Rep. John Rogers

Relating to the Coal Production Tax Credit; to amend Section 40-18-220, Code of Alabama 1975, to allow the credit to be claimed against both income and utility services taxes; to allow the credits to be earned by all persons that increase their production of coal mined in Alabama from the prior year; to allow any unused credits to be carried forward for no more than five years;

Relating to the employment of notaries public; to amend Sections 36-20-70, 36-20-71, 36-20-72, 36-20-73.1, 36-20-74, and 36-20-75, Code of Alabama 1975; to provide further for the appointment and service of notaries public; to increase the fee collected by the judge of probate for the commission of a notary; to expand the grounds under which a judge of probate may accept or deny an application for a notary commission; to require an applicant for a notary commission to complete a training program; to increase the bond required of a notary public; to provide further for the acknowledgment of signatures; to increase the fee collected for notarial acts performed; to specify the acts of a notary or other individual that constitute a crime; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Section 111.05 of the Constitution of Alabama of 2022.

Relating to contracts for professional services; to amend Section 41-4-133, Code of Alabama 1975, as last amended by Act 2022-357, to provide for the procurement of certain professional service contracts based on competitive, qualification-based policies and procedures; to provide for the advertisement of such contracts; and to subject such contracts to a fee schedule established by the Division of Construction Management of the Department of Finance, with exception.

Relating to motor vehicles; to add Section 32-5A-350.1 to the Code of Alabama 1975, to further provide for the prohibition against using a wireless telecommunications device while operating a motor vehicle; to further provide for the prohibition; to further provide exceptions; to further provide criminal penalties for a violation; to provide a warning period for a violation; to amend Section 32-5A-351, Code of Alabama 1975, to further provide for the assessment of administrative penalties; to repeal Section 32-5A-350, Code of Alabama 1975; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Section 111.05 of the Constitution of Alabama of 2022. Relating to criminal procedure; to further provide for pretrial supervision of certain offenders by the Board of Pardons and Paroles as a condition of their bond.

Relating to state government; to amend Sections 41-4-114, 41-4-120, 41-4-122 as last amended by Act 2022-357 of the 2022 Regular Session, 41-4-124, 41-4-125, Section 41-4-126 as last amended by Act 2022-357 of the 2022 Regular Session, 41-4-139, 41-4-172, 29-2-41.1 Code of Alabama 1975, to further provide exemptions to the state procurement code; to further provide for the authority to make emergency procurements and the review of those procurements by the Contract Review Legislative Oversight Committee; to provide for the procurement of certain health professionals who provide services to the Medicaid Agency under certain conditions; to further provide for the definition of professional services to include the management and administration of occupational licensing boards; to provide for the procurement of supplies, services, and professional services by district attorneys or sheriffs; to provide for the change of the name of the Office of the Chief Procurement Officer to the Division of Procurement; and to add Section 41-4-125.01 to the Code of Alabama 1975, to provide for the procurement of physicians retained to provide medical services to the State of Alabama.

Relating to crimes and offenses; to amend Section 13A-10-52, Code of Alabama 1975, to revise the criminal penalties for violations of fleeing or attempting to elude law enforcement; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Section 111.05 of the Constitution of Alabama of 2022.

Relating to public contracts; to amend Section 41-16-51, Code of Alabama 1975, to further provide for contracts for which competitive bidding is not required; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Section 111.05 of the Constitution of Alabama of 2022.

Relating to the Alabama Bail Reform Act of 1993; to amend Sections 15-13-107, 15-13-111, 15-13-114, 15-13-118, 15-13-125, 15-13-128, 15-13-131, 15-13-132, 15-13-134, 15-13-136, 15-13-137, 15-13-138, 15-13-139, 15-13-140, 15-13-141, 15-13-145, 15-13-159, 15-13-160, and 15-13-164, Code of Alabama 1975, to provide for the acceptance of certain filing fees by the sheriff or jailer; to further define cash bail and property bail; to provide further for the arrest and delivery of a defendant to jail by a surety with no court costs to be entered on the surety; to provide that a surety not be charged for a bondsman's process or for a certified copy of a bond; to require the license number of the bondsman or recovery on a bondsman's process form; to allow a surety to sign for a forfeiture with the clerk of the ordering court; to increase the time frame for which the ordering court has jurisdiction over a forfeiture action; to authorize a bail bondsman to file motions, answers, and notices relating to a defendant who is out on bond with that bondsman; to increase the time frames for providing notice and conducting hearings in conditional forfeiture proceedings; to remove the requirement that a conditional judgment to set aside be made absolute for the entire sum; to provide further for instances when a court may set aside forfeiture and may not release a defendant on judicial public bail; to provide further for eligibility for judicial public bail; to provide further for the amount of new corporate surety bonds and escrow agreements required in counties with populations of 200,000 or more; to provide further for criminal penalties for certain unlawful behavior; to make nonsubstantive, technical revisions to update the existing code language to current style; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Section 111.05 of the Constitution of Alabama of 2022.
