposited in the Off-Highway Vehicle Trust Fund. Existing law also requires the Controller to withhold $833,000 from the monthly transfer, and transfer that amount to the General Fund. The moneys in the Off-Highway Vehicle Trust Fund are required to be used, upon appropriation, for specified purposes related to off-highway motor vehicle recreation. This bill would, on June 30, 2017, eliminate the requirement that the Controller withhold $833,000 from the monthly transfer and transfer it to the General Fund and would thereby transfer this amount monthly to the Off-Highway Vehicle Trust Fund.

This act would declare June 10, 2016, as Portugal Day to celebrate Portuguese national heritage.

This measure would recognize May 24, 2016, as Slavic Heritage Day.

This measure would proclaim that Monday, January 18, 2016, be observed as the official memorial of Dr. Martin Luther King, Jr.'s birth and his work in the Civil Rights Movement.

This measure would recognize May 2016 as Celiac Disease Awareness Month.

This measure would commend the American Society for the Prevention of Cruelty to Animals on the celebration of its 150th anniversary and for the myriad contributions it has made to the health and well-being of animals nationwide and would extend best wishes for continued success in the future.
