Education funding: child development centers and preschools.

This measure would state the intent of the Legislature to increase the funding of child development centers and preschools in future years, as resources become available, in order to provide staff with adequate salaries and benefits, provide adequate resources to support program quality for children, and keep programs open to serve parents and children.

Relative to Disability History Week.

This measure would designate the 2nd week of October 2010, and annually thereafter, as Disability History Week, and would encourage public and private institutions of higher education, state and local agencies, nonprofit and community-based organizations, and private businesses and corporations to observe Disability History Week by dedicating appropriate classroom instructional time or by coordinating all-inclusive activities to be conducted during that week to afford opportunities for students and the general public to learn more about the disability community and to celebrate and honor its role in contemporary American society.

Relative to Spirit of '45 Day.

This measure would declare the Legislature's support for the observance of "Spirit of '45 Day" on the second Sunday in August to commemorate the anniversary of the end of World War II on August 14, 1945.

Commercially sexually exploited minors.

Existing law, until January 1, 2012, authorizes the District Attorney of Alameda County to create a pilot project, contingent upon local funding, for the purposes of developing a comprehensive, replicative, multidisciplinary model to address the needs and effective treatment of commercially sexually exploited minors, as specified. Existing law authorizes the District Attorney of Alameda County, as part of the pilot project, to develop protocols for identifying and assessing minors, upon arrest or detention by law enforcement, who may be victims of commercial sexual exploitation, and to develop a diversion program reflecting the best practices to address the needs and requirements of those minors. The district attorney is also authorized to develop, offer, and provide a training curriculum that would provide training for certain county employees on the commercial sexual exploitation of minors in Alameda County, as specified. This bill would authorize an identical pilot project for the County of Los Angeles. The bill would provide that if the county establishes this pilot project, the district attorney of the county would be required, contingent upon local funding, to submit a report to the Legislature summarizing the activities performed pursuant to the pilot project. These provisions would be in effect only until January 1, 2014.

Public employment: County of Alameda.

The County Employees Retirement Law of 1937 authorizes, until January 1, 2011, the board of supervisors of the Counties of Solano and Santa Barbara to, by resolution, ordinance, contract, or contract amendment, provide different retirement benefits for some safety member bargaining units within the safety member classification of a county retirement system, as specified. This bill would authorize the Board of Supervisors of the County of Alameda, by resolution adopted by majority vote as part of any negotiated memorandum of understanding with a bargaining unit that represents safety employees, to require a safety employee of that bargaining unit or unrepresented safety employee hired after approval of the resolution, to elect in writing a permanent choice between 2 specified pension calculations, as specified. The bill would also authorize the board to adopt a resolution by majority vote to provide a different formula or calculation of retirement benefits for new members of other safety bargaining units or other unrepresented safety employees hired after approval of the resolution, as specified, or to provide a different formula or calculation of safety retirement benefits for new safety members in one bargaining unit than that which is provided for new safety members of other bargaining units or new unrepresented safety members. The bill would also specify that the board shall not require that a bargaining unit be divided solely for the purpose of providing different retirement benefits. The bill would authorize the board to separately negotiate retirement benefits with a bargaining unit if the members of that bargaining unit so elect. This bill would declare that it is to take effect immediately as an urgency statute.

San Francisco Bay Area Rapid Transit District.

Existing law creates the San Francisco Bay Area Rapid Transit District (BART) , governed by an elected board of directors, with various duties and responsibilities relative to the operation of a rail transit system. Existing law authorizes the district to maintain a police department. This bill would authorize the BART board of directors to establish an office of independent police auditor that would report directly to the board and investigate complaints against district police personnel relative to on-duty misconduct and off-duty unlawful activity, as specified. If the board establishes an office of independent police auditor, the bill would require the board to organize, reorganize, and manage the office and would require the auditor to prepare reports of his or her activities.

Local government: whistleblower hotline.

Existing law authorizes a city, county, or city and county auditor or controller to maintain a whistleblower hotline to receive calls from persons who have information regarding possible violations by local government employees of state, federal, or local statutes, rules, or regulations, and requires any investigation conducted pursuant to this authorization to be kept confidential except where release of findings of a conducted investigation is deemed necessary to serve the interests of the public, except that the identity of the individual or individuals involved in the investigation is required to be kept confidential. This bill would specify that a city, county, or city and county auditor or controller may maintain the whistleblower hotline to receive calls from persons who have information regarding fraud, waste, or abuse, and would define those terms. The bill would also authorize the auditor or controller to provide a copy of a substantiated audit report or investigation to the appropriate appointing authority for disciplinary purposes, as specified.
