Relative to human trafficking.

This resolution would recognize the month of January 2012, and each following January, as National Slavery and Human Trafficking Prevention Month, and it would recognize February 1, 2012, and each following February 1, as California's Free From Slavery Day.

Continuing education.

Existing law provides for the licensure and regulation of professions and vocations by boards within the Department of Consumer Affairs and these boards may require licensees to satisfy continuing education course requirements. This bill would provide, if applicable, that continuing education or competency courses, as specified, that advance or promote labor organizing on behalf of a union, or that advance or promote statutory or regulatory changes, political candidates, political advocacy, or political strategy shall not be considered content relevant to the practice regulated by the board and shall not be acceptable for meeting requirements for licensure renewal. The bill would also prohibit, to the extent applicable, an approved provider from representing that such a continuing education or competency course is acceptable for meeting requirements for licensure renewal and would require a board, subject to specified procedural requirements, to withdraw its approval of a provider that violates that requirement for no less than 5 years, as specified.

Employment regulation: volunteers.

Existing law prescribes wages, hours, and working conditions for all employees in the state, not including any individual employed as an outside salesman or participating in a national service program, as specified. Existing law provides a system for the imposition of criminal and civil sanctions against a person violating statutes and regulations of the state relating to the employment of minors, as defined, in various activities and occupations. Existing law prescribes the maximum number of hours per day and per week that an employer may employ a minor. This bill would exempt an individual who renders services as a volunteer, as defined, from those provisions.

Administrative Procedure Act: notice of proposed actions: local government agencies.

The Administrative Procedure Act governs the procedure for the adoption, amendment, or repeal of regulations by state agencies and for the review of those regulatory actions by the Office of Administrative Law. This bill would require an agency, when it considers it appropriate, to mail or to electronically mail a notice of proposed action to adopt, amend, or repeal a regulation to local government agencies or local government agency representatives, as defined, that are likely to be affected by the proposed action, as prescribed.

Public safety: Local Safety and Protection Account: appropriation.

The Vehicle License Fee Law, in lieu of any ad valorem property tax upon vehicles, imposes an annual license fee for any vehicle subject to registration in this state in the amount of 1% of the market value of that vehicle, as provided, for a specified amount of time. Existing law also, until July 1, 2011, imposes an additional tax equal to 0.15% of the market value of specified vehicles, as determined by the Department of Motor Vehicles, to the vehicle license fee, to be deposited in the General Fund and transferred to the Local Safety and Protection Account, a continuously appropriated fund. Existing law provides that money in the account shall be allocated for various public safety programs, as provided. This bill would, beginning July 1, 2011, and each July 1 thereafter for a transfer $500,000,000 from the General Fund to the account total of 5 years, as provided. By transferring funds to a continuously appropriated fund, this bill would make an appropriation. This bill would declare that it is to take effect immediately as an urgency statute.

Fireworks displays: California Environmental Quality Act: California Coastal Act of 1976.

Existing law regulates fireworks and pyrotechnic displays and requires that a permit be obtained from the State Fire Marshal in certain instances. The California Environmental Quality Act (CEQA) requires a lead agency, as defined, to prepare, or cause to be prepared by contract, and certify the completion of, an environmental impact report on a project, as defined, that it proposes to carry out or approve that may have a significant effect on the environment, or to adopt a negative declaration if it finds that the project will not have that effect. The California Coastal Act of 1976 provides for the planning and regulation of development, under a coastal development permit process, within the coastal zone. Existing law defines development for these purposes. This bill would exempt a municipal fireworks display, as defined, from the provisions of CEQA. Because a lead agency would have to determine the applicability of the exemption and to take certain specified action upon a determination of exemption, the bill would impose a state-mandated local program. The bill would provide that a coastal development permit is not required for a municipal fireworks display and would specify that "development" does not include a municipal fireworks display. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

Public lands: lease.

Under existing law, the State Lands Commission may lease state lands under the jurisdiction of the commission for any purpose as the commission deems advisable. Existing law provides that rent shall not be charged for a private recreational pier constructed on state lands for the use of a littoral landowner. This bill would also provide that rent shall not be charged for a cantilevered deck extending over state waterways for the use of a littoral landowner.

Minimum annual tax: exemption: single member limited liability company.

Existing law, generally, imposes a minimum franchise tax of $800, except as provided, on every corporation incorporated in this state, qualified to transact intrastate business in this state, or doing business in this state, and an annual tax in an amount equal to the minimum franchise tax on every limited partnership, limited liability partnership, and limited liability company registered, qualified to transact business, or doing business in this state, as specified. Existing law requires every limited liability company subject to the annual tax to pay annually to this state a fee equal to specified amounts based upon total income from all sources reportable to this state. Existing law also requires limited liability companies classified as partnerships for California tax purposes to file certain information returns. This bill would exempt a single member limited liability company, as defined, or a federal, state, or local governmental entity from that annual tax, that annual fee, and that information return. The Corporation Tax Law, in modified conformity with federal income tax laws, exempts various types of organizations from state income taxes imposed by that law. Existing law allows organizations that have obtained a ruling or determination from the Internal Revenue Code that it is exempt from federal income taxes as an organization described in Section 501(c) (3) of the Internal Revenue Code to obtain exemption from state income taxes by submitting to the Franchise Tax Board a copy of the notification issued by the Internal Revenue Service approving the organization's tax-exempt status, as specified. Existing law requires the board to issue an acknowledgment of an organization's exemption from state income taxes, as provided. This bill would prohibit an organization formed as a California corporation or qualified to do business in California that, as of the date of receipt by the Franchise Tax Board of that notification, is listed by the Secretary of State or Franchise Tax Board as "suspended" or "forfeited" from establishing its exemption from state income taxes and would provide that the organization would not receive an acknowledgement from the board of the organization's exemption until that corporation is listed by the Secretary of State and the board as an "active" corporation.

Vital records: certified copies.

Existing law prescribes specified personal information to be included on birth, death, and marriage certificates. Under existing law, a certified copy of a birth, death, marriage, or military service record may only be supplied by the State Registrar, local registrar, or county recorder to an authorized person, as defined, who submits a statement sworn under penalty of perjury that the applicant is an authorized person. Under existing law, an "authorized person" for these purposes includes a child, grandparent, grandchild, sibling, spouse, or domestic partner of the registrant. Under existing law, every local registrar, deputy registrar, or subregistrar who fails, neglects, or refuses to perform his or her duty as required by law and by the instructions and directions of the State Registrar is guilty of a misdemeanor. This bill would require, if a request for a certified copy of a birth, death, or marriage record is made in person, that the requester produce government-issued photo identification, in addition to the existing requirement of a statement sworn under penalty of perjury. The bill also would specify that a child, grandparent, grandchild, sibling, spouse, or domestic partner of a registrant, who requests a certified copy of a registrant's birth, death, or marriage record, must be an adult or emancipated minor in order to satisfy the definition of an authorized person for that purpose. By imposing new duties on local officials, and by changing the definition of a crime, this bill would create a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that with regard to certain mandates no reimbursement is required by this act for a specified reason. With regard to any other mandates, this bill would provide that, if the Commission on State Mandates determines that the bill contains costs so mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

Department of Veterans Affairs: veterans' services.

Existing law establishes the Department of Veterans Affairs, which is responsible for administering various programs and services for the benefit of veterans. This bill would appropriate the sum of $7,300,000 from the General Fund to the Department of Veterans Affairs to provide for specified veterans' services.
