Fines, costs, forfeitures, penalties, and restitution; collection fees; assessment against incarcerated individuals. Providesthat notwithstanding any other provision of law, no collection fees,including the fees of any private attorneys or collection agencies,administrative fees, or any other fees related to collection activities,shall be assessed for the collection of any fines, costs, forfeitures,penalties, or restitution imposed in a criminal case or in a caseinvolving a traffic infraction (i) for any period during which thedefendant is incarcerated and (ii) for a period of 90 days followingthe date of the defendant's release from incarceration if the sentenceincludes an active term of incarceration.

Minor victims of sex trafficking; services.Provides that a minor engaged in prostitution or keeping, residingin, or frequenting a bawdy place shall not be proceeded upon as delinquentand shall be referred to the local department of social servicesfor an assessment and services.

Virginia Residential Landlord and Tenant Act;landlord obligations; tenant safety. Requires a landlord whoowns more than four rental dwelling units, or more than a 10 percentinterest in more than four rental dwelling units, to require allemployees and applicants for employment to submit to fingerprintingand provide personal descriptive information to be forwarded alongwith the employee's or applicant's fingerprints through the CentralCriminal Records Exchange and the Federal Bureau of Investigationfor the purpose of obtaining criminal history record informationregarding such employee or applicant. The bill allows a landlordto disqualify from employment any person who has been convicted ofor found guilty of, or entered a plea of guilty or nolo contendereto, regardless of adjudication, a violent crime committed in anyjurisdiction. The bill also provides that a landlord must (i) establishwritten policies and procedure for the storage and management of,access to, and return of all keys for each rental dwelling unit;(ii) regulate the secure storage of and access to unissued keys;and (iii) maintain a written log for the issuance and return of allkeys. Finally, pursuant to the bill, all relevant landlords must submit certain information on a quarterly basis to the Department of Housingand Community Development to prove compliance with the provisionsoutlined in the bill.

Hospital regulations; policies and proceduresrelated to victims of domestic violence and sexual assault. Requireshospitals to develop and implement written policies and proceduresrelated to the screening and treatment of victims of domestic violenceand sexual assault.

Perinatal health care providers; implicit biastraining. Requires the Board of Health to amend its regulationsto require that each hospital develop and implement policies requiringall perinatal health care providers to complete an in-person andinteractive training on implicit bias.

Special Assistant to the Governor for DisabilityRights Advocacy; position created; report. Creates the positionof Special Assistant to the Governor for Disability Rights Advocacy (the Special Assistant) for the purpose of representing Virginianswith disabilities in a comprehensive and authoritative manner byensuring that all state agencies provide adequate services, resources,and accommodations to such persons. The bill directs the SpecialAssistant to submit an annual report to the Governor on or beforeDecember 1, through the Secretary of Health and Human Resources,that (i) outlines the key issues and problems discovered within stateagencies that impact people with disabilities; (ii) identifies thedetails of any plan of action implemented by the Special Assistantto address and remediate such issues and problems; (iii) provideslegislative recommendations that would improve processes and proceduresacross all state agencies with regard to the provision of services, resources, and accommodations to people with disabilities; and (iv)details such other matters as required by the Governor.

Food donations; labeling; liability. Exempts individuals and entities that donate food and charitable organizationsthat accept food donations from criminal and civil liability fordonating or receiving food past its best-by date or other non-safety labels so long as all parties are informed. The bill provides thatimmunity from liability shall not apply in instances of gross negligenceor intentional misconduct.

Right to unionize. Repeals the provisionsof the Code of Virginia that, among other things, prohibit any agreementor combination between an employer and a labor union or labor organizationwhereby (i) nonmembers of the union or organization are denied the right to work for the employer, (ii) membership in the union or organizationis made a condition of employment or continuation of employment bysuch employer, or (iii) the union or organization acquires an employmentmonopoly in any such enterprise.
