Clean, Safe, and Reliable Drinking Water Act of 2014.

(1) Existing law, the Safe, Clean, and Reliable Drinking Water Supply Act of 2012, if approved by the voters, would authorize the issuance of bonds in the amount of $11,140,000,000 pursuant to the State General Obligation Bond Law to finance a safe drinking water and water supply reliability program. Existing law provides for the submission of the bond act to the voters at the November 4, 2014, statewide general election. This bill would repeal these provisions. (2) Under existing law, various measures have been approved by the voters to provide funds for water supply and protection facilities and programs. This bill would enact the Clean, Safe, and Reliable Drinking Water Act of 2014, which, if adopted by the voters, would authorize the issuance of bonds in the amount of $8,200,000,000 pursuant to the State General Obligation Bond Law to finance a clean, safe, and reliable drinking water program. This bill would provide for the submission of the bond act to the voters at the November 4, 2014, statewide general election.

Health care coverage: discrimination.

Existing law, the Knox-Keene Health Care Service Plan Act of 1975, provides for the regulation of health care service plans by the Department of Managed Health Care and makes a willful violation of the act a crime. Existing law provides for the regulation of health insurers by the Department of Insurance. Existing law prohibits certain discriminatory acts by health care service plans and health insurers. Existing federal law, beginning January 1, 2014, prohibits a group health plan and a health insurance issuer offering group or individual health insurance coverage from discriminating with respect to participation under the plan or coverage against any health care provider who is acting within the scope of that provider's license or certification under applicable state law. Beginning January 1, 2015, this bill would prohibit a health care service plan or health insurer from discriminating against any health care provider who is acting within the scope of that provider's license or certification, as specified. Because a willful violation of the bill's provisions relative to health care service plans would be a crime, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Courts: personal services contracts.

The Trial Court Employment Protection and Governance Act establishes a trial court employee personnel system that provides authority to hire trial court personnel, regulates the classification and compensation of trial court employees, labor relations, and personnel files, and requires each trial court to establish a system of employment selection and advancement and an employment protection system. Existing law authorizes state agencies to use personal services contracts to achieve cost savings if specified standards are satisfied, including, among other things, the contract does not cause the displacement of civil service employees and the contract is awarded through a publicized, competitive bidding process. The State Personnel Board is required to review a proposed contract upon the request of an employee organization for compliance with those standards. This bill would establish specified standards if a trial court intends to enter into a contract for any services that are currently or customarily performed by that trial court's employees. Among other things, the bill would require the trial court to clearly demonstrate that the contract will result in actual overall cost savings to the trial court for the duration of the entire contract as compared with the trial court's actual costs of providing the same services. This bill would provide that these standards apply to any contract entered into on or after January 1, 2015. The bill would provide that its provisions do not apply to a contract under specified circumstances, including when services are incidental to a contract for the purchase or lease of real or personal property. This bill would require each trial court to provide a report by February 1, 2015, to the Chairperson of the Joint Legislative Budget Committee and the chairpersons of the Senate Judiciary Committee and the Assembly Judiciary Committee if the trial court entered into a contract between July 1, 2014, and December 31, 2014, inclusive, for services that were provided or are customarily provided by its trial court employees if the contract has a term extending beyond March 31, 2015. This report would be required to include specified information relating to these contracts, including an analysis of whether the contract resulted in the displacement of trial court employees. The bill would provide that its provisions are severable.

Relative to César Chávez.

This measure would call upon all Californians to observe César Chávez's birthday, March 31, as a day of public service, to recognize the hard work and self-sacrifice that farmworkers go through to feed all the families in our state, and to learn from César Chávez's life and his mission of nonviolence, social justice, and selfless service to others.

Model curricula: computer science.

Existing law requires the adopted course of study for grades 1 to 12, inclusive, to include instruction in various areas of study, including, but not limited to, English, mathematics, and social sciences. Existing law requires the State Department of Education to adopt model curricula in certain areas of instruction, including, among others, driver education and training, gang violence suppression, and substance abuse prevention. This bill would require the Superintendent of Public Instruction to consider identifying existing model curricula for kindergarten or any of grades 1 to 6, inclusive, on computer science. The bill would also require the Superintendent to consider recommending the revision of existing, or the development of new, model curricula for kindergarten or any of grades 1 to 6, inclusive, on computer science, and to consider submitting, on or before July 1, 2017, any model curricula revised or developed as a result of this bill to the State Board of Education for adoption. The bill would provide that, in addition to funds that may be appropriated by the Legislature for purposes of implementing the provisions of the bill, the Superintendent may seek out and accept funding from nonstate sources to defray the cost of identifying, developing, or revising the model curricula. The bill would make these provisions inoperative on July 1, 2018, and would repeal them on January 1, 2019.

Home care organizations.

Existing law, the Home Care Services Consumer Protection Act, provides, on and after January 1, 2015, for the licensure and regulation of home care organizations by the State Department of Social Services and the registration of home care aides. Existing law creates the Home Care Fund to fund the administration of the act, which consists of all licensure and registration fees authorized by the act. This bill would delay implementation of the this act until January 1, 2016. Existing law requires that the department post proposed rules promulgated under the act on its Internet Web site no earlier than 10 calendar days prior to the effective date of the proposed rule. This bill would require that the proposed rules be posted on the department's Internet Web site no later than 90 calendar days prior to the rule's effective date. Existing law prohibits the cost to check criminal offender records from being used to subsidize the department checking the criminal history of other persons who are not charged a fee. This bill would remove this prohibition.

Community colleges: full-time instructors.

(1) Existing law establishes the California Community Colleges under the administration of the Board of Governors of the California Community Colleges. Existing law requires the board of governors to adopt regulations that establish minimum standards regarding the percentage of hours of credit instruction that full-time instructors are required to teach. This bill would prohibit a full-time faculty member, as defined, for a community college district from being assigned a workload that includes overload or extra assignments if the overload or extra assignments exceed 50% of a full-time workload in a semester or quarter that commences on or after January 1, 2014. The bill would provide that this prohibition shall not apply to a summer or intersession term, community colleges with fewer than 3,000 full-time equivalent students, or to certain programs, as specified. The bill would also provide that the prohibition would not supersede the pertinent requirements of a collective bargaining agreement containing restrictions regarding limitations on overload or extra assignments that is in effect when this bill becomes operative. With respect to a community college district with a collective bargaining agreement that, as of January 1, 2014, prohibits a full-time faculty member from being assigned a workload that includes overload or extra assignments if the overload or extra assignments exceed 50% of a full-time workload, the prohibition in the bill would become operative on January 1, 2015. The prohibition in the bill would also apply to the workload of supervisory or managerial personnel of a community college district who are performing faculty work that is allowed under an applicable collective bargaining agreement. To the extent that this bill would impose new duties on community college districts, it would constitute a state-mandated local program. (2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

Community Revitalization and Investment Authorities.

The Community Redevelopment Law authorizes the establishment of redevelopment agencies in communities to address the effects of blight, as defined. Existing law dissolved redevelopment agencies and community development agencies, as of February 1, 2012, and provides for the designation of successor agencies. Existing law provides for various economic development programs that foster community sustainability and community and economic development initiatives throughout the state. This bill would authorize certain public entities of a community revitalization and investment area, as described, to form a community revitalization plan within a community revitalization and investment authority (authority) to carry out the Community Redevelopment Law in a specified manner. The bill would require the authority to adopt a community revitalization plan for a community revitalization and investment area and authorize the authority to include in that plan a provision for the receipt of tax increment funds.

Public contracts: schools: cloud service providers.

Existing law sets forth the requirements for competitive bidding on various types of contracts awarded by state and local agencies. Existing law authorizes a school district to utilize alternative competitive negotiation methods for procuring bids for the acquisition of specified technological supplies and equipment. This bill would require specified terms, related to data types and disclosure, to be included in a school district contract with a cloud service provider entered into on or after January 1, 2015.
