Use sick leave for the care of immediate familymembers. Requires employers with a sick leave program to allowan employee to use his sick leave for the care of an immediate familymember. The measure applies only to employers that have 25 or moreemployees and that provide paid sick leave that allows an employeeto be absent from work in the event of the employee's own incapacity,illness, or injury. The measure applies only to employees who workat least 30 hours per week, and it caps the amount of sick leavethat may be used for the care of immediate family members at fivedays per calendar year.

Criminal proceedings; consideration of mentalcondition and intellectual and developmental disabilities. Permitsthe admission of evidence concerning a defendant's mental conditionat the time of an alleged offense, including expert testimony, ifsuch evidence (i) tends to show the defendant did or did not havethe specific mental state required for the offense charged and (ii)is otherwise admissible pursuant to the general rules of evidence.If a defendant intends to present expert testimony evidence, the bill requires him or his counsel to give notice in writing to theattorney for the Commonwealth. The bill also clarifies that a diagnosisof an intellectual or developmental disability shall be consideredby a judicial officer for the purpose of rebuttal of a presumptionagainst bail and that a court may order that a sentencing reportprepared by a probation officer contain any diagnoses of an intellectualor developmental disability.

School Divisions of Innovation; performance-based assessments. Allows a local school board, when applying for itsschool division to be designated as a School Division of Innovation,to apply to the Board of Education to replace the Virginia Studiesand Civics and Economics Standards of Learning assessments with performance-basedassessments. The bill requires any such application to (i) demonstratethat the proposed performance-based assessment requires that studentsdemonstrate the knowledge and skills required by the relevant Standardsof Learning and that students demonstrate one or more of the skillsand qualities of critical thinking, creativity, collaboration, communication,or citizenship and (ii) provide evidence of the local school board'scapacity to administer and score performance-based assessments.
