Campaign finance; prohibited contributions to candidates.

Campaign finance; prohibited contributions to candidates. Prohibits candidates, campaign committees, and political committees from soliciting or accepting contributions from any public utility, as defined in relevant law, and prohibits any public utility or political action committee established by such public utility from making any such contribution. The bill also provides that its provisions shall not be construed to prohibit the solicitation or acceptance of contributions from a political action committee established by the employees of a public utility. Under the bill, such political action committee may be administered by the public utility so long as no general treasury funds of the public utility are used for the purposes of making contributions to any candidate, campaign committee, or political committee.

School breakfasts; availability at no cost to students.

School breakfast; availability at no cost to students. Requires each school board to require each public elementary and secondary school in the local school division to participate in the federal National School Lunch Program and the federal School Breakfast Program administered by the U.S. Department of Agriculture and to make breakfast available to any student who requests such a meal at no cost to the student, unless the student's parent has provided written permission to the school board to withhold such a meal from the student. The bill requires the Department of Education to reimburse each public elementary and secondary school for each school breakfast served to a student, with a maximum of one breakfast per student per school day, and provides the formula for determining the state reimbursement rate for such meals. Finally, the bill repeals a provision of law relating to the federal School Breakfast Program that is rendered obsolete by the provisions of the bill.

Data centers; taxes on banks that are tenants of a center.

Bank franchise tax; retail sales and use tax; tangible personal property tax; data centers. Provides that on and after July 1, 2026, if any tenant of a data center is a bank, then the retail sales and use tax exemption for data center computer equipment shall not apply to the data center operator and any tenants of the data center. The bill also adds computer equipment and peripherals of all banks used in a data center to personal property that is taxable for banks subject to the bank franchise tax in lieu of most other taxes.

Office of the Executive Secretary of the Supreme Court of Virginia; guardians ad litem; mandatory appointment in custody or visitation cases involving a minor. Requires the Office of the Executive Secretary of the Supreme Court of Virginia (OES) to evaluate the current discretionary appointment of a guardian ad litem in cases where the custody or visitation of a minor child is at issue. The bill requires OES to make a recommendation as to whether the appointment of a guardian ad litem shall be mandatory in all such cases, and to consider the potential impacts of making such an appointment mandatory, including possible delays in hearings if there is not an adequate number of qualified attorneys capable of assuming such duties for the increased number of cases, and any fiscal impacts. The bill directs OES to submit its evaluation, including any observations and recommendations, to the General Assembly no later than January 1, 2027.

Provides that the plan established by the Department of Human Resource Management for the provision of health insurance coverage for state employees shall include coverage for medically necessary prosthetic devices and their repair, fitting, replacement, and components.

Child custody cases; Jud. Council of Va., et al., to evaluate representation by guardians ad litem.

Judicial Council of Virginia, Virginia State Bar, and Virginia Bar Association; work group to evaluate representation by guardians ad litem in child custody cases; report. Directs the Judicial Council of Virginia, in conjunction with the Virginia State Bar and the Virginia Bar Association, to convene a work group composed of relevant stakeholders to evaluate the ratio of cases involving the custody of a child to the number of reasonably available qualified guardians ad litem throughout the Commonwealth and to make recommendations relating to additional support that may be needed based on such ratios. The bill requires the work group to report such findings and recommendations to the Chairs of the House and Senate Committees for Courts of Justice by November 30, 2026.

Collective bargaining by public employees; exclusive bargaining representatives.

Collective bargaining by public employees; exclusive bargaining representatives. Repeals the existing prohibition on collective bargaining by public employees. The bill creates the Public Employee Relations Board, which shall determine appropriate bargaining units and provide for certification and decertification elections for exclusive bargaining representatives of state employees and local government employees. The bill requires public employers and employee organizations that are exclusive bargaining representatives to meet at reasonable times to negotiate in good faith with respect to wages, hours, and other terms and conditions of employment. The bill repeals a provision that declares that, in any procedure providing for the designation, selection, or authorization of a labor organization to represent employees, the right of an individual employee to vote by secret ballot is a fundamental right that shall be guaranteed from infringement. The bill has a delayed effective date of July 1, 2026. This bill incorporates SB 964, SB 1033, and SB 1401 and is identical to HB 2764.
