Existing law provides that a provision of a memorandum of understanding reached between the state employer and a recognized employee organization representing state civil service employees that requires the expenditure of funds does not become effective unless approved by the Legislature in the annual Budget Act. This bill would approve provisions of a memorandum of understanding entered into between the state employer and State Bargaining Unit 10, the California Association of Professional Scientists, that require the expenditure of funds, and would provide that these provisions will become effective even if these provisions are approved by the Legislature in legislation other than the annual Budget Act. The bill would provide that provisions of the memorandum of understanding approved by this bill that require the expenditure of funds will not take effect unless funds for those provisions are specifically appropriated by the Legislature, and would require the state employer and the affected employee organization to meet and confer to renegotiate the affected provisions if funds for those provisions are not specifically appropriated by the Legislature. This bill would declare that it is to take effect immediately as an urgency statute.

(1) The existing Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) prohibits any person, in the course of doing business, from knowingly and intentionally exposing any individual to a chemical known to the state to cause cancer or reproductive toxicity without giving a specified warning, or from discharging or releasing such a chemical into any source of drinking water, except as specified. Proposition 65 requires the Governor to publish a list of those chemicals on or before March 1, 1987, that includes, at a minimum, substances identified as hazardous for the purposes of occupational safety and health laws and to revise the list annually. This bill would specify that the substances included in the list that are identified as hazardous for purposes of the occupational safety and health laws may only be included if there is sufficient evidence that the referenced substance is known to cause cancer or reproductive toxicity. (2) Proposition 65 provides that it may be amended by a statute, passed in each house by a 23 vote, to further its purposes. This bill would find and declare that it furthers the purposes of Proposition 65.
This measure would designate that January 20, 2014, be observed as the official memorial of the late Dr. Martin Luther King, Jr.'s birth and commemorate Martin Luther King, Jr. Day and the work of Dr. Martin Luther King, Jr. and the Civil Rights Movement in changing public policy in California and in the United States of America. This measure would also recognize the anniversaries of the Emancipation Proclamation and the March on Washington in connection with the advancement of civil rights.
(1) The Alcoholic Beverage Control Act is administered by the Department of Alcoholic Beverage Control and requires the department to perform various duties relating to the issuance of alcoholic beverage licences. The Alcoholic Beverage Control Act requires specified applicants for on-sale or off-sale licensees to have a notice of the application published, as provided. This bill would exempt from that requirement applicants that are required to provide specified notices via mail of applications for licenses, including retail licenses, and transfer of licenses, as provided. (2) Existing law provides that protests against the issuance of a liquor license may be filed with the department. Existing law permits the Department of Alcoholic Beverage Control to reject protests, except protests made by a public agency, public official, or governing body of a city or county, it determines to be false, vexatious, or without reasonable or probable cause. This bill would require the department, by January 1, 2016, to promulgate regulations regarding responding to protests filed under these provisions. The bill would also require a protest submitted by a person other than an employee of the department or a public officer to be submitted by an individual and limit the protest to one signatory.
This measure would honor the California Council on Science and Technology for 25 years of service and unbiased advice to the State of California.
This measure would urge the Congress of the United States to enact President Barack Obama's budget proposal to increase funding for preschool and early learning. This measure would also urge the Superintendent of Public Instruction to prepare a plan for making California competitive for future increases in federal funding to preschool and early learning programs.
This measure would designate December 4, 2013, as Keeping Kids in School and Out of Court Day.
This measure would proclaim October 5, 2013, as California Firefighters Memorial Day.
This measure would recognize September 2013 as Hmong History Month, urge all citizens to join in celebrating the accomplishments of the Hmong people during Hmong History Month, and encourage the people of California to recognize the many talents, achievements, and contributions that the Hmong people make to their communities.
