This measure would state the intent of both houses of the Legislature to begin each of their respective floor sessions, following the opening prayer and the pledge of allegiance to the flag, with a recitation of an excerpt from the United States Constitution, and to begin their respective floor sessions held nearest in time to the 4th of July of each year with a recitation of the full text of the Declaration of Independence.

Existing law authorizes the Governor to submit requisitions to the United States Secretary of Defense for arms or equipment not required by the Department of the Army or allotted to the State Military Reserve. Existing law authorizes the Governor to provide arms and equipment to the State Military Reserve that are not furnished by the Department of the Army and are required in the defense of the state. This bill would instead require the Governor to provide such arms and equipment in the absence of federal support.
Under existing law, a person in possession or control of property on or with respect to which a fee for the privilege of taking birds or mammals is imposed or collected, or on or with respect to which a fee for any type of entry or use permit that includes the privilege of taking birds or mammals on the property is imposed or collected, is maintaining a commercial hunting club if birds or mammals are taken on the property. Existing law requires a commercial hunting club to be licensed and provides for that licensure by the Department of Fish and Game. This bill would repeal those provisions governing commercial hunting clubs.
Existing law requires that a child be admitted to kindergarten at the beginning of a school year, or at any time later in the same year, if the child will have his or her 5th birthday on or before December 2 of that school year. An elementary school is required to admit a child to the 1st grade during the first month of a school year if the child will have his or her 6th birthday on or before December 2 of that school year. This bill would change the required birthday for kindergarten and 1st grade admission to November 1 for the 2010–11 school year, October 1 for the 2011–12 school year, and September 1 for the 2012–13 school year and each school year thereafter. An elementary school would be required, until and including the 2012–13 school year, to admit a child to the 1st grade if the child has completed one school year of kindergarten.
Existing law provides for various forms of relief and assistance to individuals, businesses, and local agencies, including tax relief, in the event of a disaster or other emergency. This bill would express the intent of the Legislature to enact legislation to simplify the procedures for individuals, businesses, and local agencies to obtain assistance and relief, as well as appropriate relief and suspension from their tax burdens, in the event of a disaster or other emergency.
The State Board of Equalization administers various taxes, including specified local sales, use, and transactions and use taxes. This bill would require the board to study the impact of new video and voice alternatives on local tax and fee revenues and report to the Legislature, as provided.
The Gambling Control Act provides for the licensure of certain individuals and establishments involved in various gambling activities, and for the regulation of those activities, by the California Gambling Control Commission. The act requires an application for a gambling license to be made on a specified form, and prohibits a local jurisdiction from authorizing an expansion of gambling, except as specified. This bill would provide that, notwithstanding the above provisions, a gambling establishment licensed by the commission and operating in the City of San Jose on January 1, 2010, may change its location within the County of Santa Clara by providing the commission with notice at least 3 months prior to that change. The bill would provide that these provisions do not supersede any local measure prohibiting or regulating gambling establishments.
The Public Employees' Retirement Law provides a comprehensive set of rights and benefits for members of the Public Employees' Retirement System based upon age, service credit, and final compensation. That law establishes retirement formulas, known as the Second Tier, modified First Tier, and First Tier, that are applicable to specified members of the retirement system. Under that law, a member who elects to be subject to Second Tier benefits shall be paid his or her accumulated contributions plus interest, subject to specified conditions. Under that law, effective January 1, 2000, a member who received service credit subject to Second Tier benefits may elect to become subject to First Tier benefits and contribution rates. That law requires a member who elects to become subject to First Tier benefits to deposit accumulated contributions the member withdrew while he or she was subject to Second Tier benefits, plus interest, as specified. This bill would make technical, and nonsubstantive changes to these provisions.
