This measure would declare February 22, 2011, to be Spay Day USA 2011 in California, and would request that Californians observe that day by having their dogs and cats spayed or neutered and by contributing to organizations that provide spay and neuter services.

This measure would recognize February 2011 as Black History Month, urge all citizens to join in celebrating the accomplishments of African Americans during Black History Month, and encourage the people of California to recognize the many talents, achievements, and contributions that African Americans make to their communities.
The California Constitution prohibits a bill from being passed by the Legislature until the bill with amendments has been printed and distributed to the Members. This measure would prohibit passage of a bill by a house of the Legislature unless, at least 48 hours in advance, the bill is made available to the public on the Internet, except that the house may dispense with this requirement by rollcall vote, 34 of the membership concurring.
Existing law establishes in the California Environmental Protection Agency the State Air Resources Board, which is responsible for control of emissions from motor vehicles and is designated the air pollution control agency for all purposes set forth in federal law. Existing law requires the state board to consist of 11 members appointed by the Governor, with the consent of the Senate, and specifies the qualifications of those members. This bill, commencing with the 2012 statewide general election, would require the members of the state board to be elected by district voters. The bill would require the state board, by January 1, 2012, to draw district boundaries in accordance with prescribed criteria, for the purpose of the election of state board members. The bill would prescribe requirements for the election of the members of the state board and would make other conforming changes.
This measure would urge Congress and the President to restore funding for the State Criminal Alien Assistance Program.
The Sales and Use Tax Law imposes a tax on retailers measured by the gross receipts from the sale of tangible personal property sold at retail in this state, or on the storage, use, or other consumption in this state of tangible personal property purchased from a retailer for storage, use, or other consumption in this state. That law, with certain exceptions, defines a retailer as a seller that makes any retail sale of tangible personal property and as a person that makes more than 2 retail sales of tangible personal property during any 12-month period, and defines a retail sale as a sale of tangible personal property for any purpose other than resale in the regular course of business. This bill would provide, until January 1, 2016, that a qualified destination management company, as defined, is a consumer, and not a retailer, of tangible personal property it provides to its clients pursuant to a qualified contract, as defined, for destination management services, so that the sale of the tangible personal property to the destination management company is the retail sale subject to tax. The Bradley-Burns Uniform Local Sales and Use Tax Law authorizes counties and cities to impose local sales and use taxes in conformity with the Sales and Use Tax Law, and the Transactions and Use Tax Law authorizes districts, as specified, to impose transactions and use taxes in conformity with the Sales and Use Tax Law. Exemptions from state sales and use taxes are incorporated in these taxes. Section 2230 of the Revenue and Taxation Code provides that the state will reimburse counties and cities for revenue losses caused by the enactment of sales and use tax exemptions. This bill would provide that, notwithstanding Section 2230 of the Revenue and Taxation Code, no appropriation is made and the state shall not reimburse local agencies for sales and use tax revenues lost by them pursuant to this bill. This bill would take effect immediately as a tax levy, but its operative date would depend on its effective date.
Existing law imposes various limitations on emissions of air contaminants for the control of air pollution from vehicular and nonvehicular sources. Existing law generally designates the State Air Resources Board as the state agency with the primary responsibility for the control of vehicular air pollution, and air pollution control districts and air quality management districts with the primary responsibility for the control of air pollution from all sources other than vehicular sources. Existing law creates the South Coast Air Quality Management District with jurisdiction over air quality within the South Coast Air Basin, including in the Counties of Los Angeles, Orange, Riverside, and San Bernardino. This bill would prohibit the South Coast Air Quality Management District from imposing requirements, or engaging in actions, that would prevent the operation, use, or maintenance of diesel-powered generators that would provide either primary or back-up electricity to specified facilities. This bill would make legislative findings and declarations as to the necessity of a special statute for the Santa Rosa Peak Communication Site, the Sunnyslope Communication Site, and the Glen Avon Communication Site.
This measure would request that the President and the Congress of the United States pass the H.R. 2474 that would restore funding for California veterans pursuing higher education.
The California Constitution creates the office of Lieutenant Governor and establishes qualifications for the office and the method of its election. The California Constitution requires the Lieutenant Governor to become Governor when a vacancy occurs in the office of Governor, and to act as Governor during the impeachment, absence from the state, or other temporary disability of the Governor or of a Governor-elect who fails to take office. It further requires the Legislature to provide for an order of precedence after the Lieutenant Governor for succession to the office of Governor. The California Constitution provides that the Lieutenant Governor is the President of the Senate, but votes as part of that body only for the purpose of breaking a tie. The California Constitution authorizes the people to recall a public official and provides for a recall process, which may include requiring the Governor to call an election, and requires, when a recall of the Governor is initiated, that the Lieutenant Governor perform the recall duties of the Governor. The California Constitution exempts the Lieutenant Governor, and employees directly appointed or employed by him or her, from the civil service, and requires that his or her compensation be set by the California Citizens Compensation Commission. The California Constitution establishes the University of California as a public trust to be administered by the Regents of the University of California, the membership of which includes the Lieutenant Governor. Existing statutes also establish various boards and commissions of which the Lieutenant Governor is a member. This measure would eliminate the position of Lieutenant Governor and transfer the specified duties of the Lieutenant Governor to the Secretary of State. Specifically, the measure would provide that the Secretary of State is the President of the Senate, but votes as part of that body only for the purpose of breaking a tie, and would require the Secretary of State to become Governor when a vacancy occurs in the office of Governor, and to act as Governor during the impeachment, absence from the state, or other temporary disability of the Governor or of a Governor-elect who fails to take office. The measure would also require the Secretary of State to perform the recall duties assigned to the Governor, if a recall of the Governor is initiated. The measure would additionally make the Secretary of State an ex officio member of the Regents of the University of California.
This measure would designate the week of May 2 to May 8, 2010, as Public Service Recognition Week, and encourage all Californians to recognize the crucial role of public employees in this state.
