Existing law requires the Secretary of State, in consultation with the Department of General Services, to approve and adopt appropriate standards established by the American National Standards Institute or the Association for Information and Image Management for the purpose of storing and recording permanent and nonpermanent documents in electronic media. Existing law also requires those standards to include a requirement that a trusted system, as defined, be utilized in storing and recording those documents in electronic media. This bill would make a technical, nonsubstantive change to this provision.

The California Constitution generally limits ad valorem taxes on real property to 1% of the full cash value of that property. For purposes of this limitation, "full cash value" is defined as the assessor's valuation of real property as shown on the 1975–76 tax bill under "full cash value" or, thereafter, the appraised value of that real property when purchased, newly constructed, or a change in ownership has occurred. Existing property tax law specifies those circumstances in which the transfer of ownership interests results in a change in ownership of the real property, and provides that certain transfers do not result in a change of ownership. This bill would provide that a transfer of a cotenancy interest, as defined, in real property from one cotenant to the other that takes effect upon the death of the transferor cotenant and before January 1, 2020, does not constitute a change of ownership, as provided. This bill would require the transferor cotenant to sign an affidavit, as specified, under penalty of perjury. The bill would repeal these provisions on January 1, 2020. By requiring the transferor cotenant to sign an affidavit under penalty of perjury, this bill would expand the scope of the existing crime of perjury, and thereby impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. Section 2229 of the Revenue and Taxation Code requires the Legislature to reimburse local agencies annually for certain property tax revenues lost as a result of any exemption or classification of property for purposes of ad valorem property taxation. This bill would provide that, notwithstanding Section 2229 of the Revenue and Taxation Code, no appropriation is made and the state shall not reimburse local agencies for property tax revenues lost by them pursuant to the bill. This bill would take effect immediately as a tax levy.

Existing law provides for the licensure of long-term health care facilities by the State Department of Public Health. Under existing law, the Long-Term Care, Health, Safety, and Security Act of 1973, the department may assess penalties for violation of prescribed state and federal requirements. Moneys collected as a result of the penalties imposed pursuant to these provisions are required to be deposited into either the State Health Facilities Citation Penalties Account or the Federal Health Facilities Citation Penalties Account, and used, upon appropriation by the Legislature, for the protection of health or property of residents of long-term health care facilities, including reimbursing residents for personal funds lost and costs associated with informational meetings. Existing law establishes the Office of the State Long-Term Care Ombudsman in the California Department of Aging. Under existing law, the office is responsible for, among other things, investigating and resolving complaints and concerns communicated by or on behalf of patients, residents, or clients of long-term care facilities, as defined. Existing law authorizes the California Department of Aging to allocate all federal and state funds for local ombudsman programs according to a specified distribution schedule. This bill would require at least 12 of the funds in the State Health Facilities Citation Penalties Account and the Federal Health Facilities Citation Penalties Account be used to fund local ombudsman programs pursuant to the aforementioned distribution schedule.

Existing law designates area agencies on aging as local units on aging in California, which are financially supported by a variety of sources, including federal funding, state and local government assistance, the private sector, and individual contributions. Existing law also provides for independent living centers, for the purpose of assisting individuals with disabilities in their attempts to live fuller and freer lives outside institutions, and achieve social and economic independence. This bill would continuously appropriate from the Federal Trust Fund, in the absence of enactment of the annual Budget Act by July 1 of a fiscal year, (1) to the California Department of Aging, the amount of federal funds contained in the Federal Trust Fund that is necessary to pay area agencies on aging for the administration of programs under their jurisdiction, and (2) to the Department of Rehabilitation, the amount of federal funds contained in the Federal Trust Fund that is necessary to pay independent living centers for the administration of programs under their jurisdiction, pending enactment of the Budget Act. This bill would declare that it is to take effect immediately as an urgency statute.

Existing law establishes the Administrator Training Program and the Chief Business Officer Training Program under the administration of the Superintendent of Public Instruction. Under these programs, the Superintendent awards incentive funding for the prescribed training to school districts and county offices of education meeting specified program criteria. This bill would establish the Classified School Employee Training Program. The bill would provide for the program to be administered by the Superintendent, with the approval of the State Board of Education. Under the Classified School Employee Training Program, the Superintendent would award incentive funding to eligible school districts, county offices of education, charter schools, and community college districts for prescribed instruction and training for classified school employees. These provisions would not become operative unless and until the Superintendent certifies that the funding for this bill in the fiscal year in which the program commences exceeds the amount appropriated for the Administrator Training Program in the Budget Act of 2009. The bill would require the State Department of Education, after the program has been operative for no more than 3 years, to develop, subject to review and approval by the state board, a report for submission to the Legislature regarding the program.

Existing law, the Automotive Repair Act, provides for the registration and regulation of automotive repair dealers, as defined. Existing law requires an automotive repair dealer to record all work done by the dealer on an invoice and to describe all service work done and parts supplied. A violation of the act is a crime. This bill would also require an automotive repair dealer to list on the invoice the manufacture date of any tire installed or sold by the dealer. By imposing a new requirement on automotive repair dealers, the violation of which would be a crime, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Existing law requires any vehicle manufacturer who alters new vehicles into housecars to, in addition to any new product warranty, assume any warranty responsibility of the original vehicle manufacturer for any and all components of the finished product that are, by virtue of any act of the alterer, no longer covered by the warranty issued by the original vehicle manufacturer. This bill would extend that warranty requirement to any vehicle manufacturer who modifies new vehicles into vehicles useable by persons with disabilities.

Under the Williamson Act, unless the board or council after notice and hearing makes a finding to the contrary, the erection, construction, alteration, or maintenance of gas, electric, water, communication, or agricultural laborer housing facilities are considered compatible uses on land under a Williamson Act contract, and no land occupied by any of those facilities may be excluded from an agricultural preserve by reason of that use. This bill would also include horse breeding and training facilities as a compatible use of land under a Williamson Act contract.

Under existing law, the Department of Veterans Affairs has specified powers and duties relating to veterans. This bill would require the Department of Veterans Affairs on or before May 1, 2010, to conduct an internal study to evaluate the process by which active duty service men and women receive information regarding veterans benefits, as specified. This bill would also require the Department of Veterans Affairs to submit a reports to the Legislature, as provided.

Under existing law, the Federal Communications Commission licenses and partially regulates providers of commercial mobile radio service, including providers of cellular radiotelephone service (cellular) , broadband Personal Communications Services (PCS) , and digital Specialized Mobile Radio (SMR) services (collectively, mobile telephony service providers) . Under existing law, no state or local government may regulate the entry of, or the rates charged by, any commercial mobile radio service, but a state or local government is generally not prohibited from regulating the other terms and conditions of commercial mobile radio service. Existing law requires mobile telephony service providers to provide certain customer and subscriber services. This bill would prohibit a mobile telephony service provider from directing a customer to a sales representative for the provider when the customer attempts to use the service to complete a telephone call to a person or business other than the provider.
