Relative to New United Motor Manufacturing, Inc.

This measure would make various statements regarding the importance of New United Motor Manufacturing, Inc. (NUMMI) to the California economy and would declare the necessity for the Legislature to utilize its vested powers to keep NUMMI in California.

Marine mammal protection: swordfish importation.

This measure requests the United States government to restrict swordfish imports unless and until there is a process by which a nation seeking to export swordfish or swordfish products to the United States provides reasonable proof of the effects on marine mammals of the commercial fishing technology used to obtain the swordfish or swordfish products, and the National Marine Fisheries Service receives that proof and determines that the proof demonstrates that the swordfish or swordfish products to be imported were not caught with commercial fishing technology that results in the incidental kill or incidental serious injury of marine mammals in excess of United States standards.

Relative to the Deputy Kent Hintergardt Memorial Highway.

This measure would designate a specified portion of State Highway Route 15 in Temecula as the Deputy Kent Hintergardt Memorial Highway. The measure would also request the Department of Transportation to determine the cost of appropriate signs showing this special designation and, upon receiving donations from nonstate sources covering those costs, to erect those signs.

Relative to pancreatic cancer.

This measure would urge the President and the Congress of the United States to expand federally funded research efforts aimed at developing a reliable means of detecting pancreatic cancer in its early stages.

Housing and Emergency Shelter Trust Fund of 2006: reversion of funds.

The Housing and Emergency Shelter Trust Fund Act of 2006 authorizes the issuance of bonds in the amount of $2,850,000,000 pursuant to the State General Obligation Bond Law. One billion five hundred million dollars of proceeds from the sale of these bonds is required to be deposited in the Affordable Housing Account and a specified amount of money in the account are to be transferred to the Housing Rehabilitation Loan Fund, expended under the Multifamily Housing Program, and the Building Equity and Growth in Neighborhoods Fund, to be used for the Building Equity and Growth in Neighborhoods Program. Existing law requires that any funds not encumbered for these purposes within 30 months of availability revert for general use in the Multifamily Housing Program and CalHome Program, respectively. This bill would require that funds transferred to the Housing Rehabilitation Loan Fund that are not encumbered by July 31, 2011, revert for general use unless the Department of Housing and Community Development determines that the funds should revert sooner due to diminished demand. The bill would also require that funds transferred to the Building Equity and Growth in Neighborhoods Fund that are not encumbered by November 17, 2011, revert for general use unless the department determines that the funds should revert sooner due to diminished demand. This bill would declare that it is to take effect immediately as an urgency statute.

Transportation finance.

The Motor Vehicle Fuel License Tax Law imposes a tax of $0.18 per gallon on motor vehicle fuel, commonly referred to as gasoline. The Diesel Fuel Tax Law imposes a tax of $0.18 per gallon on diesel fuel. These revenues, after certain deductions for nonhighway fuel uses, are deposited in the Highway Users Tax Account. Approximately 13 of the revenues in the account are appropriated, to be apportioned by various formulas to cities and counties, and most of the remaining revenues are deposited in the State Highway Account after specified transfers to the Bicycle Transportation Account and the State Parks and Recreation Fund. This bill would require the Controller, if a specified portion of the Highway Users Tax Account is transferred to the Transportation Debt Service Fund, to make certain calculations regarding the amount of funding that has been transferred to the Transportation Debt Service Fund. The bill would, commencing in the 2011–12 fiscal year, and in each fiscal year thereafter for a total of 10 years, continuously appropriate a certain amount of revenues from the General Fund, which would be required to be apportioned to local agencies in a manner that fully restores the funds transferred to the Transportation Debt Service Fund. The California Constitution authorizes the Governor to declare a fiscal emergency and to call the Legislature into special session for that purpose. The Governor issued a proclamation declaring a fiscal emergency, and calling a special session for this purpose, on July 1, 2009. This bill would state that it addresses the fiscal emergency declared by the Governor by proclamation issued on July 1, 2009, pursuant to the California Constitution. This bill would declare that it is to take effect immediately as an urgency statute.

This measure would declare the week of June 29 through July 5, 2009, Yellow Ribbon Week to show support for military families and for troops fighting in Iraq and Afghanistan.

Relative to Chinese Americans in California.

This measure would acknowledge the history of the Chinese in California, recognize the contributions made to the State of California by Chinese Americans and Chinese immigrants, and express regret for past discriminatory laws and constitutional provisions which resulted in the persecution of Chinese living in California.

Relative to Dr. Martin Luther King, Jr. Day.

This measure would designate that January 19, 2009, be observed as the official memorial of the late Rev. Dr. Martin Luther King, Jr.'s birth, and commemorate Dr. Martin Luther King, Jr. Day, the work of Dr. Martin Luther King, Jr., and the Civil Rights Movement in changing public policy in California and in the United States of America.
