Oil and gas leases: state waters.

Existing law authorizes the State Lands Commission to enter into a lease for the extraction of oil or gas from state-owned tide and submerged lands in the California Coastal Sanctuary if the commission determines that those oil and gas deposits are being drained by means of producing wells upon adjacent federal lands and if the lease is in the best interests of the state. This bill would create, until July 1, 2011, the Interim Resources Management Board, consisting of the Secretary of the Natural Resources Agency, the Secretary for Environmental Protection, and the Controller. The bill would authorize the board to consider a lease application for the extraction of oil or gas offshore in state waters. The bill would authorize the board to approve that lease if specified terms and conditions are met. The bill would set forth related declarations and findings.

Nursing: continuing education.

Existing law, the Nursing Practice Act, provides for the licensure and regulation of registered nurses by the Board of Registered Nursing and makes a violation of the act a crime. Existing law requires a licensee renewing his or her license to submit proof to the board that during a specified time the licensee has been informed of developments in the registered nursing field either by pursuing a continuing education course offered by a provider approved by the board or by other means deemed equivalent by the board. Existing law requires the board to establish, by regulation, standards for continuing education. Existing law requires these standards to make a variety of alternative forms of continuing education available to licensees. Existing law requires the content of all courses of continuing education to be relevant to the practice of nursing. This bill would provide that continuing education courses, as specified, that advance or promote labor organizing on behalf of a union, or that advance or promote statutory or regulatory changes, political candidates, political advocacy, or political strategy shall not be considered content relevant to the practice of nursing and shall not be acceptable for meeting requirements for licensure renewal. The bill would also prohibit an approved provider from representing that such a continuing education course is acceptable for meeting requirements for licensure renewal and would require the board, subject to specified procedural requirements, to withdraw its approval of a provider that violates that requirement for no less than 5 years, as specified. Because a violation of these requirements by a provider would constitute a crime, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. This bill would declare that it is to take effect immediately as an urgency statute.

Short line railroads.

Existing law provides for various transportation planning activities by the Department of Transportation and other agencies. Existing law provides funding for projects to enhance goods movement and for projects to rehabilitate short line railroads. This bill would require the Business, Transportation and Housing Agency to prepare a 5-year Short Line Commercial Rail Haul Connectivity Plan for the state, the focus of which would be to identify, with a statewide emphasis, opportunities for short line commercial rail system improvements and linkages. The plan would be required to include desirable linkages and feeder opportunities between short line commercial rail services, and to identify the coordination in planning and the capital investments necessary in that regard. The plan would also be required to identify future right-of-way needs of short line commercial rail lines in connection with state and local highway system improvements in order to accommodate future rail system improvements. The plan would be developed in consultation with the agencies and entities responsible for the various rail and highway systems. The plan would initially be submitted to the California Transportation Commission for approval on September 1, 2012, and every 5 years thereafter. Upon approval of the plan, the commission, for each commercial rail project to improve the movement of goods that is subject to commission approval and implicated by the plan, would be required to make a determination that the project is consistent with the plan. The bill would also provide that the commission, for good cause, may approve a project that is not consistent with the plan, subject to a waiver granted by the Secretary of Business, Transportation and Housing.

Business licensing: Business Master License Center.

Under existing law, businesses are required to obtain various licenses from regulatory agencies. Existing law also requires state agencies to take specified actions, including, but not limited to, designating a small business liaison, to assist small businesses achieve compliance with statutory and regulatory requirements. This bill would create the Business Master License Center, which would have prescribed duties, including, but not limited to, developing and administering a computerized one-stop master license system capable of storing, retrieving, and exchanging license information, as well as issuing and renewing master licenses, as specified. The bill would permit the Governor to appoint a 3rd-party facilitator from the business community, to provide oversight over the creation of the center and the development of its master license system. This bill would charge license applicants, in addition to any other fees or deposits required to obtain a particular license, a master license administrative fee in specified amounts, to be deposited into the Master License Fund, which this bill would create. This bill would require that the moneys in the fund, upon appropriation by the Legislature, be used only to administer the Business Master License Center.

Employment: improving economic opportunities.

This measure would encourage state government to make the retention of private sector employment and the creation of new employment opportunities its highest priority, and it would declare the Legislature's leading role in restoring the business climate in the state to encourage economic growth.

Community colleges: agricultural career technical education.

Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. Existing law establishes community college districts, administered by a governing board, throughout the state, and authorizes these districts to provide instruction to students at the community college campuses maintained by the districts. Existing law creates within the State Department of Education an agricultural career technical education unit to assist school districts in the establishment and maintenance of agricultural career technical education programs. This bill would express the intent of the Legislature to enact legislation to develop and adopt uniform, objective, and high-quality criteria and standards for evaluating programs of instruction in agricultural career technical education within the California Community Colleges.

Guantanamo Bay: detention facility.

This bill would urge the President of the United States and the Congress to employ necessary measures to ensure that no terrorist or suspected terrorist detained at Guantanamo Bay, Cuba is permitted to enter California in custody or otherwise.

Relative to a Day of Remembrance.

This measure would declare February 19, 2010, as a Day of Remembrance in order to increase public awareness of the events surrounding the internment of Americans of Japanese ancestry during World War II.

Employment: apprentice training.

Existing law makes it the public policy of the state to promote apprenticeship as a form of on-the-job training when such training is cost effective. This bill would make nonsubstantive changes to this provision.
