Consideration of bills that create immunityfrom civil liability for physical injuries or death caused to a person.Requires that any bill that creates immunity from civil liabilityfor physical injuries or death caused to a person include an appropriationof $50,000 to the Department of Medical Assistance Services for theprovision of medical assistance services as a condition of consideration by the General Assembly. The bill requires that the $50,000 appropriationbe included in a final enactment clause to such bill that createsimmunity and requires the Department of Planning and Budget, in conjunctionwith other state agencies, to ensure that the fiscal impact statement for such bill states that the bill creates immunity from civil liabilityfor physical injuries or death caused to a person.

Failure to advise of consequences of guiltyplea; vacation of conviction. Creates a mechanism for a personwho is not a citizen of the United States to vacate a criminal convictionor adjudication of delinquency, other than for a violent felony oran offense that requires sex offender registration, if such personwas not advised of the possible adverse consequences of such convictionor adjudication on his immigration status (i) for any conviction ofsuch offense entered on or before July 1, 2019, or (ii) if the petitionerreceived actual notice that he is subject to deportation or removalfrom the United States, exclusion from admission to the United States, or denial of naturalization under federal law as a result of enteringa plea of guilty or nolo contendere to such offense and such petitionis filed within one year after receiving such notice. The bill providesthat such person may file a petition with the appropriate circuitcourt, which may hold a hearing on the petition and either dismissthe petition or vacate the person's conviction or adjudication andorder a retrial. The bill also provides that only one such petitionmay be filed.
Abolition of the death penalty. Abolishesthe death penalty, including for those persons currently under adeath sentence.
Civil action; sale of personal data. Requiresa person that disseminates, obtains, maintains, or collects personaldata about a consumer for a fee to implement security practices toprotect the confidentiality of a consumer's personal data, obtainexpress consent of a parent of a minor before selling the personaldata of such minor, provide access to consumers to their own personaldata that is held by the entity, refrain from maintaining or sellingdata that it knows to be inaccurate, and provide a means by whicha consumer can opt out of the sale of his personal data. The billprovides that a violation could result in a civil penalty of up to$7,500 or damages to be awarded to a consumer. The bill also providesfor the award of attorney fees and costs.
Aboveground storage tanks; Hazardous Substance Aboveground Storage Tank Fund; civil and criminal penalties. Directs the State Water Control Board to regulate aboveground storage tanks that measure more than 1,320 gallons in capacity and are used to contain hazardous substances other than oil. The bill directs the Board to adopt regulations that establish requirements for registration, certification, and inspection, and other requirements of tank owners, and that establish a schedule of fees. The bill authorizes the Board to undertake corrective action, or to require the owner to undertake corrective action, in the event of a discharge of a hazardous substance. The bill requires tank owners to register their tanks, pay certain registration fees, develop release response plans, upgrade certain older tanks, install containment infrastructure for certain aboveground storage tanks, notify certain parties in the event of a release of a regulated substance, and demonstrate their financial responsibility. The bill also creates the Hazardous Substance Aboveground Storage Tank Fund for the administration of the bill and provides for civil and criminal penalties for violations of requirements of the bill, with the moneys received to be deposited into the existing Virginia Environmental Emergency Response Fund.

Land subdivision and development; release of performance guarantees. Prohibits the final complete release of any remaining bond, escrow, letter of credit, or other performance guarantee required of a subdivider or developer by a governing body for the construction of certain public facilities until each common area, if any, is transferred from the subdivider or developer to a property owners' association.
Collective bargaining for public employees.Repeals the existing prohibition on collective bargaining by publicemployees. The bill creates the Public Employee Relations Board,which will determine appropriate bargaining units and provide forcertification and decertification elections for exclusive bargainingrepresentatives of state employees and local government employees.The measure requires public employers and employee organizationsthat are exclusive bargaining representatives to meet at reasonabletimes to negotiate in good faith with respect to wages, hours, andother terms and conditions of employment. The measure repeals a provisionenacted in 2013 that declares that, in any procedure providing for the designation, selection, or authorization of a labor organizationto represent employees, the right of an individual employee to voteby secret ballot is a fundamental right that shall be guaranteedfrom infringement.
State Corporation Commission; members. Increasesfrom three to five the number of members of the State CorporationCommission. The measure requires that the new members be initiallyelected for a six-year term during the earlier of the 2021 Regular Session of the General Assembly or any special session convened priorthereto.
