This measure would proclaim June 11, 2014, and June 11 of each subsequent year, California LGBT Veterans Day, to be celebrated statewide.
This measure would declare the month of May 2014 as Foster Care Month.
The Alcoholic Beverage Control Act provides that any person under 21 years of age who purchases any alcoholic beverage, who consumes any alcoholic beverage in any on-sale premises, or who possesses any alcoholic beverage on any street or highway or in any public place or any place open to the public is guilty of a misdemeanor. The Alcoholic Beverage Control Act provides that every person who sells, furnishes, gives, or causes to be sold, furnished, or given away any alcoholic beverage to any person under 21 years of age is guilty of a misdemeanor. This bill would allow a qualified student to taste an alcoholic beverage and exempt the student and the qualified academic institution in which the student is enrolled from criminal prosecution under the above-described provisions, as provided. The bill would define the terms "qualified academic institution," "qualified student," and "taste" for the purposes of this provision.
(1) Existing law refers to mentally disordered persons, or mentally defective persons in provisions relating to, among other things, education, social services, and civil law. Existing law also refers to the insane in provisions relating to, among other things, family law and social services. This bill would revise these provisions to instead refer to persons with a mental health disorder or persons who lack legal capacity to make decisions, respectively. The bill would make related technical changes. (2) Under the California Public Records Act, except for exempt records, every state or local agency, upon request, is required to make records available to any person upon payment of fees to cover costs. Existing law specifies records that are exempt from the Public Records Act based on above provisions. The bill would make conforming changes to the Public Records Act based on the above provisions. (3) The Irrigation District Law provides for the formation of irrigation districts with prescribed powers, including the power to levy an annual assessment upon the land in the district and to obtain a collector's deed against the property if the assessment is not paid. Existing law requires an action proceeding, defense, answer, or cross-complaint based on the invalidity or irregularity of the collector's deed to begin within one year after the recordation of the deed, unless otherwise specified, including when the owner of the land was, at the time of sale, a minor or insane person in which case the statute of limitations begins to run when the disability is removed. This bill would make a technical change to clarify that the statute of limitations is tolled if the owner is a minor or lacks mental capacity.
The Personal Income Tax Law authorizes an individual to contribute amounts in excess of his or her tax liability for the support of specified funds, including, among others, the California Firefighters' Memorial Fund and the California Peace Officer Memorial Foundation Fund. Existing law provides for the repeal of the contribution provisions for these funds on January 1, 2016. This bill would instead repeal those provisions on January 1, 2021.
(1) Existing law exempts, until January 1, 2015, licensed carriers of livestock from certain limitations of access upon highways when those carriers are directly en route to or from a point of loading or unloading of livestock on specified portions of State Highway Route 101, if the travel is necessary and incidental to the shipment of the livestock, and certain conditions are met. This bill would extend the operation of that exemption until all specified route improvements are completed, and the Director of Transportation makes a determination that a certain combination of vehicles is authorized to operate on specified portions of State Highway Route 101. (2) Existing law requires the Director of Transportation to notify the Secretary of State if, prior to January 1, 2012, the director determines that the removal of certain trees is the only possible adjustment to State Highway Route 101 that would accommodate truck sizes allowed to travel on specified portions of State Highway Route 101 pursuant to the exemption described in (1) above, the notification of which would repeal that exemption. Existing law also requires the Director of Transportation to notify the Secretary of State if, prior to January 1, 2015, the director determines that safety improvements to specified portions of State Highway Route 101 have resulted in the reclassification of the entire segment as a terminal access route, as specified, the notification of which would repeal the exemption described in (1) above. This bill would extend the operation of those provisions to the date that all specified route improvements are completed, and the Director of Transportation makes a determination that a certain combination of vehicles is authorized to operate on specified portions of State Highway Route 101.
This measure would designate July 10, 2014, as Journeyman Linemen Recognition Day to honor and recognize the contribution of the countless journeyman linemen who often place themselves in harm's way to serve their communities.
This measure would proclaim June 12, 2014, as Women Veterans' Day and urge all citizens to join in celebrating the many contributions of women to our military forces.
This measure would declare the week of May 25, 2014, to May 31, 2014, inclusive, as Diffuse Intrinsic Pontine Glioma (DIPG) Awareness Week to honor those who work to make research and resources a reality for children suffering from DIPG and their families.
The Alcoholic Beverage Control Act permits the Department of Alcoholic Beverage Control to issue special temporary licenses and permits to various entities for limited purposes. The act permits the department to issue a certified farmers' market sales permit that authorizes a licensee under a winegrower's license, a member of the licensee's family, or an employee of the licensee to sell wine produced and bottled by the winegrower at certified farmers' market locations, under specified conditions. The act provides that a violation of its provisions is a misdemeanor, unless otherwise specified. This bill would specify that, pursuant to the certified farmers' market sales permit, the licensee may only sell wine that is produced entirely from grapes or other agricultural products grown by the winegrower and that is bottled by the winegrower. This bill would require the certified farmers' market sales permit to authorize the licensee, a member of the licensee's family, or an employee of the licensee to conduct an instructional tasting event on the subject of wine at a certified farmers' market, subject to certain conditions. By expanding the definition of an existing crime, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. This bill would declare that it is to take effect immediately as an urgency statute.
