Relative to César Chávez.

This measure would call upon all Californians to observe César Chávez's birthday, March 31, as a day of public service, to recognize the hard work and self-sacrifice that farmworkers go through to feed all the families in our state, and to learn from César Chávez's life and his mission of nonviolence, social justice, and selfless service to others.

Medical licenses.

Existing law, the Medical Practice Act, provides for the licensure and regulation of medical practitioners by the Medical Board of California in the Department of Consumer Affairs. The board may determine that an applicant for a physician and surgeon's certificate has satisfied specified requirements if, among other things, he or she has not been the subject of a disciplinary action by a medical licensing authority. A "medical licensing authority," for purposes of the act, is defined as an officer, board, commission, or department of another state upon whose certificate a reciprocity certificate may be issued. This bill would make a technical, nonsubstantive change to those provisions.

Obscene matter.

Existing law generally makes it a crime for anyone who knowingly sends or causes to be sent, or brings or causes to be brought, into this state for sale or distribution, or in this state possesses, prepares, publishes, produces, develops, duplicates, with intent to distribute or to exhibit to, or to exchange with, others, or who offers to distribute, distributes, or exhibits to, or exchanges with, others, any obscene matter, knowing that the matter depicts a person under the age of 18 years personally engaging in or personally simulating sexual conduct. This bill would make a technical, nonsubstantive change to those provisions.

Economic development: taxation: credits: certifications.

The Personal Income Tax Law and the Corporation Tax Law authorize various credits against the taxes imposed by those laws, including a hiring credit for qualified taxpayers who hire qualified employees, as defined, within enterprise zones and local agency military base recovery areas, subject to specified criteria and requirements. Those laws require that a taxpayer obtain a certification from the Employment Development Department, as permitted by federal law, the local county or city Job Training Partnership Act administrative entity, the local county GAIN office or social services agency, or the local government administering a specified area or zone that provides that a qualified employee meets the specified eligibility requirements. Existing law authorizes any local entity formerly authorized to issue a certification that provides that a qualified employee, qualified disadvantaged individual, or qualified displaced employee meets specified eligibility requirements, to continue to accept applications for certification and to issue the certifications up to but no later than January 1, 2015. This bill would instead authorize those local entities to continue to accept applications for the certification up to but no later than January 1, 2015, and would provide that a local entity has until January 1, 2016, to issue the certifications. This bill would declare that it is to take effect immediately as an urgency statute.

Existing law, known as the Safe Place to Learn Act, declares that it is the policy of the State of California to ensure that all local educational agencies continue to work to reduce discrimination, harassment, violence, intimidation, and bullying. This bill would make a nonsubstantive change in this provision.

Small Business Technical Assistance Act of 2014.

The Economic Revitalization Act establishes the Governor's Office of Business and Economic Development, also known as "GO-Biz," to serve the Governor as the lead entity for economic strategy and the marketing of California on issues relating to business development, private sector investment, and economic growth. Bergeson-Peace Infrastructure and Economic Development Bank Act establishes the California Infrastructure and Economic Development Bank within GO-Biz to, among other things, assist in the promotion of economic development throughout the state. This bill would enact the Small Business Technical Assistance Act of 2014, within the bank under the direction of GO-Biz to, among other things, serve as the lead state entity for overseeing the state's participation with the federal California Small Business Development Center Program, the Women's Business Center program, the Veteran Business Outreach Center program, the Service Corps of Retired Executives (SCORE) , and the Procurement Technical Assistance Cooperative Agreement program. This act would also recognize those federal programs. This act would authorize GO-Biz or any other state entity to contract with a federal small business technical assistance center. This act would require the State Chair of the California Small Business Development Center Leadership Council, established under the federal program, or the contract lead for any of the other federal small business technical assistance centers, to report specific information to GO-Biz relating to any year that state funds are appropriated to support the California Small Business Development Center Program or any of the other federal small business technical assistance center programs, and would, in turn, require the director of GO-Biz or the contract lead for any of the other small business technical assistance centers to provide that report to the Legislature and post the report on the GO-Biz's Internet Web site. This bill would also require the state chair, as a condition of accepting state funds, to allow access to other information about those programs under certain conditions. This bill would make legislative findings and declarations in this regard.

Vehicles: misdemeanor violations: amnesty.

Existing law requires a county to establish a one-time amnesty program for fines and bail due on or before January 1, 2009, for certain infraction or misdemeanor violations of the Vehicle Code and Penal Code, between January 1, 2012, and June 30, 2012. Existing law authorizes the court and county, in addition to and at the same time as the above one-time amnesty program, to establish a one-time amnesty program for specified misdemeanor violations due on or before January 1, 2009, if certain conditions are met. Existing law allows a person owing a fine or bail that was eligible for amnesty under these programs to pay to the superior or juvenile court 50% of the total fine or bail, as defined, which is required to be accepted by the court in full satisfaction of the delinquent fine or bail. Existing law prohibits criminal action from being brought against a person for a delinquent fine or bail paid under the amnesty programs. This bill would revise these provisions to authorize a court or county, on or after January 1, 2016, and until December 31, 2016, and upon the agreement of both the court and the county, to implement similar amnesty programs for fines and bail due on or before January 1, 2012. The bill would require the amnesty programs to be conducted in accordance with guidelines provided by the Judicial Council.

Highways: exit information signs.

Existing law requires the Department of Transportation to adopt rules and regulations that allow the placement, near exits on freeways in rural areas, of information signs identifying specific roadside businesses or approved attractions. Existing law also requires the department to develop rules and regulations governing signs for approved attractions, as specified. This bill would make nonsubstantive changes to these provisions.

Space flight liability.

The Space Flight Liability and Immunity Act requires a space flight entity, as defined, to collect a signed warning statement from each participant in space flight activities. The warning statement is required to inform the participant that there is limited civil liability for bodily injury sustained as a result of the inherent risks associated with space flight activities. The act limits the liability of a space flight entity that complies with these provisions. The act also provides that limited liability under these provisions does not limit or prevent the liability of a space flight entity that commits an act of gross negligence or willful or wanton disregard for the safety of the participant, that intentionally causes a participant injury, or that has actual knowledge or reasonably should have known of a dangerous condition, as provided. This bill would include a manufacturer or supplier of components, services, or vehicles that have been reviewed by the United States Federal Aviation Administration as part of issuing a license, permit, or other authorization pursuant to specified provisions of federal law relating to commercial space launch activities as a space flight entity with limited liability for any participant injury. This bill would additionally provide that limited liability under these provisions does not limit or prevent the liability of a space flight entity that manufactures or supplies a product with a defect. This bill would prohibit a space flight entity's liability from being limited unless the space flight entity presents to and files with the Secretary of State a certification of insurance, as specified. This bill would repeal the Space Flight Liability and Immunity Act on July 1, 2021.

California State University: Antelope Valley campus.

Existing law establishes the California State University, under the administration of the Trustees of the California State University, as one of the segments of public postsecondary education in this state. The California State University currently comprises 23 institutions of higher education. This bill would authorize the Chancellor of the California State University to complete and submit to the trustees a study about the feasibility of a California State University satellite program, and ultimately, an independent California State University campus, in the Antelope Valley, as defined, within 18 months after the date that the trustees certify that sufficient funds are available to conduct the study. The bill would require funding for the study to be derived solely from nonstate sources. If the trustees decide that a new campus or off-campus center is needed in the Antelope Valley, the trustees would be authorized to conduct a formal study of the proposal, as provided.
