Liability of general contractor for wages of subcontractor's employees. Provides that there is a valid defenseto a claim of nonpayment of wages by a general contractor to a subcontractor's employees if the general contractor obtains a written certificationthat (i) the subcontractor and each of his sub-subcontractors haspaid all employees all wages due for the period during which thewages are claimed for the work performed on the project and (ii) to the subcontractor's knowledge all sub-subcontractors have also paidtheir employees. The bill also provides that the terms "general contractor" and "subcontractor" shall not include persons solely furnishing materials for the purposes of the liability of a contractor for wagesdue to a subcontractor's employees.

Local school divisions; in-person learning.Requires each local school division to make in-person learning availableto all students by choice of the student's parent or guardian. Thebill contains an emergency clause.
Environmental permit fees. Directs the VirginiaWaste Management Board to adopt regulations to collect from any personoperating certain facilities permitted for the disposal, storage,or treatment of nonhazardous solid waste such annual fees as arenecessary to provide funding for the total direct costs of the nonhazardoussolid waste management program when aggregated and combined withother existing fees. The bill also directs the State Water ControlBoard to adopt regulations specifying permit maintenance fees thateach permitted facility shall pay to the Board for certain waterquality or withdrawal permits. The bill requires the fee amountsto be set at an amount that is necessary to collect no less than40 percent and no greater than 50 percent of the direct costs requiredfor the administration, compliance, and enforcement of such permits.The bill contains enactment clauses that (i) direct the relevantBoards to adopt such regulations by January 1, 2022, and (ii) providefor the expiration of existing provisions for similar permit feescontingent upon the adoption of such regulations.
Conservation easements; construction. Providesthat an easement held pursuant to the Virginia Conservation EasementAct or the Open-Space Land Act be liberally construed in favor ofachieving the conservation purposes for which it was created.
Attorneys; granting certificates without examination. Provides that the Supreme Court of Virginia shall have the discretionto grant a certificate to practice law without examination to anattorney who has (i) been admitted to practice law before the courtof last resort of any state or territory of the United States orthe District of Columbia for at least two years; (ii) made at leastsix pro hac vice appearances in a court in the Commonwealth, whetherstate or federal; and (iii) obtained a juris doctor or LL.M. degreefrom an accredited law school in the United States that was approvedby the American Bar Association.
Farmers market food and beverage sales consideredessential during state of emergency. Provides that any Commonwealth-basedseller at a farmers market of food or beverage products, and thefarmers market in which it is located, shall be considered an essentialbusiness to the same extent as grocery stores if such stores areallowed to remain open as essential businesses during a state ofemergency declared by the Governor.
Taxation of public service corporations; electric suppliers; storage. Amends the definition of electric supplier to include certain battery storage facilities with a storage capacity greater than 25 megawatts and subjects such facilities to central assessment by the State Corporation Commission. The bill also requires battery storage facilities qualifying as electric suppliers to file an annual report to the Commission.The bill also defines "energy storage system" as equipment, facilities, or devices that are capable of absorbing energy, storing it for a period of time, and redelivering that energy after it has been stored. The bill provides that energy storage systems shall be considered certified pollution control equipment and facilities and shall be exempt from local property taxation. The tax exemption applies only to certain projects with alternating current (AC) storage capacity of more than five megawatts and less than 150 megawatts. The bill also provides that a locality may assess a revenue share of up to $1,400 per megawatt of alternating current (AC) storage capacity on energy storage systems.

Certain emergency and quarantine orders; additional procedural requirements. Provides that any person who is affectedby an order of quarantine may file an appeal in the circuit courtfor the city or county in which he resides or is located or the circuitcourt for the jurisdiction or jurisdictions for any affected area;currently, only a person who is subject to an order of quarantinemay appeal the order. The bill also provides that in any case inwhich the Governor has issued an emergency order that includes anymeasure that closes schools or businesses or restricts the movementof healthy persons within the area to which the order applies, allof the rights, protections, and procedures applicable in the caseof an order of quarantine issued by the Commissioner of Health shall apply.
