California Global Warming Solutions Act of 2006: Greenhouse Gas Reduction Fund: investment plan.

The California Global Warming Solutions Act of 2006 establishes the State Air Resources Board as the state agency responsible for monitoring and regulating sources emitting greenhouse gases. The act authorizes the state board to include the use of market-based compliance mechanisms. Existing law requires all moneys, except for fines and penalties, collected by the state board from the auction or sale of allowances as part of a market-based compliance mechanism to be deposited in the Greenhouse Gas Reduction Fund and to be available upon appropriation by the Legislature. Existing law requires the Department of Finance, in consultation with the state board and any other relevant state agency, to develop, as specified, a 3-year investment plan for the moneys deposited in the Greenhouse Gas Reduction Fund. Existing law requires the moneys from the fund to be used to facilitate the achievement of reductions of greenhouse gas emissions consistent with the act and, among other things, to maximize economic, environmental, and public health benefits to the state. This bill, beginning July 1, 2021, would require state agencies administering competitive grant programs that allocate moneys from the fund to give specified communities preferential points during grant application scoring for programs intended to improve air quality and to include a specified application timeline and to allow applicants from the Counties of Imperial and San Diego to include daytime population numbers in grant applications. This bill, for competitive grant programs that involve housing, urban forestry, urban greening, or planning and that allocate moneys from the fund after July 1, 2021, would require state agencies administering those moneys from the fund to develop at least 3 categories for applications based on the population and density of where the proposed project is to be located and to develop scoring criteria for each category, as specified. This bill would additionally require the moneys in the fund to be used to facilitate the achievement of reductions of greenhouse gas emissions consistent with the act and to increase water supply resilience; reduce or prevent increases in transportation, energy, or fuel costs, particularly in disadvantaged communities; accelerate the development and implementation of low-carbon technology; reduce vehicle miles traveled; promote zoning and development activities that increase public access to essential services or amenities; promote partnerships between multiple jurisdictions; promote climate change adaptation capacity; and improve community access to green space. This bill also would require the Department of Finance to include in an annual report to the Legislature specified information on the applications received for each grant program allocating moneys from the fund.

Relative to Family Justice Centers.

This measure would declare March 5, 2020, as Family Justice Center Day in California and would recognize the lifesaving and hope-giving work of the California Family Justice Center Network and its member Family Justice Centers as they work with rape crisis centers, domestic violence shelters, human trafficking agencies, prosecutors' offices, law enforcement agencies, and other professionals and community-based organizations to ensure that adult and child survivors of trauma can access all of their services in one setting.

Relative to California Arbor Day.

This measure would recognize March 7, 2020, as California Arbor Day, and would urge California residents to observe the day with appropriate tree-planting activities and programs.

Income taxes: credits: agricultural employees: overtime pay.

Existing law, the Phase-In Overtime for Agricultural Workers Act of 2016, creates a schedule that phases in overtime requirements for an agricultural employee, as specified, over the course of 7 years, from 2019 to 2025, inclusive, including a requirement, beginning January 1, 2019, for an employer that employs more than 25 employees, that an agricultural employee receive no less than one and 12 times that employee's regular rate of pay for all hours worked in excess of 9.5 hours in one day or in excess of 55 hours in one week. Beginning January 1, 2022, existing law applies that provision to an employer that employs 25 or fewer employees. Existing law authorizes the Governor to delay the implementation of these overtime pay provisions if the Governor suspends the implementation of a scheduled state minimum wage increase, as specified. The Personal Income Tax Law and the Corporation Tax Law allow various credits against the taxes imposed by those laws, including a credit in an amount measured by the amount of wages paid or incurred to prisoners employed in a specified program and a credit in an amount measured by the wages paid to certain employees within a designated census tract or economic development area. Existing law requires any bill authorizing a new tax expenditure to contain, among other things, specific goals, purposes, and objectives that the tax expenditure will achieve, detailed performance indicators, and data collection requirements. This bill would allow a credit against those taxes for each taxable year beginning on or after January 1, 2020, and before January 1, 2023, in an amount equal to the overtime wage premium paid or incurred by the taxpayer in the taxable year to an agricultural employee, as defined, in the taxable year pursuant to the specified provisions of the Phase-In Overtime for Agricultural Workers Act of 2016. The bill would also include additional information required for any bill authorizing a new tax expenditure. This bill would take effect immediately as a tax levy.

Vehicular air pollution: Clean Fleet Program.

Existing law establishes the Alternative and Renewable Fuel and Vehicle Technology Program, administered by the State Energy Resources Conservation and Development Commission. Existing law requires the commission under the Alternative and Renewable Fuel and Vehicle Technology Program to provide funding measures to certain entities to develop and deploy innovative technologies that transform California's fuel and vehicle types to help attain the state's climate change policies. Existing law requires the commission to give preference to those projects that maximize the goals of the program based on specified criteria and to fund specified eligible projects, including, among others, alternative and renewable fuel projects to develop and improve alternative and renewable low-carbon fuels, including renewable diesel. This bill would require the State Air Resources Board, by July 1, 2021, to adopt the Clean Fleet Program to reduce the emissions of greenhouse gases, to improve air quality, and to benefit low-income residents by providing certain incentives for the displacement of petroleum diesel with biofuels, as defined, The bill would require the state board to adopt guidelines for the program and to begin the implementation of the program on January 1, 2022. The bill would require the state board, on July 1, 2021, and every fiscal year thereafter, to set specific and measurable goals for the displacement of petroleum fuel with biofuels.

Rosa Parks Day in California: 20th Anniversary.

This measure would memorialize the achievements of Rosa Parks in the Civil Rights Movement and would commemorate the 20th Anniversary of Rosa Parks Day in California on February 4, 2020.

California Deserts Conservancy: establishment.

Existing law establishes in the Natural Resources Agency various conservancies authorized to acquire, hold, and manage, as specified, certain lands within particular geographic parts of the state in order to conserve, preserve, or protect lands within those areas for public benefit. This bill would establish the California Deserts Conservancy in the agency to undertake various conservation activities, as prescribed, related to the California deserts region, as defined, to protect, conserve, and restore that region's natural, cultural, archaeological, historical, and physical resources, among other functions. The bill would require the conservancy to be governed by a 13-member board of directors, as prescribed, with up to 3 additional nonvoting board members, as specified. The bill would authorize the conservancy to adopt guidelines setting priorities and criteria for projects and programs throughout the California deserts region, and authorize the conservancy to make grants and loans to local public agencies, nonprofit organizations, and tribal organizations in order to carry out the purposes of the bill's provisions. The bill would create the California Deserts Conservancy Fund within the State Treasury and make moneys in this fund available, upon appropriation by the Legislature, for the purposes of implementing the bill's provisions. This bill would make legislative findings and declarations relating to California deserts.
