Health care: mammograms.

Existing law requires specified information to be provided to patients regarding their health care. Existing federal law requires a written report of the results of each mammography examination and requires a summary of that report to be sent to the patient within a specified time period. This bill, from April 1, 2013, until January 1, 2019, would require, under specified circumstances, a health facility at which a mammography examination is performed to include in the summary of the written report that is sent to the patient a prescribed notice on breast density.

Standardized Testing and Reporting Program: academic achievement: assessment instrument.

Existing law requires the Superintendent of Public Instruction, with approval of the State Board of Education, to develop an Academic Performance Index (API) , as part of the Public School Performance Accountability Program, to measure the performance of schools, especially the academic performance of pupils. The Leroy Greene California Assessment of Academic Achievement Act requires the Superintendent to design and implement a statewide pupil assessment program, known as the Standardized Testing and Reporting (STAR) Program. Existing law requires the State Department of Education to develop and adopt primary language assessments that are aligned to the state academic content standards, as specified. This bill would authorize the department, subject to the approval of the state board, to make available to school districts and charter schools a primary language assessment, as specified, that allows school districts and charter schools to assess pupils who are enrolled in a dual language immersion program, as specified, and who are either nonlimited English proficient or redesignated fluent English proficient. The bill would require that a school district or charter school that chooses to administer the primary language assessment do so at its own expense, and enter into an agreement, subject to the approval of the department, with the state testing contractor, as specified.

Education finance: California Task Force on School Finance.

Existing law establishes the public school system in this state, and, among other things, provides for the establishment of school districts throughout the state and for their provision of instruction at the public elementary and secondary schools they operate and maintain. Existing law establishes a public school funding system that includes, among other elements, the provision of funding to local educational agencies through state apportionments, the proceeds of property taxes collected at the local level, and other sources. This bill would establish a 21-member California Task Force on School Finance as of January 1, 2013, to review and analyze alternative formulas for allocating funds to public schools in California for the purpose of identifying and recommending a formula or formulas that best meet the needs of California's public school system and public school pupils. The bill would specify criteria to be used by the task force to evaluate funding formulas. The bill would provide that 10 of the members of the task force would be appointed by the Governor, 5 appointed by the Speaker of the Assembly, 5 appointed by the Senate Committee on Rules, and that the Superintendent of Public Instruction or his or her designee would be a member of, and serve as chair of, the task force. The bill would specify the qualifications of the appointees, and provide for reimbursement for their expenses in attending meetings. The bill would require that meetings of the task force would be subject to specified open meeting requirements. The bill would require the task force to report its findings and recommendations to the Legislature on or before April 1, 2013. The bill would become operative only if the Superintendent of Public Instruction certifies, on or before January 31, 2013, that sufficient nonstate funds are available for its implementation. This bill would make these provisions inoperative on July 1, 2013, and would repeal them as of January 1, 2014.

Medicare: dental care.

This measure would memorialize the President and Congress of the United States to enact legislation that would add comprehensive, preventative dental care coverage to Medicare benefits.

This measure would recognize the 45th anniversary of Kwanzaa and proclaim December 26 through January 1 each year as Kwanzaa Week.

Postsecondary education: military veterans.

This measure encourages the California Community Colleges, the California State University, and the University of California to consider and adopt the American Council on Education credit recommendations to give veterans due credit for their military experience.

Relative to California Bullying Prevention Day.

This measure would declare December 12, 2012, as California Bullying Prevention Day, and would recognize the need for individuals, schools, communities, businesses, local governments, and the state to take action on behalf of bullying prevention in California.

Relative to the United States Postal Service.

This measure would urge the United States Postal Service to end its plan to reduce the frequency of mail delivery from 6 days to 5 days a week, and to take all appropriate measures to ensure the continuation of this 6-day mail delivery service.

Corporation taxes: apportionment: single sales factor: Middle Class Scholarship Fund.

The Corporation Tax Law imposes taxes measured by income and, in the case of a business with business income derived from or attributable to sources both within and without this state, apportions the business income between this state and other states and foreign countries in accordance with a specified 4-factor formula based on the property, payroll, and sales within and without this state, except that in the case of an apportioning trade or business that derives more than 50% of its gross business receipts from conducting one or more qualified business activities, as defined, business income is apportioned in accordance with a specified 3-factor formula. That law, for taxable years beginning on or after January 1, 2011, allows a taxpayer to apportion its business income in accordance with a single sales factor formula, except as provided, pursuant to an irrevocable annual election, as specified. That law also provides that sales of tangible personal property and sales of other than tangible personal property are in this state in accordance with specified criteria. This bill, for taxable years beginning on or after January 1, 2012, would require a taxpayer, except as provided, to apportion its business income in accordance with a single sale factor and would allow a taxpayer to annually elect to apportion business income in accordance with the 4-factor formula, as provided. This bill also would revise the rules that determine whether a taxpayer is doing business in this state and would revise the provisions that determine whether sales other than tangible personal property occur in this state, including specific provisions for cable systems or networks. This bill would require any aggregate increase in revenues derived from its provisions less a specified amount, as provided, to be deposited into the Middle Class Scholarship Fund, which the bill would establish, and, upon appropriation by the Legislature, allocate those revenues for the purpose of increasing the affordability of higher education. This bill would become operative only if a specified measure is chaptered and establishes a middle-class scholarship program. This bill would declare that it is to take effect immediately as an urgency statute.
