Driving under the influence; remote alcohol monitoring; penalty. Provides that in the case of an adult offender's first conviction of driving under the influence when the offender's blood alcohol content was less than 0.15, upon motion of the offender, the sole restriction of the offender's restricted driver's license shall be the prohibition of the offender from operating any motor vehicle not equipped with a functioning, certified ignition interlock system for one year without any violation of the ignition interlock system requirements. The bill provides that if a person is ineligible to receive a restricted license, a court may instead authorize such person to use a remote alcohol monitoring device, refrain from alcohol consumption, and participate in an alcohol safety action program; such provisions of the bill shall become effective on July 1, 2021. The bill provides that tampering with a remote alcohol monitoring device is a Class 1 misdemeanor. This bill incorporates SB 154 and SB 520.

Suspension of driver's license for nonpayment of fines or costs. Repeals the requirement that the driver's license of a person convicted of any violation of the law who fails or refuses to provide for immediate payment of fines or costs be suspended. The bill also removes a provision allowing the court to require a defendant to present a summary prepared by the Department of Motor Vehicles of the other courts in which the defendant also owes fines and costs. The bill requires the Commissioner of the Department of Motor Vehicles to return or reinstate any person's driver's license that was suspended prior to July 1, 2019, solely for nonpayment of fines or costs. Such person does not have to pay a reinstatement fee. The bill contains an emergency clause and incorporates SB 10, SB 514, and SB 814.
Funeral directors and embalmers; Board to promulgate regulations for licensure. Directs the Board of Funeral Directors and Embalmers to promulgate regulations that establish requirements of licensure for funeral directors and embalmers.
Inquiry and report of immigration status; personscharged with or convicted of certain crimes. Removes provisionsrequiring (i) jail officers to ascertain the citizenship of any inmatetaken into custody at a jail, (ii) probation and parole officersto inquire as to the citizenship status of an individual convictedof a felony in circuit court and referred to such officers, and (iii)officers in charge of correctional facilities to inquire as to thecitizenship of any person committed to a correctional facility, and therefore such information is not required to be reported to theCentral Criminal Records Exchange of the Department of State Police.The bill also removes the mandatory duty of the clerk of a courtcommitting a convicted alien to a correctional facility to furnishrelated court records to a United States immigration officer andthe requirement that an intake officer report to the Bureau of Immigrationand Customs Enforcement of the U.S. Department of Homeland Securityany juvenile detained on an allegation that the juvenile, believedto be in the United States illegally, committed a violent felony.
Contracts with design professionals; provisionsrequiring a duty to defend void. Provides that a provision containedin a contract between an architect or professional engineer and anypublic body relating to the planning or design of a building requiringthe architect or professional engineer to defend another party tothe contract or a named indemnitee against liability for damage arisingout of bodily injury to persons or damage to the property sufferedin the course of the performance of the contract that is caused byor that resulted solely from the negligence of such other party isagainst public policy and is void and unenforceable.
Alcoholic beverage control; winery license privileges. Allows winery licensees to sell at retail the brands of wine thatthe winery owns (i) at premises described in the winery license foron-premises consumption or in closed containers for off-premisesconsumption or (ii) in approved areas at four special events peryear for on-premises consumption or in closed containers for off-premisesconsumption, provided that not less than 20 percent of the volumeof wine sold for on-premises consumption in any calendar year ismanufactured on the licensed premises.
Energy efficiency; Commonwealth Efficient andResilient Buildings Board. Establishes the Commonwealth Efficientand Resilient Buildings Board to advise the Governor, the Virginia Public Building Authority, and all state agencies, departments, authorities, institutions of higher learning, and political subdivisionson accelerating improvements to state buildings to reduce greenhousegas emissions and improve resiliency. The Board shall be composedof eleven members, including three nonlegislative citizen membersto be appointed by the Governor. The Directors of the Departmentsof General Services, Mines, Minerals and Energy, and Planning andBudget, or their designees; the Secretaries of Education, Finance,and Natural Resources, or their designees; the Special Assistant tothe Governor for Coastal Adaptation and Protection; and the Chairmanof the Virginia Public Building Authority shall serve ex officiowith voting privileges. The billalso requires the head of each state agency to designate an existingemployee, known as an energy manager, who shall be responsible forimplementing improvements to state buildings to reduce greenhousegas emissions and improve energy efficiency and climate change resiliency. The Board has a sunset date of July 1, 2030.
Fairfax County; policemen's pension and retirementboard. Increases from seven to eight the number of members onthe policemen's pension and retirement board created in a countythat has adopted the urban county executive form of government (FairfaxCounty) and increases from two to three the number of members ofsuch board who shall be members of such retirement system and employedby the county police department as sworn police officers and whohave been elected by the members of the retirement system who areemployed by the police department as sworn police officers.
Provision of mental health services to a minor;access to health records. Prohibits a health care provider fromrefusing to provide mental health services to a minor on the basisthat the parents of such minor refuse to agree to limit their accessto such minor's health care records or request that such health careprovider testify in a court proceeding regarding the treatment ofthe minor.
Fairfax County; policemen's retirement system. Authorizes any person who has been a member of another county retirement system and who withdraws therefrom and becomes a member of the policemen's retirement system established by a county that has adopted the urban county executive form of government (Fairfax County) to purchase membership service credit for service rendered while a member of such other county retirement system by paying into the policemen's retirement system all contributions that would have been due from the person had the person been a member of the policemen's retirement system for each of the years for which membership service credit is sought. The bill contains technical amendments.
