Motor vehicle replacement parts.

Existing law regulates the use of motor vehicle replacement parts, and prohibits an insurer from requiring the use of nonoriginal equipment manufacturer aftermarket crash parts, as defined, in the repair of an insured's motor vehicle, unless the consumer is advised, in the written estimate and invoice, of the use of the part. A violation of those provisions is a crime. This bill would require that the use of nonoriginal equipment manufacturer certified aftermarket crash parts, including the name of the certifying entity, also be identified on the written estimate and invoice. Because this bill would expand the scope of a crime, it would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Vehicles: driver's license requirements: farming exemption.

(1) Existing law provides that a person with a class C license may operate a motor vehicle or combination of motor vehicles of 26,000 pounds or less when it is operated by a farmer, an employee of a farmer, or an instructor credentialed in agriculture as part of a specified instructional program, it is used exclusively in the conduct of agricultural operations, and it is not used in the capacity of a for-hire carrier or for compensation. This bill would additionally authorize a class C licenseholder to operate, until January 1, 2018, a combination of vehicles with a specified gross combination weight rating and gross vehicle weight rating that meets specified operating conditions, including being operated by a farmer or an employee of a farmer and being operated within 150 miles of a farm. (2) Existing law excludes certain vehicles from the definition of a commercial motor vehicle for purposes of the Motor Carriers of Property Permit Act. This bill would exclude, from that act, until January 1, 2018, a pickup truck, as defined, or a vehicle that has a flatbed of less than 9 feet and meets certain conditions regarding its weight rating and operation. The bill would also exclude until January 1, 2018, a combination of vehicles with a specified weight rating that meets certain conditions regarding the weight rating and operation of those vehicles. (3) The bill would require the Department of the California Highway Patrol to submit a report, by January 1, 2017, to the Legislature, that evaluates the exemptions provided by the bill and recommends as to whether those exemptions should be continued. The bill would repeal the report requirement on January 1, 2021.

Foster Youth Higher Education Preparation and Support Act of 2012.

Existing law establishes the segments of the public postsecondary education system in the state, including the University of California administered by the Regents of the University of California, the California State University administered by the Trustees of the California State University, and the California Community Colleges administered by the Board of Governors of the California Community Colleges. Existing law establishes the Higher Education Outreach and Assistance Act for Emancipated Foster Youth, which requires the Trustees of the California State University and the Board of Governors of the California Community Colleges to perform specified services to assist emancipated foster youth. This bill would enact the Foster Youth Higher Education Preparation and Support Act of 2012, which would additionally require the California State University, and request the California Community Colleges and the University of California, to establish foster youth campus support programs, which are separate from the Higher Education Outreach and Assistance Act for Emancipated Foster Youth, to provide comprehensive support and outreach services, as specified, to current and former foster youth in an effort to retain foster youth in higher education. The bill would require the California State University, and request the California Community Colleges and the University of California, to designate a foster youth campus support program coordinator using new or existing resources. The bill would require the State Department of Social Services to annually notify foster youth 13 years of age or older, and those foster youths' caregivers, of the postsecondary educational support provided to them pursuant to this bill.

Fairs: sustainability.

Existing law governs fairs and expositions in this state, including the California Exposition and State Fair, county and district fairs, and citrus fruit fairs. Existing law divides the state into agricultural districts and authorizes 50 or more persons who are residents of a district to form district agricultural associations for the purpose of holding fairs, expositions, and exhibitions, as specified. Existing law provides that district agricultural associations are state institutions and are governed by a board of directors whose members are appointed by the Governor. Existing law authorizes an association to carry out specified duties with the approval of the Department of Food and Agriculture and the Department of General Services, including contracting and leasing its real property. Existing law establishes the Fair and Exposition Fund. Existing law provides for the deposit of various funds, including license fees from various activities related to horse racing, including satellite wagering, into the fund. Existing law authorizes the Department of Food and Agriculture to make and administer loans from the fund to any fair in the network of California fairs, as specified. This bill would establish the California Fair Network Commission as a separate, independent nonprofit mutual benefit corporation to assess the fairs fees for service and administrative oversight, as specified. The bill would authorize the commission to employ staff who are employees of the commission and would require the commission to adopt procedures concerning the operation of the commission. The bill would set forth a related statement of legislative findings and declarations.

Relative to National Multicultural Cancer Awareness Week.

This measure would designate the week of April 15 to 21, 2012, as "National Multicultural Cancer Awareness Week," and would encourage the promotion of policies and programs that seek to reduce cancer disparities and improve cancer prevention, detection, treatment, and followup care for all Californians.

Inmates: electronic monitoring.

Existing law authorizes the board of supervisors of any county to authorize the correctional administrator, as defined, to offer a program under which only inmates being held in lieu of bail in a county jail or other county correctional facility may participate in an electronic monitoring program if the inmate is not the subject of a hold or an outstanding warrant and any one of certain conditions are met. This bill would authorize a defendant arrested without a warrant for a bailable offense that is a felony punishable in a county jail to apply for release on a reduced bail if the defendant agrees to be placed in an electronic monitoring program administered by the county-authorized correctional administrator. This bill would declare that it is to take effect immediately as an urgency statute.

The Safe, Reliable High-Speed Passenger Train Bond Act for the 21st Century: project funding.

Existing law, pursuant to the Safe, Reliable High-Speed Passenger Train Bond Act for the 21st Century, approved by the voters as Proposition 1A at the November 4, 2008, general election, provides for the issuance of $9.95 billion in general obligation bonds for high-speed train capital projects and other associated purposes. Existing law makes $950 million of the proceeds of those bonds available for capital improvements to intercity and commuter rail lines and urban rail systems that provide direct connectivity to the high-speed train system and its facilities, or that are part of the construction of the high-speed train system, as specified, or that provide capacity enhancements and safety improvements. Existing law requires the California Transportation Commission to allocate those funds to eligible recipients, as defined, and to develop guidelines to implement those provisions. This bill would appropriate $523,400,000 from the High-Speed Passenger Train Bond Fund to the Department of Transportation for allocation by the California Transportation Commission as provided for in specified guidelines adopted by the commission.
