Elections: voter registration information: security: campaign literature and communications.

Existing law makes an affidavit of voter registration confidential, and prohibits the use of an affidavit for a personal, private, or commercial purpose, except as specified. Existing law requires that an affidavit of voter registration with respect to a voter be provided to a candidate for federal, state, or local office, to a committee for or against an initiative or referendum measure for which publication is made, and to a person for election, scholarly, journalistic, or political purposes, or for governmental purposes, as determined by the Secretary of State. Existing law requires the release of the home address or signature of a voter whenever the person's vote is challenged, as specified. This bill would require the Secretary of State to adopt regulations describing best practices for storage and security of voter registration information received by an applicant. The bill would require a person or entity who has received voter registration information pursuant to an application to disclose a breach in the security of the storage of the information to the Secretary of State, as specified. Existing law makes it a misdemeanor for a person to knowingly cause to be mailed or distributed, or knowingly mail or distribute, literature to a voter that includes a designation of the voter's precinct polling place other than the precinct polling place listed for that voter in an official precinct polling list. This bill would make it a misdemeanor for a person, with actual knowledge and intent to deceive, to cause to be distributed or to distribute literature or any other form of communication to a voter that the person knows to include voting information that is incorrect, false, or misleading, as specified. This bill would specify that distribution for this purposes includes distribution by mail, radio or television broadcast, telephone call, text message, email, or any other electronic means, including over the Internet. By creating a new crime, this bill would create a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. This bill would declare that it is to take effect immediately as an urgency statute.

Cannabis: Cannabis Control Appeals Panel.

(1) The Control, Regulate and Tax Adult Use of Marijuana Act of 2016 (AUMA) , an initiative measure approved as Proposition 64 at the November 8, 2016, statewide general election, authorizes a person who obtains a state license under AUMA to engage in commercial adult-use cannabis activity pursuant to that license and applicable local ordinances. The Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA) , among other things, consolidates the licensure and regulation of commercial medicinal and adult-use cannabis activities. MAUCRSA establishes in state government a Cannabis Control Appeals Panel to review specified decisions of licensing authorities appealed by any person aggrieved by those decisions. MAUCRSA requires that the panel consist of one member appointed by the Senate Committee on Rules, one member appointed by the Speaker of the Assembly, and 3 members appointed by the Governor, as specified. MAUCRSA authorizes the Governor to remove from office a member of the panel appointed by the Governor. MAUCRSA authorizes the Legislature to remove any member of the panel from office for certain reasons. This bill would eliminate the Legislature's power to remove a member of the panel for certain reasons and would provide that the members of the panel may be removed from office by their appointing authority. (2) AUMA authorizes legislative amendment of its provisions with a 23 vote of both houses, without submission to the voters, to further its purposes and intent. This bill would declare that its provisions further the purposes and intent of AUMA. (3) This bill would declare that it is to take effect immediately as an urgency statute.

Relative to World Oceans Day.

This measure would recognize June 8 as World Oceans Day, and would declare that the Legislature intends to act decisively in 2018 in regard to passing legislation aimed at reducing plastic pollution in California rivers, beaches, and ocean, and would further declare that the State of California is determined to seek additional ways to curb plastic pollution on those waterways and beaches, and in other natural spaces and communities.

Relative to special education funding.

This measure would respectfully memorialize the Congress and the President of the United States to enact H.R. 2902 pending before Congress that would fully fund the federal Individuals with Disabilities Education Act.

Relative to Philippine Independence Day.

This measure would recognize June 12, 2018, as the 120th Anniversary of Philippine Independence and would call upon the people of the state to observe the month of June with appropriate ceremonies, programs, and activities.

Firearms: retired peace officers.

Existing law defines "honorably retired" for purposes of certain exceptions to the law involving the carrying of firearms by a retired peace officer. The existing Safety For All Act of 2016, approved as an initiative statute at the November 8, 2016, statewide general election, makes it a crime for a person, commencing July 1, 2017, to possess a large-capacity magazine. Proposition 63 exempts from that prohibition the possession of a large-capacity magazine by honorably retired sworn peace officers. The existing act authorizes the Legislature to amend its provisions by statute approved by a 55% vote of each house if the amendments are consistent with, and further the intent of, the initiative statute. This bill would amend that act by redefining the definition of "honorably retired" to include a retired reserve officer who has met specified length of service requirements.

Relative to federal Temporary Protected Status.

This measure would condemn the decision to end the Temporary Protected Status designation for El Salvador, Haiti, Nicaragua, Honduras, and Sudan. The measure would also urge the United States Congress to enact a bipartisan permanent solution for Salvadorans, Haitians, Nicaraguans, Hondurans, and Sudanese with Temporary Protected Status.
