Relative to the Williamson Act.

This measure would recognize the 45th Anniversary of the California Land Conservation Act of 1965, otherwise known as the Williamson Act, and would recognize the value to the state of agricultural land conservation contracts.

Relative to Women's Equality Day.

This measure would memorialize the Congress and the President of the United States to uphold protections of women's equality and to encourage all Americans to participate in the celebration of Women's Equality Day on August 26, 2010, the 90th anniversary of the passage of the Nineteenth Amendment to the United States Constitution, which gave women the right to vote.

Water use: Sacramento-San Joaquin Delta watershed: report.

Existing law requires the Department of Water Resources to prepare and update, every 5 years, the California Water Plan, which is a plan for the conservation, development, and use of the water resources of the state. Existing law declares that the policy of the state is to reduce reliance on the Sacramento-San Joaquin Delta in meeting the state's future water supply needs through a specified statewide strategy. Existing law requires each region that depends on water from the Delta watershed to improve its regional self-reliance for water by taking specified actions. The department exports water from the Delta watershed in connection with its operation of the State Water Project. This bill would require the department, in preparing and updating the California Water Plan, to include a report on progress toward meeting the goals described above.

This measure would commend the Girl Scouts for 98 years of service and for inspiring millions of girls with the highest ideals of confidence, courage, and character.

Veterans: substance abuse and mental health services.

Existing law provides benefits for state military veterans. This bill would require the Department of Veterans Affairs to consult with the State Department of Mental Health and the State Department of Alcohol and Drug Programs, as provided, to identify federal funds that are available for the purposes of funding community-based organizations, certified by the department, to provide substance abuse and mental health services to veterans, as specified, and to pay reasonable administrative expenses. This bill would also require the department to develop a process by which to certify community-based organizations that receive funding, and require the department to establish criteria of success for the purpose of determining renewal of funding to those community-based organizations. The bill would, in counties in which there are no community-based organizations that serve veterans, permit a county to apply for a grant to be used for purposes related to the funding and provision of substance abuse and mental health services to veterans.

Local government: bankruptcy proceedings.

Under existing law, any taxing agency or instrumentality of the state may file a petition and prosecute to completion bankruptcy proceedings permitted under the laws of the United States. This bill would provide that a local public entity may only file under federal bankruptcy law with the approval of the California Debt and Investment Advisory Commission, except as specified. The bill would also provide an alternative procedure for a local entity to file under federal bankruptcy law by submitting specific analyses regarding its financial position to the State Auditor who would be required to audit the analyses and financial position of the local entity. The bill would make the local public entity responsible for the costs of the audit, as specified. The public entity would be authorized to file a petition under federal bankruptcy law after the State Auditor has notified the public entity of completion of its audit work and made public the findings of that audit.

Taxation: Oil Industry Fair Share Act.

Existing law imposes various taxes, including taxes on the privilege of engaging in certain activities. The Fee Collection Procedures Law, the violation of which is a crime, provides procedures for the collection of certain fees and surcharges. This bill would impose a tax on and after January 1, 2010, upon any producer for the privilege of severing oil from the earth or water in this state for sale, transport, consumption, storage, profit, or use, as provided, at the rate of 10% of the gross value of each barrel of oil severed. The tax would be administered by the State Board of Equalization and would be collected pursuant to the procedures set forth in the Fee Collection Procedures Law. The bill would require the board to deposit all revenues, less refunds, collected pursuant to these provisions into the General Fund. Because this bill would expand the scope of the Fee Collection Procedures Law, the violation of which is a crime, it would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. This bill would result in a change in state taxes for the purpose of increasing state revenues within the meaning of Section 3 of Article XIIIA of the California Constitution, and thus would require for passage the approval of 23 of the membership of each house of the Legislature. This bill would take effect immediately as a tax levy.
