This measure would honor the late Reverend Dr. Martin Luther King, Jr. and commemorate Dr. Martin Luther King, Jr. Day.
This measure would designate the month of January 2018 as Gang Awareness and Prevention Month in the State of California and would encourage cities and constituents across the state to observe the month with appropriate programs, ceremonies, and activities to prevent future gang activity and honor those who lost their lives due to gang activity.
Existing law establishes the Commission on Teacher Credentialing and authorizes the commission to issue teaching credentials and services credentials, as provided. Existing law further establishes the periods for which a credential is valid. This bill would make nonsubstantive changes to the latter provision.
Existing federal law, the Indian Gaming Regulatory Act of 1988, provides for the negotiation and execution of tribal-state gaming compacts for the purpose of authorizing certain types of gaming on Indian lands within a state. The California Constitution authorizes the Governor to negotiate and conclude compacts, subject to ratification by the Legislature. Existing law ratifies a number of tribal-state gaming compacts between the State of California and specified Indian tribes. Existing law creates in the State Treasury the Indian Gaming Special Distribution Fund for the receipt and deposit of moneys received by the state from Indian tribes pursuant to the terms of gaming compacts entered into with the state. Existing law authorizes moneys in that fund to be used for certain purposes, including compensation for regulatory costs incurred in connection with implementing and administering tribal-state gaming compacts. This bill would make technical, nonsubstantive changes to these provisions.
Existing law requires the State Air Resources Board, no later than January 1, 2018, to approve and begin implementing a comprehensive strategy to reduce emissions of short-lived climate pollutants in the state to achieve a reduction in methane by 40%, hydrofluorocarbon gases by 40%, and anthropogenic black carbon by 50% below 2013 levels by 2030, as specified. Existing law requires the state board, in consultation with the Department of Food and Agriculture, to adopt regulations to reduce methane emissions from livestock manure management operations and dairy manure management operations consistent with the strategy, as specified. This bill would make technical, nonsubstantive changes to those provisions.
Existing law requires that all vote by mail ballots cast be received by the elections official from whom they were obtained or by the precinct board no later than the close of the polls on election day or no later than 8 p.m. on election day, as specified. Notwithstanding this requirement, existing law provides that a vote by mail ballot is considered timely cast if it is received by the voter's election official via the United States Postal Service or a bona fide private mail delivery company, as defined, no later than 3 days after election day if a specified requirement is met. This bill would additionally require that a ballot delivered to the elections official by a bona fide private mail delivery company include documentation that the company received the ballot on or before election day.
Existing law, the Sustainable Groundwater Management Act, requires all groundwater basins designated as high- or medium-priority basins by the Department of Water Resources that are designated as basins subject to critical conditions of overdraft to be managed under a groundwater sustainability plan or coordinated groundwater sustainability plans by January 31, 2020, and requires all other groundwater basins designated as high- or medium-priority basins to be managed under a groundwater sustainability plan or coordinated groundwater sustainability plans by January 31, 2022, except as specified. This bill would state the intent of the Legislature to enact statutory changes relating to the Sustainable Groundwater Management Act.
Existing law makes it unlawful for any person other than a licensee of the Department of Alcoholic Beverage Control to sell, manufacture, or import alcoholic beverages in this state. This bill would provide that a license or permit is not needed for an art gallery to provide wine and beer to patrons, for consumption on the gallery premises, subject to specified conditions, including that the price of the wine and beer is not included in the sales price of any piece of art or merchandise sold by the gallery.
Existing law establishes the Military Department, which includes, among others, the California National Guard. Existing law provides certain protections for members of the California National Guard called to active duty, including eviction or distress protections and tax deferments. This bill would require the department, upon an appropriation of funds by the Legislature, to assume sole financial liability for any required payment to the federal government of an enlistment bonus, student loan repayment, or any other incentive payments improperly authorized by the California National Guard between January 1, 2006, and December 31, 2010, including any interest charges or other associated fees. The bill would also require the department upon an appropriation of funds by the Legislature, to repay to any member of the California National Guard who has repaid to the federal government any of these improperly authorized payments the amount the member has repaid, including any interest charges or other associated fees. The bill would specify that these provision become operative only if the federal government does not enact specified legislation on or before August 1, 2017, and the department posts a notice to that effect on its Internet Web site.
