Property taxation: assessment appeals: deferral of tax payment.

Existing property tax law provides for the payment property taxes on real property on the secured roll in two installments, which are due and payable on specified dates. Under existing property tax law, unpaid property taxes become delinquent, and subject to a delinquent penalty of 10%, as provided. Under existing law, the case of corrections or cancellations made to the roll following a decision of a board of equalization or assessment appeals board in an adopting county if the taxpayer has failed to pay an amount of taxes computed upon assessed value that is the subject of a pending assessment appeal, that taxpayer's relief from penalties is limited to the difference between the county board's final determination of value and the value on the assessment roll for the fiscal year covered by the taxpayer's application for reduction in assessment. This bill, notwithstanding any other law, would require, upon the filing of an application with a county board of equalization or assessment appeals board for a reduction in an assessment as provided, that the date on which the taxes on the secured roll for the subject real property are due and payable be tolled during the pendency of the assessment appeal as to the disputed amount of the taxes. The bill would authorize tolling only for real property that the taxpayer both owns and occupies. The bill would provide that any taxes owed by the taxpayer are due and payable on specified dates after the resolution of the assessment appeal, as provided, and, if unpaid, deemed delinquent and subject to penalty. The bill would authorize the Governor to suspend operation of these provisions by executive order when, in the Governor's judgment, economic conditions affecting the market in real property on a statewide basis warrant such a suspension. The bill would also make various conforming changes. By adding to the duties of local tax officials to administer these provisions, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

Relative to Family Justice Centers.

This measure would declare March 5, 2020, as Family Justice Center Day in California and would recognize the lifesaving and hope-giving work of the California Family Justice Center Network and its member Family Justice Centers as they work with rape crisis centers, domestic violence shelters, human trafficking agencies, prosecutors' offices, law enforcement agencies, and other professionals and community-based organizations to ensure that adult and child survivors of trauma can access all of their services in one setting.

Relative to California Arbor Day.

This measure would recognize March 7, 2020, as California Arbor Day, and would urge California residents to observe the day with appropriate tree-planting activities and programs.

Electricity: demand response: base interruptible program.

Under existing law, the Public Utilities Commission has regulatory authority over public utilities, including electrical corporations. Existing law requires each load-serving entity, defined as including electrical corporations, electric service providers, and community choice aggregators, to maintain physical generating capacity and electrical demand response adequate to meet its electrical demand requirements. Existing law requires the commission to establish rules for how and when backup generation may be used within a demand response program and to establish reporting and data collection requirements to verify compliance with those rules. Pursuant to existing law, the commission has authorized the state's 3 largest electrical corporations to offer reliability-based demand response programs, including the base interruptible program, which is available to qualifying nonresidential customers of an electrical corporation. This bill would require that the base interruptible program, as administered by the state's 3 largest electrical corporations in 2018, be available to qualifying industrial customers regardless of the load-serving entity that is that customer's supplier of electricity. The bill would require that the minimum incentive levels for program participation be those applicable within the service territory of each electrical corporation during 2018, adjusted for inflation using a price index determined by the commission to be appropriate. The bill would authorize the commission to approve increased incentive levels for program participation if the commission determines that those increased incentives are reasonably warranted to ensure continued participation by eligible industrial customers, within the upper limits established by the commission, and to ensure continued delivery of resource adequacy and expected ratepayer benefits. Because the bill would require actions by those load-serving entities that are community choice aggregators, the bill would impose a state-mandated local program. Under existing law, a violation of the Public Utilities Act or any order, decision, rule, direction, demand, or requirement of the commission is a crime. Because the provisions of this bill would be a part of the act and because a violation of an order or decision of the commission implementing its requirements would be a crime, the bill would impose a state-mandated local program by creating a new crime. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for specified reasons.

Rosa Parks Day in California: 20th Anniversary.

This measure would memorialize the achievements of Rosa Parks in the Civil Rights Movement and would commemorate the 20th Anniversary of Rosa Parks Day in California on February 4, 2020.

License fees: military partners and spouses.

Existing law provides for the licensure and regulation of various professions and vocations by boards within the Department of Consumer Affairs. Existing law provides for the issuance of reciprocal licenses in certain fields where the applicant, among other requirements, has a license to practice within that field in another jurisdiction, as specified. Existing law requires a board within the department to expedite the licensure process for an applicant who holds a current license in another jurisdiction in the same profession or vocation and who supplies satisfactory evidence of being married to, or in a domestic partnership or other legal union with, an active duty member of the Armed Forces of the United States who is assigned to a duty station in California under official active duty military orders. This bill would prohibit a board from charging an initial or original license fee to an applicant who meets these expedited licensing requirements.

Relative to Maternal Health Awareness Day.

This measure would proclaim January 23, 2020, as Maternal Health Awareness Day, to draw attention to the efforts that have improved maternal health in California and to highlight the need for continued improvement of maternal health for all women.
