Relative to Child Abuse Prevention Month.

This measure would acknowledge the month of April 2016 as Child Abuse Prevention Month, and encourage the people of the State of California to work together to support youth-serving child abuse prevention activities in their communities and schools.

Relative to California Travel and Tourism Month.

This measure would proclaim the month of May 2016, and every May thereafter, as California Travel and Tourism Month to celebrate the leadership of California's tourism industry in growing California's economy and improving the quality of life for all Californians.

Relative to the Pomona Police Officer Shaun Diamond Memorial Highway.

This measure would designate the portion of Interstate 10 from the State Route 57 Interchange to the North Towne Avenue exit in the County of Los Angeles as the Pomona Police Officer Shaun Diamond Memorial Highway. The measure would also request the Department of Transportation to determine the cost of appropriate signs showing this special designation and, upon receiving donations from nonstate sources covering that cost, to erect those signs.

Teen Dating Violence Awareness and Prevention Month.

This measure would proclaim the month of February 2016 as Teen Dating Violence Awareness and Prevention Month, and would encourage all Californians to observe Teen Dating Violence Awareness and Prevention Month with programs and activities that raise awareness about teen dating violence.

Elections: ballots: ballot order.

Existing law requires all voting to be by ballot and requires each polling place to provide, at each election at which public officers are to be voted for, but one form of ballot for all candidates for public office, except for partisan primary elections, as specified. Existing law specifies the order of precedence of offices on the ballot and authorizes a county elections official to vary the order for certain offices and measures submitted to the voters, in order to allow for the most efficient use of space on the ballot in counties that use a voting system, as defined. Existing law requires state measures to always precede local measures. This bill, for the November 8, 2016, statewide general election only, would authorize a county board of supervisors to direct the county elections official to place a local measure related to local transportation finance above state measures. This bill would declare that it is to take effect immediately as an urgency statute.

California Sex Trade Buyer First Offender Program.

Existing law makes it a misdemeanor to solicit or agree to engage in, or to engage in, an act of prostitution. A misdemeanor is generally punishable by not more than 6 months in a county jail, a fine not exceeding $1,000, or both that fine and imprisonment in a county jail. Existing law imposes additional penalties, including a higher fine, a longer term of imprisonment, or a suspension of the privilege to operate a motor vehicle, as specified, upon a person who is convicted of committing the crime, under certain circumstances. This bill would authorize the court, in addition to any other penalty imposed by law, to require a person who has been convicted of providing, or offering or attempting to provide, money or another thing of value, in exchange for an act of prostitution, to attend and successfully complete a sex trade buyer first offender program approved by the probation department, if an approved program is available. The bill would require the probation department in each county to design and implement an approval and renewal process for sex trade buyer first offender programs in accordance with the requirements of the bill. Among other requirements for these programs, the bill would require that these programs provide 6 to 8 hours of education for each participant, including information regarding the legal consequences of subsequent offenses, health education, and the effects of the sex trade on sellers of sex and on the community, as specified. The bill would also require the probation department to adopt and implement procedures for approving a new or existing program, and for revoking or suspending approval of an existing program, as specified. By imposing a new duty on county probation departments, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.
