Coal tax credits; sunset date.

Sunset of coal tax credits. Sunsets the Coal Employment and Production Incentive Tax Credit and Coalfield Employment Enhancement Tax Credit after tax year 2021 and prohibits the allocation of such credits on and after January 1, 2022. The bill provides that if Coal Employment and Production Incentive Tax Credit credits were earned prior to January 1, 2022, the credit holder may claim the credits in subsequent tax years pursuant to the applicable carryover requirements of current law; however, such credit holders would be limited to claiming $1 million in carryover credits per taxable year. The bill directs the Department of Mines, Minerals and Energy to convene a stakeholder process to report by December 1, 2021 on recommendations for how the Commonwealth can provide economic transition support to the coalfield region.

Probation, revocation, and suspension of sentence; limitations on sentence, technical violation.

Probation, revocation, and suspension of sentence; limitations. Limits the amount of active incarceration a court can impose as a result of a revocation hearing for a probation violation. The bill provides that if the court finds the basis of a violation of the terms and conditions of a suspended sentence or probation is that the defendant was convicted of a criminal offense or violated another condition other than a technical violation, the court may pronounce whatever sentence might have been originally imposed. The bill defines "technical violation" and provides specific limitations on the sentence a court may impose depending on whether the violation is a first, second, or third or subsequent technical violation. The bill also provides that a court may fix the period of probation for up to the statutory maximum period for which the defendant might originally have been sentenced to be imprisoned and any period of supervised probation shall not exceed five years from the release of the defendant from any active period of incarceration. The bill also provides that a court must measure any period of suspension of sentence from the date of entry of the original sentencing order.

Charitable Gaming Board; regulations; electronic pull tabs. Prohibits the Charitable Gaming Board from promulgating regulations that prohibit the use of multiple video monitors or touch screens on an electronic pull tab device and provides that the use of electronic pull tab devices utilizing multiple video monitors or touchscreens shall be limited to one player at a time.

Broadband services; school boards to appropriate funds for expansion of services for education.

Broadband services; education. Authorizesschool boards to appropriate funds for the purposes of promoting,facilitating, and encouraging the expansion and operation of broadbandservices for educational purposes. The bill authorizes school boardsto partner with private broadband service providers to promote, implement,and subsidize broadband for educational purposes to the householdsof students who would qualify for (i) a child nutrition program or(ii) any other program recognized or adopted by the local schoolboard as a measuring standard to identify at-risk students.

Virginia Freedom of Information Act; meetings held through electronic communication means.

Virginia Freedom of Information Act; meetingsheld through electronic communication means during a state of emergency.Allows a public body, or a joint meeting thereof, to meet by electroniccommunication means without a quorum of the public body physicallyassembled at one location when a locality in which the public bodyis located has declared a local state of emergency, provided that(i) the catastrophic nature of the declared emergency makes it impracticableor unsafe to assemble a quorum in a single location and (ii) thepurpose of the meeting is to provide for the continuity of operations of the public body or the discharge of its lawful purposes, duties,and responsibilities. Under current law, public bodies may only meetin such manner when the Governor has declared a state of emergency,and only for the purpose of addressing the emergency. Finally, thebill requires public bodies meeting through electronic communicationmeans during a local or state declaration of a state of emergencyto (a) make arrangements for public access to such meeting throughelectronic communication means, including videoconferencing if alreadyused by the public body, and (b) provide the public with the opportunityto comment at such meetings when public comment is customarily received.

Labor, Secretary of; position created in Governor's Cabinet.

Governor's Secretaries; Secretary of Labor created. Creates in the Governor's Cabinet the position of Secretary of Labor. The bill transfers from the Secretary of Commerce and Trade to the Secretary of Labor responsibility for the Department of Labor and Industry, the Department of Professional and Occupational Regulation, and the Virginia Employment Commission. The bill removes the position of Chief Workforce Development Advisor and reassigns its duties to the Secretary of Labor. The bill also adds the Secretary of Labor to the Governor's comprehensive economic development policy committee.

Standards of Learning; reading & mathematics assessments for students in grades three through eight.

Standards of Learning assessments; reading and mathematics; grades three through eight; individual student growth. Requires the Board of Education to establish, in lieu of a one-time end-of-year assessment and for the purpose of providing measures of individual student growth over the course of the school year, a through-year growth assessment system, aligned with the Standards of Learning, for the administration of reading and mathematics assessments in grades three through eight. The bill requires such through-year growth assessment system to include at least one beginning-of-year and one end-of-year assessment in order to provide individual student growth scores over the course of the school year, provided that the total time scheduled for taking all such assessments shall not exceed 150 percent of the time scheduled for taking a single end-of-year proficiency assessment. The bill requires the Department of Education to ensure adequate training for teachers and principals on how to interpret and use student growth data from such assessments to improve reading and mathematics instruction in grades three through eight throughout the school year. The bill requires such through-year growth assessment system to be fully implemented in each local school division no later than the 2024-2025 school year.

Directs the Commonwealth TransportationBoard, in consultation with the Secretaries of Transportation andCommerce and Trade, to develop criteria to be used in the award offunds for access roads to economic development sites. Sports betting; clarifies certain procedures.

Clarifiesthe procedures by which the Virginia Lottery determines whether anevent is considered youth sports, on which betting is prohibited.The bill clarifies that a permit issued to a casino operator shallnot count toward the maximum of 12 permits that the Director of theVirginia Lottery can issue and makes technical amendments relatedto the interaction between sports betting law and casino gaming law.
