Utility easements; encroachments.

Utility easements; encroachments. Declaresthat the damages to which a provider of utility services is entitledwhen the owner of the servient tract improves, occupies, or otherwiseencroaches on an easement in which the provider has utility facilitiesshall be determined only on the basis of (i) any reduction in thevalue of such easement as a result of such construction, occupation,or other encroachment and (ii) the additional costs reasonably anticipatedto be incurred by the entity in its provision of utility services.If the owner of the servient tract and the provider are unable to agree upon the appropriate amount of damages, either party may requestthe State Corporation Commission to determine the amount.

Police animals; killing or injuring, penalty.

Killing or injuring police animals; penalty. Provides that the punishment for any person who maliciously kills or injures an animal owned, used, or trained by a law-enforcement agency, regional jail, or the Department of Corrections, while such animal is performing its lawful duties or is being kept in a kennel, pen, or stable while off duty, shall be separate and apart from, and shall be made to run consecutively with, any other sentence.

Military-overseas ballots; electronic return of voted ballots, report.

Study; Secretary of Administration;State Board of Elections; electronic return of voted military-overseasballots; pilot program; report. Requests the Secretary of Administrationto oversee and develop a charter and directives for the State Boardof Elections to form a working group to study implementation of electronicreturn of voted military-overseas ballots. In conducting its study, the State Board of Elections with the working group shall study anddevelop initial instructions and procedures that (i) consider issuesrelated to accessibility, auditability, authentication, verification,and security through encryption, in order to ensure that any processimplemented would guarantee the accuracy and integrity of voted military-overseasballots, and (ii) recommend (a) security measures necessary to reasonablysecure the transmission, processing, and storage of voter data frominterception and unauthorized access; (b) methods for verifying andauthenticating the identity of the voter electronically when registeringto vote and when requesting a ballot from and returning a ballotto the voter's jurisdiction; (c) methods for the encryption of votedballots; and (d) a procedure for security reviews after an election.The study shall focus on implementation of electronic return of votedmilitary-overseas ballots first as a limited pilot program in 2021,and later on a statewide basis.

Child support enforcement; Department of Social Services to distribute support payments.

Department of Social Services; child supportenforcement; distribution of support payments. Requires the Departmentof Social Services, in cases in which the Department receives child support payments, to enter into an agreement with the obligee thatshall include information regarding the Department's duty to disbursesupport payments to the obligee and establish a date by which suchdisbursements shall be made each month. The bill requires the Department, if it does not receive a support payment at least two days beforethe date scheduled for disbursement, to issue to the obligee a paymentin the amount that would have been distributed had the obligor'ssupport payment been timely received.
