Digital Infrastructure and Video Competition Act of 2006: franchise renewal.

Existing law, the Digital Infrastructure and Video Competition Act of 2006, establishes a procedure for the issuance of state franchises for the provision of video service, as defined. The act designates the Public Utilities Commission as the sole franchising authority for a state franchise under the act. Existing law provides that a state-issued franchise to provide video service is only valid for 10 years after the date of issuance, and requires the holder to apply for a renewal of the state franchise for an additional 10-year period if the holder wishes to continue to provide video services in the area covered by the franchise. This bill would make nonsubstantive changes to the provision specifying conditions for renewal of a franchise under the act.

Community colleges: community service classes.

Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. Existing law establishes community college districts throughout the state, and authorizes them to provide instruction at the campuses they operate. Existing law authorizes the governing board of any community college district to establish and maintain, in accordance with specified criteria, community service classes in civic, vocational, literacy, health, homemaking, technical, and general education, including, but not limited to, classes in the fields of visual and performing arts, handicraft, science, literature, nature study, nature contacting, aquatic sports, and athletics. This bill would make nonsubstantive changes in this provision.

The California Water Plan.

Existing law requires the Department of Water Resources to update every 5 years the plan for the orderly and coordinated control, protection, conservation, development, and use of the water resources of the state, which is known as The California Water Plan. This bill would make nonsubstantive changes to that requirement.

Employment.

Existing law establishes the Department of Industrial Relations within the Labor and Workforce Development Agency and provides that one of the functions of the department is to foster, promote, and develop the welfare of wage earners of this state. This bill would make a nonsubstantive change to that provision relating to the functions of the department.

Autonomous vehicles.

Existing law establishes regulations for the operation of an autonomous vehicle on public roads for testing purposes by a driver who possesses the proper class of license for the type of vehicle being operated if the manufacturer meets prescribed requirements. This bill would make technical, nonsubstantive changes to those provisions.

Legislature: independent ombudsperson: sexual harassment.

Existing law creates the California State Auditor's Office, which is independent of the executive branch and legislative control, to examine and report annually upon the financial statements prepared by the executive branch. The California Whistleblower Protection Act additionally authorizes the State Auditor to conduct an investigative audit upon receiving specific information that an employee or state agency has engaged in an improper governmental activity, as defined. The act does not apply to the Legislature or employees of the Legislature. The act requires the auditor to establish a means of submitting allegations of improper governmental activity, and generally requires the State Auditor to keep confidential every investigation, including all investigative files and work product. This bill would state the intent of the Legislature to enact legislation establishing an independent ombudsperson, under the jurisdiction of the State Auditor, to investigate allegations of sexual harassment in the Legislature, as specified.

Alcohol and drug programs.

Existing law sets forth provisions for the transfer of the duties, powers, purposes, functions, responsibilities, and jurisdiction of the former State Department of Alcohol and Drug Programs to the State Department of Health Care Services and the State Department of Public Health, as specified, on July 1, 2013. Existing law states that the transfer is designed to perform certain tasks, including, among others, consolidating within the State Department of Health Care Services all substance use disorder functions and programs from the former State Department of Alcohol and Drug Programs and promoting opportunities for the improvement of health care delivery, as specified. This bill would make a technical, nonsubstantive change to one of those provisions.

Mental health services.

Existing law establishes the State Department of Public Health, to be headed by the State Public Health Officer and sets forth its powers and duties. Existing law authorizes the department to maintain a mental health service for advising and assisting local departments of health and education in the establishment of mental health services, particularly in connection with maternal and child health conferences and in the schools of the state. This bill would make nonsubstantive changes to that provision.

City streets and highways.

Existing law authorizes the legislative body of a city to do any and all things necessary to lay out, acquire, and construct any section or portion of any street or highway within its jurisdiction as a freeway and to make any existing street or highway a freeway. This bill would make nonsubstantive changes to this provision.

Professional engineers.

The Professional Engineers Act provides for the licensure and regulation of professional engineers by the Board for Professional Engineers, Land Surveyors, and Geologists. Existing law defines the term "professional engineer" for purposes of that act. This bill would make nonsubstantive changes to that definitional provision.
