Workers' compensation: medical treatment.

Existing law establishes a workers' compensation system, administered by the Administrative Director of the Division of Workers' Compensation, to compensate an employee for injuries sustained in the course of employment. Existing law requires the administrative director to adopt a medical treatment utilization schedule. Existing law requires the administrative director to contract with an outside independent research organization to evaluate and report on the impact of the provision of medical treatment within the first 30 days after a claim is filed, for claims filed on or after January 1, 2017, until January 1, 2019. Existing law requires the report to be completed before January 1, 2020, and to be distributed to the administrative director, the Senate Committee on Labor and Industrial Relations, and the Assembly Committee on Insurance. This bill would require the administrative director to contract with an outside independent research organization to evaluate and report on the impact of the provision of medical treatment within the first 30 days after a claim is filed for those claims filed between January 1, 2017, and January 1, 2021. The bill would require the report to be completed before July 1, 2023.

Transit operators: street harassment survey.

Existing law creates various transit districts throughout the state, with specified powers and duties relative to providing public transit service. Existing law provides various provisions applicable to all public transit and transit districts. This bill would require the Mineta Transportation Institute at San Jose State University to, on or before December 31, 2023, develop and make available on its internet website a survey for the purpose of promoting consistency in the collection of specified survey data to inform efforts to improve the safety of riders and reduce street harassment on public transit.

Civil rights: businesses: discrimination and harassment of customers: pilot program.

Existing law, the Unruh Civil Rights Act, provides that all persons within the jurisdiction of this state are entitled to full and equal accommodations in all business establishments regardless of specified characteristics, including sex, race, color, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, sexual orientation, citizenship, primary language, or immigration status. Existing law, the California Fair Employment and Housing Act (FEHA) , establishes the Civil Rights Department within the Business, Consumer Services, and Housing Agency and sets forth its powers and duties relating to enforcement of civil rights laws with respect to housing and employment and to protect and safeguard the right of all persons to obtain and hold employment without discrimination based on specified characteristics or status. Existing law prohibits an employer and other specified entities from harassing an employee, an applicant, an unpaid intern or volunteer, or a person providing services pursuant to a contract, because of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, genetic information, marital status, sex, gender, gender identity, gender expression, age, sexual orientation, or veteran or military status, if the entity, or its agents or supervisors, knows or should have known of that conduct and failed to take immediate and appropriate corrective action. This bill would require the department to establish a pilot program on or before January 1, 2025, to recognize businesses that create environments free from discrimination and harassment and would require the department to develop criteria to qualify for recognition, including, among other things, demonstrating compliance with the Unruh Civil Rights Act. The bill would require the department to provide a certificate to qualifying businesses and publish on its internet website a database of businesses receiving that certificate. The bill would require the department to evaluate whether that recognition is effective on or before January 1, 2028, as specified. The bill would provide that recognition under the pilot program does not establish and is not relevant to any defense of claims brought under existing law. The bill would repeal its provisions on July 1, 2028.

Relative to state government.

This measure would designate the East End Complex-Block 171 in Sacramento as the Mario Obledo Building, and would request the Department of General Services to determine the cost of erecting appropriate plaques and markers showing the designation and, upon receiving donations from nonstate sources, to cover that cost to erect signage.

Relative to Social Security benefits.

This measure would urge the United States Congress to amend the United States Social Security Administration's index of earnings to ensure that a decline in aggregate wages due to COVID-19 does not result in decreased benefits.

Christopher Columbus Transcontinental Highway: removal of designation.

This measure would request that the Department of Transportation remove the "The Christopher Columbus Transcontinental Highway" designation from the portion of Interstate 10 in the state, as well as any signage and markers memorializing that designation, and advise the Federal Highway Administration of the state's action.

Relative to the Select Committee to Investigate the January 6th Attack on the United States Capitol.

This measure would, among other things, on the first anniversary of the attack on the United States Capitol on January 6, 2021, urge the Select Committee to Investigate the January 6th Attack on the United States Capitol to uncover the facts, circumstances, and causes relating to the attack, and honor the individuals who died or were injured as a result of the attack.

Student loan debt repayment.

This measure would urge the United States Secretary of Education to establish and submit to the United States Congress for approval a monthly student loan payment plan for federal student loans, based on the personal savings rate as published by the federal Bureau of Economic Analysis.

Relative to the Senior Master Sergeant John James Paoletti Memorial Highway.

This measure would designate the portion of State Route 5 from El Horno Street, at postmile 10.001, to Crown Valley Parkway, at postmile 13.776, in the County of Orange as the Senior Master Sergeant John James Paoletti Memorial Highway. The measure would request that the Department of Transportation determine the cost of appropriate signs showing this special designation and, upon receiving donations from nonstate sources covering that cost, erect those signs.
