Relative to Leyte Landing Commemoration Day.

This measure would designate October 20, 2013, and each 20th day of October thereafter, as Leyte Landing Commemoration Day in recognition of the significance of the Leyte landing in liberating the Philippines from Japanese occupation, helping to establish the independence of the Philippines, and fostering closer ties between the Philippines and the United States.

Protective and restraining orders: computer database system.

Existing law authorizes a judicial officer in a civil proceeding relating to domestic violence to issue an emergency protective order if there is an immediate and present danger of domestic violence, abuse, or abduction of a child, or abuse of an elder or dependent adult. Existing law also authorizes a court in a criminal proceeding to issue an emergency protective order if there is an immediate and present danger of stalking, as specified. Existing law requires a law enforcement officer, as defined, for purposes of court proceedings relating to domestic violence, or a peace officer, in criminal proceedings relating to stalking, who requests an emergency protective order, to carry copies of the order while on duty. Existing law also requires the Department of Justice to maintain a computer database system for protective and restraining orders and injunctions and make that information available to court clerks and law enforcement personnel. This bill would delete the requirement that a law enforcement officer or a peace officer, as described above, who requests an emergency protective order carry copies of the order while on duty. The bill would instead require the law enforcement agency to have that order entered into the computer database system for protective and restraining orders maintained by the Department of Justice. By imposing additional duties on local law enforcement agencies, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

Pupils: juvenile court schools.

Existing law requires county boards of education to provide for the administration and operation of public schools in juvenile homes, juvenile halls, day centers, juvenile ranches, juvenile camps, regional youth educational facilities, Orange County youth correctional centers, or in any group home housing 25 or more children, as specified. These public schools are known under existing law as juvenile court schools. Existing law requires that juvenile court schools be conducted in a manner prescribed by the county board of education to best accomplish the purposes set forth in existing law. This bill would authorize the county board of education to adopt and enforce a course of study that enhances instruction in mathematics and English language arts for pupils attending juvenile court schools, as determined by statewide assessment or objective local evaluations and assessments as approved by the county superintendent of schools. The bill would require an adopted enhanced course of study to meet specified standards, as appropriate, and be tailored to meet the needs of the individual pupil to increase the pupil's academic literacy and reading fluency.

Elections: voter signature.

Existing law authorizes certain persons to use a signature stamp to affix a signature to various elections documents. Existing law prohibits a voter from using a signature stamp until the signature stamp is used by the voter to sign an affidavit of registration in the presence of a county elections official. Existing law requires the Department of Motor Vehicles and the Secretary of State to develop a process and infrastructure to allow the electronic copy of a person's signature and other information to be transferred to the Secretary of State for the purpose of allowing a person to register to vote electronically on the Secretary of State's Internet Web site. This bill would additionally authorize certain registered voters to use a signature stamp if the voter submits an affidavit of registration electronically utilizing a signature stamp that has been approved by the Department of Motor Vehicles and transmitted to the Secretary of State.

Pupil instruction: financial literacy.

Existing law requires a school district, as part of its adopted course of study for grades 7 to 12, inclusive, to offer courses in specified areas of study, including, among others, social sciences, drawing upon the disciplines of anthropology, economics, geography, history, political science, psychology, and sociology. Existing law requires the State Board of Education, after January 1, 2003, and concurrently with, but not prior to, the next revision of textbooks or curriculum frameworks in the social sciences, health, and mathematics curricula, to ensure that these academic areas integrate components of human growth, human development, and human contribution to society, across the life course, and also financial preparedness. This bill would require the state board to integrate financial literacy, including, but not limited to, budgeting and managing credit, student loans, consumer debt, and identity theft security with those specified academic areas. The bill would also make conforming and nonsubstantive changes.

Financial institutions: Iran sanctions.

Existing law generally provides for the regulation and licensure of financial institutions, including, but not limited to, banks and credit unions, by the Department of Business Oversight and the Commissioner of Business Oversight, as specified. The federal Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 imposes federal sanctions against the Government of Iran, as specified, and, among other duties, requires the Secretary of the Treasury to prescribe regulations to prohibit, or impose strict conditions on, the opening or maintaining in the United States of a correspondent account or a payable-through account by a foreign financial institution that the Secretary of the Treasury finds knowingly engages in certain activities related to the Government of Iran, subject to specified penalties. The federal act also requires the Secretary of the Treasury to prescribe regulations to require a domestic financial institution maintaining a correspondent account or payable-through account in the United States for a foreign financial institution to perform an audit of prohibited activities that may be carried out by the foreign financial institution, report to the Department of the Treasury with respect to transactions or other financial services provided with respect to a prohibited activity, certify that the foreign financial institution is not knowingly engaging in any prohibited activity, to the best of its knowledge, and establish due diligence policies, procedures, and controls reasonably designed to detect whether the Secretary of the Treasury has found the foreign financial institution to knowingly engage in any prohibited activity. This bill would require the commissioner, when conducting specified examinations, to examine whether a licensee that maintains a correspondent account or payable-through account, as defined, is in compliance with the federal Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010, associated federal regulations, and any related presidential executive orders. The bill also authorizes the commissioner to bring an action for a violation of the act, as specified, and requires the commissioner to forward evidence of the violation to the United States Department of the Treasury. This bill would become inoperative when certain conditions are met.

Relative to Dropout Recovery Week.

This measure would declare the week of August 4, 2013, to August 10, 2013, inclusive, to be Dropout Recovery Week, and would state the Legislature's intent to encourage the support of dropout recovery high schools with creative teaching strategies, alternative assessments, and adequate resources.

Relative to Swimmable California Day.

This measure would proclaim July 25, 2013, as Swimmable California Day to recognize Californians' rights to clean and safe waters for swimming and other appropriate activities, and to encourage Californians to enjoy and use their waters.

Relative to Korean War Armistice Day.

This measure would proclaim July 27, 2013, as Korean War Armistice Day. It would urge Californians to observe the anniversary and call upon them to honor and give thanks to Korean War veterans. It would also urge Governor Jerry Brown to proclaim July 27, 2013, as Korean War Armistice Day and instruct all state departments, agencies, interest groups, organizations, and individuals to fly the United States flag at half-mast on July 27, 2013, in memory of veterans from this state who died as a result of their service in Korea.
