This measure would request the President and the Congress of the United States to enact the Social Security Fairness Act of 2009, which would repeal the Government Pension Offset and the Windfall Elimination Provision from the Social Security Act.
This measure would declare the Legislature's support for a Bill of Rights for the Children and Youth of California that resolves to invest in all children and youth so that certain goals may be achieved.
This measure would make various statements regarding the importance of New United Motor Manufacturing, Inc. (NUMMI) to the California economy and would declare the necessity for the Legislature to utilize its vested powers to keep NUMMI in California.
This measure requests the United States government to restrict swordfish imports unless and until there is a process by which a nation seeking to export swordfish or swordfish products to the United States provides reasonable proof of the effects on marine mammals of the commercial fishing technology used to obtain the swordfish or swordfish products, and the National Marine Fisheries Service receives that proof and determines that the proof demonstrates that the swordfish or swordfish products to be imported were not caught with commercial fishing technology that results in the incidental kill or incidental serious injury of marine mammals in excess of United States standards.
This measure would designate a specified portion of State Highway Route 15 in Temecula as the Deputy Kent Hintergardt Memorial Highway. The measure would also request the Department of Transportation to determine the cost of appropriate signs showing this special designation and, upon receiving donations from nonstate sources covering those costs, to erect those signs.
This measure would urge the President and the Congress of the United States to expand federally funded research efforts aimed at developing a reliable means of detecting pancreatic cancer in its early stages.
Existing law provides that any person who in good faith, and not for compensation, renders emergency medical care at the scene of an emergency shall not be liable for any civil damages resulting from any act or omission. This bill would instead provide that medical, law enforcement, and emergency personnel who in good faith, and not for compensation, render emergency medical or nonmedical care at the scene of an emergency shall not be liable for any civil damages resulting from any act or omission. This bill would also provide that any person, not including medical, law enforcement, and emergency personnel, who in good faith, and not for compensation, renders emergency medical or nonmedical care or assistance at the scene of an emergency shall not be liable for any civil damages resulting from any act or omission, as long as that act or omission does not constitute gross negligence or willful or wanton misconduct. This bill would declare that it is to take effect immediately as an urgency statute.
Existing law provides that no disaster worker who is performing disaster services during a state of war emergency, a state of emergency, or a local emergency shall be liable for civil damages on account of personal injury to or death of any person or property, as provided. This bill would provide that disaster service workers shall not be liable when acting within the scope of their responsibilities under the authority of the governmental emergency organization, as provided. This bill would provide that these provisions apply exclusively to any legal action filed on or after the effective date of this bill. This bill would declare that it is to take effect immediately as an urgency statute.
The Transportation Development Act, also known as the Mills-Alquist-Deddeh Act, provides for the allocation of local transportation funds in each county from 14 of 1% of the sales tax to various transportation purposes, including transportation planning, transit operations, and in some cases, local streets and roads. The act is administered by the transportation planning agency having jurisdiction and specifies the sequence of allocations to be made by that agency to eligible claimants. This bill would authorize the Solano Transportation Authority, a joint powers agency, to file a claim with the transportation planning agency for up to 2% of local transportation funds available to the county and city members of the authority for countywide transit planning and coordination relative to Solano County. Existing law creates the State Transit Assistance program as one of the transit programs funded by the Public Transportation Account from certain fuel sales tax revenues. Under the program, available funds are apportioned by the Controller to transportation planning agencies for allocation to transit operators and for other related purposes within the agency's jurisdiction. Apportionments are made under 2 different formulas, one based on population and the other based on operator revenue. This bill would specifically provide for the Solano Transportation Authority to be an eligible claimant for State Transit Assistance funds apportioned under the population formula, to be used for public transportation purposes, including countywide transit planning and coordination relative to Solano County.
Existing law creates the Life and Annuity Consumer Protection Fund as a special account within the Insurance Fund and requires that the moneys deposited therein, from a $1 fee levied against insurers based upon each individual life insurance and annuity product worth $15,000 or more issued to a resident of this state, be dedicated to protecting consumers of insurance products. Under existing law, that provision is repealed as of January 1, 2010. This bill would extend the operation of that provision to January 1, 2015. This bill would also require the Insurance Commissioner to annually publish on its Internet Web site a report detailing certain specified aspects of protections for the consumers of insurance products.
