Income tax, corporate and state; credit for braille labeling program.

Income tax credit; braille labeling program. Creates a nonrefundable individual and corporate income tax credit, as applicable, for taxable years 2026 through 2030 for up to $50,000 of expenditures incurred in the development and implementation of a braille labeling program on products, items, or packages sold in or shipped within the Commonwealth. The bill specifies that the aggregate amount of such credits allowed for all taxpayers in a taxable year is $500,000 and that any credit not usable for the taxable year in which it is first allowed shall not be carried over for credit in any succeeding taxable year.

Lobbying; expands definition to include influencing/attempting to influence local government action.

Lobbying; registration; local governments; penalty. Expands the definition of "lobbying" to include influencing or attempting to influence local government action, defined in the bill, or solicitation of others to influence a local government official, also defined in the bill. Current law limits such influencing to executive or legislative action and soliciting to executive or legislative officials. The bill requires the Secretary of the Commonwealth to prepare a list of the positions and names of local government officials to be revised at least semi-annually and made available to lobbyists to assist them in complying with the provisions of the bill. The bill has a delayed effective date of May 1, 2027.

Tax administration; award for tax underpayment detection assistance. Authorizes the Tax Commissioner to award monetary compensation to individuals who provide information that assists the Department of Taxation in the successful collection of delinquent state taxes owed by other individual or business taxpayers. The bill provides that such awards may be given only if (i) the underpaying individual taxpayer's gross income exceeds $100,000 or the underpaying business taxpayer's gross income exceeds $500,000 and (ii) the amount in question exceeds $50,000.

Virginia College Opportunity Fund; established, reports.

Commonwealth Savers Plan; Virginia College Opportunity Endowment and Fund established; report. Establishes (i) the Endowment Scholarship Program for the purpose of providing scholarships to students at eligible institutions, as defined in the bill; (ii) the Virginia College Opportunity Endowment as an agency of the Commonwealth for the purpose of establishing and administering the Endowment Scholarship Program; and (iii) as subfunds of the Commonwealth Savers Plan fund, (a) the DB529 Fund for the purpose of holding in trust the assets of prepaid tuition contracts to meet contractual obligations and (b) the Virginia College Opportunity Fund (the Opportunity Fund), into which certain funds from the DB529 Fund shall be deposited for the purpose of funding, by income generated from investments of such deposits, the Endowment Scholarship Program and other applicable programs, as set forth in the bill. The bill requires the Commonwealth Savers Plan (the Plan) to (a) after the fiscal year beginning on July 1, 2026, deposit $500 million into the Opportunity Fund from the DB529 Fund; (b) each fiscal year thereafter, in accordance with the timeline set forth in the bill, submit to the General Assembly a report on the funded status, as defined by applicable law, of the DB529 Fund and the recommendations of the Plan on the prudence of directing deposits, and the amounts of any such deposits, of additional actuarial surpluses of the Plan from the DB529 Fund into the Opportunity Fund; and (c) each subsequent year, deposit additional actuarial surpluses into the Opportunity Fund in accordance with the provisions of the bill. The bill also requires the Joint Legislative Audit and Review Commission to, no less than biennially, complete an independent evaluation and risk assessment of the Plan's risk assessment model, assumptions, and other measures employed by the Plan relating to the DB529 Fund and Opportunity Fund. Finally, the bill contains provisions (1) relating to voluntary contributions to the Opportunity Fund for the purpose of receiving tax fund contributions and income tax deductions, and (2) exempting from mandatory disclosure requirements certain information contained in a public record relating to the Commonwealth Savers Plan or the Virginia College Opportunity Endowment and Fund.

Motor vehicle collisions; preservation and collection of certain mobile telephone data.

Motor vehicle collisions; preservation and collection of certain mobile telephone data; collision reports. Allows an attorney who has certified that he represents a party involved in a motor vehicle collision to request in writing that the mobile telephone provider of another party alleged to have caused or contributed to the cause of such collision preserve for a period of 180 days from the date of such preservation request certain information related to such other party's mobile telephone. In addition, the bill requires any collision report filed as a result of such collision to include the mobile telephone number, mobile telephone provider, and International Mobile Equipment Identity (IMEI) number for any driver involved in a motor vehicle collision. The bill also creates a rebuttable presumption of spoliation of evidence where a person refuses to provide such information to a law-enforcement officer for such collision report and where such refusal materially prevents another person involved in such collision from showing liability for the collision.
