Valley Fever Education, Early Diagnosis, and Treatment Act.

Existing law requires the State Department of Public Health to establish a list of reportable communicable and noncommunicable diseases and conditions and specify the timeliness requirements related to the reporting of each disease and condition. Existing law requires the department to develop information about various communicable diseases, including hepatitis C and meningococcal disease, and to make the information available to the public. Existing law also supports research into the development of a vaccine to protect against valley fever (coccidioidomycosis) . This bill would establish the Valley Fever Education, Early Diagnosis, and Treatment Act. This bill would, among other things, require the department to conduct a valley fever awareness campaign to communicate with local health jurisdictions, providers, and the public about valley fever, as described. The bill would authorize the department to award grants or enter into contracts to perform activities related to the awareness campaign, as specified. Those provisions would become inoperative on January 1, 2021.

Relative to the Tijuana River Valley.

This measure would urge the federal government and the United States Section of the International Boundary and Water Commission to take immediate action to adequately address cross-border pollution in the Tijuana River Valley.

This measure would express the support of the Legislature for the 23 Asilomar AI Principles as guiding values for the development of artificial intelligence and of related public policy.

Real estate transfer fees: prohibition.

Existing law allows various fees to be included in the price of a residential real estate transfer. Existing law defines a "transfer fee" with respect to real property as a fee payment requirement imposed in any covenant, restriction, or condition contained in any deed, contract, security instrument, or other document affecting the transfer or sale of real property that requires a fee be paid upon transfer of the real property, with specified exceptions. This bill, on or after January 1, 2019, would prohibit the creation of a transfer fee, other than excepted transfer fee covenants, as defined. The bill would provide that any transfer fee created in violation of this prohibition is void as against public policy. Existing law, when a transfer fee is imposed upon real property on or after January 1, 2008, requires the person or entity imposing the transfer fee, as a condition of payment of the fee, to record a separate document meeting specified requirements. Existing law requires that document to contain, among other things, for private transfer fees created on or after February 8, 2011, absent a specified exception, a notice in at least 14-point boldface type disclosing certain information, including that federal housing agencies are prohibited from dealing in mortgages on properties encumbered by private transfer fee covenants that do not provide a direct benefit to real property encumbered, and that if a person purchases such a property that person may have difficulty obtaining financing. This bill would provide that excepted transfer fee covenants are not required to comply with the notice described above.

Relative to Epilepsy Awareness Month.

This measure would proclaim November 2018 as Epilepsy Awareness Month and call for a recommitment to increasing awareness and understanding of those living with epilepsy.

Transportation network companies: disclosure of participating driver information.

(1) The Passenger Charter-party Carriers' Act defines a transportation network company as an organization, whether a corporation, partnership, sole proprietor, or other form, operating in California that provides prearranged transportation services for compensation using an online-enabled platform to connect passengers with drivers using their personal vehicles. Existing law requires a transportation network company, among other things, to conduct, or have a 3rd party conduct, a local and national criminal background check for each participating driver, as specified, and prohibits a transportation network company from contracting with, employing, or retaining a driver if he or she, among other things, is currently registered on the United States Department of Justice National Sex Offender Public Web site, has been convicted of any of certain terrorism-related felonies or a violent felony, or, within the previous 7 years, has been convicted of misdemeanor assault or battery, any domestic violence offense, driving under the influence of alcohol or drugs, or any of a specified list of felonies. A violation of the act is a crime. The bill would additionally require a transportation network company to provide information about the transportation network company driver to the passenger on its online-enabled application or platform at the time that the passenger is matched to that driver, including the transportation network company driver's first name and a picture of the driver, an image of the make and model of the driver's vehicle, and the license plate number of the vehicle. (2) Because a violation of the act is a crime and this bill would expand the scope of the act, this bill would impose a state-mandated local program. (3) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Relative to pet fire safety.

This measure would urge pet owners in the state to take specified actions to prevent harm to pets caused by fire, prepare for fire emergencies at home, and take precautions to ensure the safe location, rescue, care, and medical treatment of all pets in the event of a wildfire in or around a pet owner's home.

Relative to California's Sikh American Awareness and Appreciation Month.

This measure would designate the month of November 2018 to be California's Sikh American Awareness and Appreciation Month. This measure would recognize and acknowledge the significant contributions made by Californians of Sikh heritage to our state and seeks to afford all Californians the opportunity to better understand, recognize, and appreciate the rich history and shared principles of Sikh Americans. This measure would condemn all hate crimes and bias incidents against Sikh Americans and encourage all Sikhs to practice their faith freely and fearlessly.

Relative to Social Security.

This measure would request the Congress of the United States to enact, and the President to sign, legislation that would repeal the Government Pension Offset and the Windfall Elimination Provision from the Social Security Act.
