Voter registration: California New Motor Voter Program.

Existing federal law, the National Voter Registration Act of 1993, requires a state to, among other things, establish procedures to register a person to vote for federal office by an application made simultaneously with a driver's license application. Existing state law requires, in conformance with federal law, that the Secretary of State and the Department of Motor Vehicles establish and implement the California New Motor Voter Program for the purpose of increasing opportunities for voter registration for qualified voters. Existing state law requires the Department of Motor Vehicles to transmit to the Secretary of State specified information related to the person's eligibility to vote, which the person provides when applying for a driver's license or identification card. Existing state law provides that this information transmitted to the Secretary of State constitutes a completed affidavit of registration, and the Secretary of State is required to register the person to vote, unless the person affirmatively declines to register to vote or the person is ineligible to vote, or other specified conditions exist. This bill would require a driver's license or identification card application, renewal, or change of address notification, as specified, to include a voter registration application and would require the Department of Motor Vehicles to transmit the application to the Secretary of State according to specified deadlines. The bill would require the Department of Motor Vehicles to monitor the timeliness of its transmittals to the Secretary of State, and to provide the Secretary of State information regarding delays and irregularities in its ability to do so. The bill would require the Department of Motor Vehicles and the Secretary of State each to designate an employee to undertake specified responsibilities to ensure compliance with the California New Motor Voter Program and the National Voter Registration Act. The bill would require the Secretary of State to convene a task force that would provide advice and perform other duties with respect to implementing the California New Motor Voter Program. This bill would incorporate additional changes to Section 5100 of the Elections Code proposed by AB 446 to be operative only if this bill and AB 446 are enacted and this bill is enacted last.

Hearing aids: locked programming software: notice.

Existing law, the Speech-Language Pathologists and Audiologists and Hearing Aid Dispensers Licensure Act, provides for the licensure and regulation of speech-language pathologists, audiologists, and hearing aid dispensers by the Speech-Language Pathology and Audiology and Hearing Aid Dispensers Board, which is within the Department of Consumer Affairs. A violation of the act is a crime. Existing law requires a licensed hearing aid dispenser or a licensed audiologist, upon the consummation of the sale of a hearing aid, to deliver to the purchaser a written receipt containing specified information, including, among other things, the address and office hours at which the licensee is available for servicing of the hearing aid and the terms of any guarantee or written warranty. Existing law requires a licensed hearing aid dispenser or a licensed audiologist to maintain certain records, including a copy of the written receipt, for 7 years and to permit inspection by the board upon reasonable notice. This bill would refer to a licensed dispensing audiologist instead of a licensed audiologist in the above-described provisions. The bill would require a licensed hearing aid dispenser or a licensed dispensing audiologist, before the consummation of the sale of a hearing aid that uses proprietary programming software or locked, nonproprietary software, as those terms are defined, to provide the purchaser with a written notice in 12-point type or larger that contains specified language informing the purchaser that the hearing aid can only be serviced or programmed at specific facilities or locations. The bill would require the written notice to be signed by the purchaser before the sale and would require the licensed hearing aid dispenser or a licensed dispensing audiologist to maintain a copy of the notice in accordance with the record-keeping requirements described above. By expanding the scope of a crime, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Park districts: ordinances: nuisances: abatement.

Existing law prescribes procedures, including the election of a board of directors, for the formation of regional park districts, regional park and open-space districts, or regional open-space districts. Existing law authorizes 3 or more cities, together with any parcel or parcels of city or county territory, whether in the same or different counties, to organize and incorporate, but requires that all the territory in the proposed district be contiguous. Existing law requires the board of directors to superintend, control, and make available to all the inhabitants of the district all public recreation lands and facilities, as provided. Existing law requires the board of directors to act only by ordinance, resolution, or a motion duly recorded in the minutes of a meeting of the board. This bill would authorize the board of directors of a district, by ordinance, to declare that an encroachment onto district lands constitutes a nuisance. The bill would authorize a district that adopts such a nuisance ordinance to establish a nuisance abatement procedure, which would include notice and hearing requirements, and to collect abatement and related administrative costs and penalties, including through a nuisance abatement lien, as specified. The bill would authorize a county recorder to impose a fee on a district to reimburse the costs of processing and recording a nuisance abatement lien and providing notice. The bill would additionally authorize a district to initiate a civil action to abate a nuisance in the name of the district, as specified. Existing law provides that a violation of an ordinance, rule, or regulation adopted by the board of directors of a district is a misdemeanor punishable by a fine or imprisonment in the county jail, as provided. This bill would provide that the above provision does not apply to a violation of an ordinance adopted pursuant to the bill's provisions.

Forest resources: national forest lands: Good Neighbor Authority Fund: ecological restoration and fire resiliency projects.

Existing law establishes in the State Treasury the Good Neighbor Authority Fund, to be administered by the Department of Forestry and Fire Protection under the direction of the Secretary of the Natural Resources Agency. Existing law makes the moneys in the fund available for expenditure, upon appropriation by the Legislature, as authorized by specified federal law, and to the extent not in conflict with federal law or agreements, for state departments or agencies to undertake forest health and fuels reduction projects on federal lands executed through these agreements, and to fund costs associated with planning, implementing, and maintaining these projects, including administrative and operational costs. This bill would reorganize the law relating to the fund. The bill would require the Secretary of the Natural Resources Agency, under an agreement between the state and the federal government, to establish a program for purposes of conducting ecological restoration and fire resiliency projects on national forest lands, with priority given to forest restoration and fuels reduction projects that are landscape scale and are focused on ecological restoration and to community fire protection and protection of water and other infrastructure. The bill would require projects to be based on the best available science and emphasize the use of prescribed fire where appropriate. The bill would require projects with multiple benefits to be prioritized, as applicable and feasible. The bill would require projects to be designed, to the extent feasible, to prevent type conversion and the spread of invasive plants and grasses, provide for ecological restoration and fire resiliency projects appropriate to the landscape and vegetation being treated based upon the best available science, and provide ecologically appropriate treatment to native shrublands, as provided.

Driver's licenses: organ donation.

Existing law, the Uniform Anatomical Gift Act, authorizes the creation of a not-for-profit entity to be designated as the California Organ and Tissue Donor Registrar and requires that entity to establish and maintain the Donate Life California Organ and Tissue Donor Registry for persons who have identified themselves as organ and tissue donors upon their death. Existing law requires the Department of Motor Vehicles, upon issuance of a new driver's license or a renewal of a driver's license or the issuance of an identification card, to provide information on organ and tissue donation. Existing law requires an application for an original or renewal driver's license or identification card to contain a space for the applicant to enroll in the Donate Life California Organ and Tissue Donor Registry and requires the application to include specified check boxes for an applicant to indicate whether to add the applicant's name to the registry. Existing law requires the back of the application to include a specified disclosure statement informing the applicant that by marking 'Yes' in the check boxes the applicant is legally authorizing the recovery of organs and tissues in the event of their death. Existing law authorizes a person who applies for an original or renewal driver's license or identification card to designate a voluntary contribution of $2 for the purpose of promoting and supporting organ and tissue donation, as specified. This bill would revise and recast these requirements relating to providing for enrollment for organ or tissue donation through the process of obtaining a driver's license or identification card from the department, including deleting an outdated reporting requirement and making conforming changes to related provisions. The bill would instead require the department to enter into a memorandum of understanding (MOU) with the Donate Life California Organ and Tissue Donor Registry to mutually agree upon the language providing for enrollment in organ or tissue donation. The bill would authorize a person who applies for an original or renewal driver's license or identification card to designate a voluntary contribution of $2 or more, as specified.

This measure would proclaim November 3, 2021, as One Health Day, to celebrate and bring attention to the need for a One Health approach to address shared health threats at the human-animal-environmental interface.

Relative to blood cancer and blood donation awareness.

This measure would designate the month of September 2021 as Leukemia, Lymphoma, and Myeloma Awareness Month and Blood Cancer Awareness Month and the first week of September 2021 as Blood Donation Week.

Relative to the Harvey L. Hall Memorial Highway.

This measure would designate a specified portion of Westside Parkway on State Route 58 in the County of Kern as the Harvey L. Hall Memorial Highway. The measure would request that the Department of Transportation determine the costs of appropriate signs showing this special designation and, upon receiving donations from nonstate sources covering those costs, erect those signs.

Coastal and marine waters: Santa Catalina Island: dichloro-diphenyl-trichloroethane.

This measure would request that the Congress of the United States and the United States Environmental Protection Agency take all measures necessary to prevent further damage to California's citizens, wildlife, and natural resources by the dichloro-diphenyl-trichloroethane waste dumped in the waters near Santa Catalina Island.
