Community colleges: ethnic studies.

Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. The segment comprises 73 community college districts and a total of 116 campuses throughout the state. This bill would, commencing with the 2022–23 academic year, require each community college district to offer courses in ethnic studies at each of its campuses. The bill would require that the units earned by students for successful completion of these courses would be eligible for transfer and, if applicable, would meet the ethnic studies general education graduation requirements at the California State University. The bill would also, commencing with the 2024–25 academic year, require each community college district to require the completion of at least one course in ethnic studies of at least 3 units as a requirement for a student to obtain an associate degree. The bill would require the Chancellor of the California Community Colleges to develop and adopt appropriate regulations for the implementation of these provisions, and to develop and implement a plan to streamline the course and curriculum approval process, including an expedited state approval process and a process that enables ethnic studies courses to be portable among community college districts. This bill would require the Legislative Analyst's Office to conduct a study on the number of ethnic studies courses the California State University accepted from the community college districts to satisfy the ethnic studies graduation requirements established in existing law. The bill would require the California State University to provide specified information to the Legislative Analyst's Office on or before January 1, 2023, and would require the Legislative Analyst's Office to submit a report to the education and fiscal policy committees of the Legislature with findings and recommendations on or before April 30, 2023. Because this bill would impose new duties on community college districts, it would constitute a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

Santa Clara Valley Water District: contracts: best value procurement.

Existing law authorizes certain local entities to select a bidder for a contract on the basis of "best value," as defined. Existing law governs various types of contract procedures applicable to the Santa Clara Valley Water District and prescribes competitive bidding procedures for any improvement or unit of work over $50,000. This bill would authorize the district, upon approval by the board of directors of the district, to award contracts on a best value basis for any work of the Anderson Dam project, defined to include prescribed activities and works of construction with regard to the Leroy Anderson Dam and Reservoir and certain fish and aquatic habitat measures described in a federal-state settlement agreement. The bill would require the district, if the board elects to award contracts on a best value basis, to comply with specified requirements governing the documents prepared, setting forth the scope and estimated price of the project and the request for qualifications, with bids evaluated using only the criteria and selection procedures identified in the procurement process documents. The bill would prohibit an Anderson Dam project contractor from being prequalified, shortlisted, or awarded a contract unless the contractor provides an enforceable commitment to the district that the contractor and its subcontractors at every tier will use a skilled and trained workforce to perform all work on the project, in accordance with certain criteria. By requiring certain information of bidders to be certified under penalty of perjury, the bill would expand an existing crime, thereby imposing a state-mandated local program. This bill would make legislative findings and declarations as to the necessity of a special statute for the Santa Clara Valley Water District. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Relative to Food Allergy Awareness Week.

This measure would declare the week of May 10 to May 16, 2021, inclusive, as Food Allergy Awareness Week and request that the Governor issue a proclamation to observe the week with appropriate understanding and awareness of food allergies and anaphylaxis.

Relative to Cystinuria Awareness Day.

This measure would recognize and proclaim June 24, 2021, as Cystinuria Awareness Day to promote awareness of Cystinuria and to show support for California medical research centers that take an active role in the fight against the disease.

Relative to California Holocaust Memorial Day.

This bill would proclaim the week of April 18, 2021, to April 24, 2021, inclusive, as Adult Education Week, and would honor the teachers, administrators, classified staff, and students of adult education programs statewide for their efforts, persistence, and accomplishments.
